Mr. Cox offered the following resolution : Resolved, That in the opinion of this house the printing given to Messrs. Clarke & Co. was only the incidental printing of the proceedings of this house. Mr. Teas called for the previous question, and it being put, "Shall the main question be now put?" It was decided in the affirmative. The main question was then put, and the yeas and nays being called for, were as follows: Yeas: Messrs. Box, Boyls, Brunson, Brunet, Childs, Cornwall, Cox, Durkee, M'Gregor, M'Knight, M'Williams, Parkinson, Reynolds, Sheldon, Smith, Shanley, Sholes, Teas, and, Leffler, speaker-19. Nays: Messrs. Blair, Chance, Engle, Jenkins, Quigley, and Wheeler-6. So the resolution was adopted. Mr. Quigley offered the following resolution: Resolved, That it is an established principle of law and justice, that no man nor body of men can take advantage of their own mistakes, and that this house has not the power of abrogating a solemn contract with a second party, entered into by themselves, without the consent of said second party. Mr. Parkinson moved to lay the resolution on the table until the 4th of July next, and called for the yeas and nays. The yeas and nays being taken, It was decided in the affirmative. Those who voted in the affirmative are, Messrs. Boyls, Brunson, Brunet, Childs, Cornwall, Cox, Durkee, M'Knight, M Williams, Parkinson, Reynolds, Sheldon, Smith, Shanley, and Sholes-15. Mr. Engle offered the following resolution : Resolved, That the resolution of this house, adopted on the 7th of Nov., appointing James Clarke & Co. printers to this house, does give the printing of the journal of the present session to those gentlemen, whatever may have been the indivi dual opinion of members concerning their intention as to the extent of the said resolution. On motion of Mr. Shanley, The said resolution was indefinitely postponed. Ayes, 17-Nays, 4. Mr. Engle offered the following resolution: Resolved, That the resolution of this house, passed on the 7th day of Nov. last, electing Jas. Clarke & Co., printers to this house, stands as the judgment of this house, and cannot be altered or rescinded by any other resolution which this house may adopt. Mr. Cox moved to lay the resolution on the table till the 4th day of July next. And the question being taken, It passed in the affirmative. On motion of Mr. Parkinson, Resolved, That a select committee be appointed to draft a memorial to Congress, praying for an appropriation for the improvement of the navigation of the Pecatonica river, and that said committee report to this house on to-morrow. Messrs. Parkinson, Smith, M'Knight, Shanley, and Cox, were appointed the committee. Mr. Brunson, from the committee on engrossed bills, reported bill No. 41 to be correctly engrossed. Mr. Sheldon, chairman of the committee on the militia, reported a memorial to the secretary of war, relating to the defence of the frontier, which was read a first, second, and third time, passed, and ordered to be sent to the council for concur rence. Message from the Council, by the secretary: "Mr. Speaker,-The Council has concurred in bill No. 37, A bill to divorce Mary M'Arthur, from her husband, John M'Arthur;' and has receded from the disagreeing vote on the amendment made by the House of Representatives to the joint resolution in relation to the printing of the laws in the several papers of this territory. "The amendment is concurred in." And then he withdrew. Mr. Quigley, by leave, introduced bill No. 46, entitled "A bill to establish the boundary lines of the counties of Dubuque, Clayton, Jackson, Benton, Linn, Jones, Clinton, Johnson, Scott, Delaware, Buchanan, Cedar, Fayette, and Keokuck, and to provide for the location of the seats of justice in said counties, and for other purposes;" which was read the first time, and laid on the table. Mr. Nowlin, by leave, introduced bill No. 47, entitled "A bill to provide for the assessment and collection of territorial taxes," which was read the first time, and, on motion of Mr. Quigley, Was laid on the table. Bill No. 10, C. F., entitled "A bill organizing a board of county commissioners in this territory," was read the first time, and Referred to the following select committee, viz: Messrs. Engle, Quigley, Chance, Parkinson, and M.Williams. On motion of Mr. Chance, The house adjourned to 3 o'clock, P. M. 3 O'CLOCK, P. M. On motion of Mr. Shanley, the House resolved itself into committee of the whole, Mr. Durkee in the chair, for the consideration of bill No. 4, entitled " A bill relating to the militia and public defence of the territory of Wisconsin. After some time the committee rose, reported by their chairman the progress made therein, and asked leave to sit again. Leave was granted. Mr. M Williams made a motion to adjourn, and the question being put, It was decided in the negative. Mr. Brunson moved a reconsideration of the vote of yesterday, on the motion made by Mr. Chance, laying a resolution respecting printing, on the table until the fourth of July next. Mr. Chance moved a call of the house. The roll was called, and absent members sent for. Mr. M'Knight moved to adjourn, and, the question being taken, It was decided in the affirmative. Thursday, December 7, 1837. On motion of Mr. Engle, The twenty-eighth rule was rescinded, and the following was substituted in lieu thereof. Rule 28th.-It shall be in order for the committee on enrolments to report at any time. On motion of Mr. Childs, Leave of absence was granted to Hon. Charles Durkee for the remainder of the present session. Mr. M Williams, from the committee on enrolments, reported the following act, memorial, and resolution to have been correctly enrolled, viz: "An act to divorce Mary M'Arthur from her husband John M'Arthur." "A memorial in favour of John Hood;" and "A resolution in reference to La Point Island." The said act, memorial, and resolution were presented to, signed by the speaker, and the two former transmitted to the president of the Council for his signature. Mr. Quigley, from the select committee, to which was committed bill No. 10, C. F. entitled "A bill organizing a board of county commissioners," reported said bill with an amend ment. The bill was then read the second time. On motion of Mr. Sheldon, The 18th rule was suspended in order that the bill might now be considered by the house. The amendment reported was agreed to.
