The order of the day was then announced, and, on motion of

Mr. Engle,

The house resolved itself into a committee of the whole on bill No. 12, entitled "A bill for the partition of the half breed lands, and for other purposes;" Mr. Sholes in the chair.

After some time, the committee rose and reported the said bill by their chairman, with amendments.

The amendments were agreed to, and the bill was ordered to be engrossed for a third reading.

The secretary of the Council was introduced, and delivered the following message:

Mr. Speaker, The Council have passed bills of the following titles, viz:

"No. 20, A bill to amend, and alter an act entitled an act to incorporate the La Fontaine Rail Road Company.'

"No. 23, ‘A bill to authorize the receipt and disposing of real estate in the several counties in this territory.'

“No. 24, ‘A bill to make valid the location of a territorial road from Racine to Janesville.'

"No. 27, 'A bill to locate and establish a territorial road from Mount Pleasant to the county seat of Green county.'

'No. 48, ' A bill to incorporate the Racine Seminary.'

"In which bills I am requested to ask the concurrence of this house.

"The Council have concurred in bills from this house, as follow:

“No. 2, ‘A bill to lay out a territorial road from the White Oak Springs, and for other purposes;' and

“No. 41, ‘A bill to lay out a territorial road east of the Mississippi, and for other purposes,' with amendments thereto; to which amendments 1 am directed to ask the assent of this house;"

And then he withdrew.

On motion of Mr. Sheldon,

The house adjourned, till 3 o'clock, P. M.

On motion of Mr. Sholes,

The house went into committee of the whole on bill No. 78, entitled "A bill concerning costs and fees;" Mr. Sholes in the chair.

After some time the committee rose, and by their chairman reported the progress made therein, and asked leave to sit again. Leave was granted.

On motion of Mr. Engle,

The said bill was made the order of the day for to-morrow. Bill No. 22, entitled "A bill to prevent and punish gambling," was announced ready for a third reading.

The said bill was then read the third time, and upon the question,

"Shall the bill pass?" The yeas and nays were called for, and were as follow:

Mr. Brunson reported bills Nos. 49, 84, 85, and 86, to be correctly engrossed.

The following bills were read the third time, passed, titles agreed to, and ordered to be sent to the Council for concurrence, viz:

No. 49, "A bill to establish a ferry across the Mississippi river, at Cassville."

No. 86, "A bill to establish a ferry on Rock river, at Janesville, in Rock county."

No. 82, "A bill to incorporate the trustees of the Milwaukee, Academy."

No. 85, "A bill to incorporate the Green county Seminary.

No. 59, "A bill to locate and establish a territorial road from Dubuque to A. Bankston's."

No. 84, "A bill to incorporate the Dubuque Seminary."
Mr. Brunson offered the following resolution:

Resolved, That the originators and defenders of the bill for the partition of the half breed lands be instructed to inquire into the expediency of providing by law, for the partition and sale of that tract of land situated in the county of Crawford, and known by the name of "Carver's Tract," in order to facilitate the settlement thereof; with instructions to report by bill or otherwise.

On motion of Mr. Childs,

The said resolution was laid on the table.

Mr. Teas gave notice that, at a future day, he should introduce a bill to regulate mills and millers. The house adjourned.

Thursday, December 28, 1837.

Mr. Reynolds presented the petition of inhabitants residing on the west side of Cedar river, praying for a territorial road. Referred to the following select committee, viz:

Messrs. Reynolds, Blair, and M'Gregor.

Mr. Brunson, from the committee on engrossments, reported bill No. 77, entitled "A bill to organize the county of Walworth, and to establish the seat of justice thereof," to be correctly engrossed.

Mr. Shanley, agreeably to previous notice, introduced bill No. 101, entitled "A bill to authorize Henry Holtzbecker to keep a ferry."

The bill was read the first and second times, the rule to print having been suspended with reference to said bill.

Mr. Jenkins, agreeably to previous notice, introduced bill

No. 102, entitled "A bill to preserve good order in worshipping congregations and societies in this territory."

The bill was read the first time, and laid on the table.

Mr. Engle, from the committee on the judiciary, to which were referred bill No. 61, entitled "A bill to provide for the payment of expenses in criminal cases," and the substitute proposed thereto, reported the said bill to the house without amend

ment.

The bill was then read the second time, and considered as in committee of the whole.

Ordered to be engrossed for a third reading.

On motion of Mr. Parkinson,

The 16th rule was suspended, with reference to the bill, which was then read a third time, passed, and the title agreed to.

Ordered to be sent to the Council for concurrence.

The house proceeded to take up the messages and bills on the table.

A resolution of the Council, returning bill No. 5, entitled “A bill regulating and defining the extent of the right of possession on lands belonging to the government of the United States, and for other purposes," and the substitute thereto, passed by the house, was referred to the following select committee, viz: Messrs. Sheldon, Engle, and Parkinson.

The amendments made by the Council to bill No 2, entitled "A bill to lay out a territorial road from the White Oak Springs, and for other purposes," were severally agreed to; viz:

In the fourth section, seventh line, strike out the word "through," and insert "to." Strike out, in the eighth line, same section, the words, "to Helena, on the Wisconsin river;" and, in the amendments to bill No. 41, entitled “A bill to lay out a territorial road east of the Mississippi, and for other purposes;" viz: in section three, seventh line, strike out "district court," and insert "board of commissioners." In the last line of the same section, strike out "territorial road," and insert "public highway."

Ordered, that the clerk acquaint the Council thereof.

Mr. Cox, by leave, introduced bill No. 103, entitled "A bill
