After some time the committee rose, and by their chairman reported said report, without amendment.

Mr. Childs offered the following resolution:

Resolved, That for the purpose of establishing the boundary lines of the several counties, laid off in the original county of Des Moines, the committee appointed for that purpose is hereby instructed by this house to report a bill without delay, in accordance with the recommendation as expressed in the éxecutive message on the said bill.

Mr. Teas moved to lay the report of the committee and the resolution on the table:

Which was disagreed to.

The question then recurred on Mr. Childs' resolution, and on that question, the yeas and nays being called for, were as follow:

Yeas:-Messrs. Box, Childs, Chance, Engle, Jenkins, M‘Gregor, M Williams, Nowlin, Quigley, Sheldon, Smith, Sholes, and Wheeler-13.

Nays:-Messrs. Blair, Boyls, Brunson, Cornwall, M‘Knight, Parkinson, Reynolds, Shanley, Teas, and Leffler, speaker-10. The house then adjourned till three o'clock, P. M.

Bill No. 78, entitled "A bill concerning costs and fees," was taken up.

On motion of Mr. Chance,

So much of the report of the committee of the whole, as increased jurors' fees from seventy-five cents, to one dollar and fifty cents, was disagreed to.

On the question to agree to the amendments made to the bill by the committee of the whole, as amended by the house, the yeas and nays were called for, and were as follow:

Yeas:-Messrs. Blair, Boyls, Brunson, Childs, Chance, Cox, Engle, Jenkins, M'Gregor, M'Knight, M'Williams, Parkinson, Quigley, Reynolds, Sholes, Wheeler, and Leffler, speaker—17.

Nays:-Messrs. Box, Cornwall, Sheldon, Smith, Shanley, and Teas-6.

So the amendments were agreed to.

The bill was then ordered to be engrossed for the third reading.

Mr. Chance moved to reconsider the resolution passed by the house this morning, instructing the Des Moines delegation to report a bill concerning the boundaries of the counties to be formed out of Des Moines county.

The motion was laid on the table.

The following bills from the Council were then considered: No. 15, Council file, entitled, "A bill for assessing and collecting county revenue," was referred to the judiciary commit

tee.

The house resolved itself into a committee of the whole on bill No. 35, Council file, entitled "A bill providing for the number of town officers, and for the tenure of county and town officers;" Mr. Engle in the chair.

After a short time the committee rose, and by their chairman reported said bill, with amendments.

The amendments were agreed to, and

The bill was ordered to be engrossed for a third reading. The sixteenth rule was suspended, and the bill was read a third time, passed, and title amended to read,

"A bill concerning town and county officers in the several counties of Brown, Milwaukee, and Racine, and the counties attached to them for judicial purposes."

Ordered that the Council be informed.

The house resolved itself into committee of the whole on bill No. 21, Council file, entitled "A bill for the relief of the poor;" Mr. Sheldon in the chair.

After some time the committee rose, and by their chairman reported the bill without amendment.

The bill was then ordered to be engrossed for a third reading. On motion of Mr. Engle,

The sixteenth rule was suspended in reference to said bill, and it was then read the third time, passed, and title agreed to. Ordered that the Council be informed.

The following communication was received from the Council by their secretary:

"Mr. Speaker, The Council have passed bills of the following titles, viz:

"No. 49, entitled 'A bill to locate and establish a territorial road from Janesville to Mineral Point.

"No. 50, entitled 'A bill to locate and establish a territorial road from Mineral Point to Savannah, on the Wisconsin river.'

"No. 53, entitled 'A bill to locate and establish a territorial road from Madison, in Dane county, to the state line of Illinois, in Walworth county;' in which bills I am directed to ask the concurrence of this house."

"The Council have concurred in bills from this house, with amendments, viz:

"No. 30, entitled 'A bill to authorize the town of Milwaukee, on the west side of river, to borrow money."

"No. 31, entitled 'A bill to incorporate the Milwaukee and Rock River Canal Company."

"No. 93, entitled 'An act to provide for the sale of the land on which the seat of justice of Racine county is placed;'"

And then he withdrew.

Bill No. 25, entitled "A bill to locate and establish a territorial road from Beloit to Goodhue's mills ;" and

No. 28, entitled "A bill to locate and establish a territorial road from Madison, in Dane county, to the southern boundary of Green county," were then taken up, and,

On motion of Mr. Sheldon,

The house resolved itself into a committee of the whole on said bills; Mr. M'Gregor in the chair.

After some time the committee rose, and by their chairman reported said bill without amendment.

Ordered, that said bills do lie on the table.

On motion,

The several rules were suspended with reference to bill No. 34, Council file, entitled "A bill to amend an act, entitled "An act establishing the county boundaries of Portage county,'” and Ordered, that said bill do lie on the table.

On motion of Mr. Teas,

The house resolved itself into

committtee of the whole on

bill No. 46, entitled "A bill to authorize the county commissioners to levy a tax for county purposes;" Mr. Engle in the chair.

After some time the committee rose, and by their chairman reported the said bill without amendment.

Ordered, that said bill be committed to the committee on the judiciary.

Notices were then given that bills would be introduced at a future day, as follows:

By Mr. Chance; "A bill to incorporate the Philandrian College, in the town of Denmark."

By Mr. Nowlin; "A bill for a territorial road from Charleston, in Jackson county, to Charleston, in Jones county."

"A bill relative to stray animals.”

"A bill to create two additional election precincts in Scott county, and for other purposes.

By Mr. Box; "A bill to establish a seminary at Benton's Port.” By Mr. Parkinson; "A bill to provide for the election of county surveyors."

And then the house adjourned.

Saturday, December 30, 1837.

On motion of Mr. Blair,

Leave of absence was granted to the messenger of this house until Tuesday next.

Mr. Jenkins presented the petition of inhabitants of Henry county, for the relief of John Stowe.

Referred to a select committee, viz: Messrs. Jenkins, Chance, and Box.

On motion of Mr. Cox, the following resolution was taken up: Resolved, That this house adjourn on the 19th of January next, the Council concurring herein, and that this house receive no new matter after the 13th of next month, unless the same have strict reference to bills that may be introduced previous to that time.

Mr. Sholes moved to amend the resolution by striking out "19th," and inserting " 10th."

Mr. Sheldon moved to amend the amendment by substituting 30th," for "10th.”

The question was severed, and first taken on striking out "19th."

The motion to strike out was lost.

The resolution was laid on the table.

The amendments made by the Council to the following bills were severally read and concurred in, viz:

No. 30, entitled "A bill to authorize the town of Milwaukee, on the west side of the river, to borrow money."

No. 31, H. R. file, entitled "A bill to incorporate the Milwaukee and Rock River Canal Company."

No. 93, H. R. file, entitled, “An act to provide for the sale of the land on which the seat of justice of Racine county is placed."

Ordered, that the clerk acquaint the Council thereof.

Bill No. 55, entitled "A bill defining the boundaries of Portage county, and for other purposes," was read the second time, and

The rule requiring all bills to be considered in committee of the whole was suspended, and the bill was considered by the house.

The 16th rule was then suspended, and said bill was read the third time, passed, title agreed to, and

Ordered to be sent to the Council for concurrence.

Bill No. 34, entitled "A bill for an act prescribing the mode of trying the right of property," was read the second time.

The house resolved itself into a committee of the whole on said bill; Mr. Engle in the chair.
