Tuesday, January 2, 1838. A message was received from his excellency the governor, informing the house, that he had examined and approved the following acts, viz: "An act providing for taking the second census, or enumeration of the inhabitants of the territory of Wisconsin." "An act to lay out a territorial road from the White Oak Springs, and for other purposes," and "An act to lay out a territorial road east of the Mississippi, and for other purposes." Mr. Blair presented the petitions of inhabitants of Louisa county, for ferries across the Iowa river. Referred to the following select committee, viz; Messrs. Blair, Reynolds, and Box. Mr. Quigley presented the petition of inhabitants of Dubuque and Muscatine counties, praying for the location of a territorial road. Referred to the committee on roads and highways. Mr. Quigley presented the account of G. W. Cummings, sheriff of the county of Dubuque, against the territory. Referred to the committee on expenses. Mr. Box, agreeably to notice previously given, introduced bill No. 107, entitled "A bill to establish a seminary at Fort Madison, in Lee county." Read the first and second times, the rule requiring all bills to be printed after the first reading being suspended with reference to said bill. On motion of Mr. Sheldon, Leave of absence was granted to Mr. M'Gregor for five days. Mr. Quigley, from the committee on schools, reported Bill No. 108, entitled "A bill to regulate the sale o. school lands, and to provide for organizing and perpetuating common schools." Read the first and second times, the rule requiring all bills to be printed after the first reading having been suspended · with reference to said bill. On motion of Mr. Shanley, Bill No. 56 was read the second time. The house then went into committee of the whole on said bill, Mr. Nowlin in the chair. After a short time the committee rose, reported the progress made therein, and asked leave to sit again. Leave was granted. The bill was then made the order of the day for Thursday next. On motion of Mr. Nowlin, All bills and petitions, for territorial roads were referred to the following select committee, viz: Messrs. Nowlin, Cox, and Brunson. On motion of Mr. Brunson, The rule requiring all bills to be printed on being read the first time, was suspended in reference to bill No. 105, entitled "A bill to incorporate the stockholders of the State Bank of Wisconsin, at Prairie du Chien." Mr. Smith, from the committee to which was referred the petition of Louisa Ann Sibley, reported Bill No. 109, entitled "A bill to divorce Louisa Ann Sibley from her husband, William T. Sibley." Read the first and second times; the rule requiring bills to be printed after the first reading being suspended, and, On motion of Mr. Nowlin, The said bill was recommitted to the committee by whom it was reported. Mr. M Williams, from the committee on enrolments, reported the following acts and memorial to be correctly enrolled, viz: "A memorial to Congress for an appropriation of $20,000, to complete the public buildings at the seat of government." "An act to provide for the sale of the land on which the seat of justice of Racine county is located." "An act to provide for laying out and opening territorial roads." "An act to establish the several towns in the counties of Milwaukee, Brown, and Racine, and the counties attached for judicial purposes." The said memorial and acts were then presented to, signed by the speaker, and ordered to be sent to the president of the Council for his signature. On motion of Mr. Childs, The house resolved itself into the committee of the whole on bill No. 98, entitled "A bill to authorize the building a dam across the Manitoowoc river;" Mr. Wheeler in the chair. After some time the committee rose, and by their chairman reported said bill with an amendment. The amendment was agreed to, and The bill was ordered to be engrossed for the third reading. The sixteenth rule was suspended, with reference to said bill, in order that the bill be read the third time to-day. The bill was then read the third time, passed, and the title thereof agreed to. Ordered, that the clerk request the concurrence of the Council in the said bill. On motion of Mr. Parkinson, The house resolved itself into a committee of the whole; Mr. Teas in the chair, on the following bills, viz: Bill No. 68, entitled "A bill to authorize Jeremiah Smith, senior, to establish a ferry across the Iowa river, at the county seat of Louisa county." No. 69, entitled "A bill to authorize Philip B. Harrison to establish a ferry across the Iowa river at Florence, Louisa county." No. 72, entitled "A bill to authorize John J. Rinearson and Walter Butler to keep a ferry." No. 73, entitled "A bill to authorize Benjamin L. Webb to keep a ferry across the Wisconsin river at Helena." i.. No. 74, entitled "A bill to authorize Wm. S. Hamilton to establish and keep a ferry across the Wisconsin river." No. 75, entitled "A bill to authorize Aaron White to establish and keep a ferry across the Mississippi river at Fort Madison." No. 76, entitled "A bill to establish a ferry across the Mississippi river at the town of Davenport." No. 91, entitled "A bill to authorize Samuel Doolittle to keep a ferry across the Mississippi at the town of Camanche." No. 92, entitled "A bill to establish a ferry across the Mississippi at the town of Fort Madison." No. 94, entitled "A bill to authorize Isaac Galland to establish a ferry across the Mississippi river at Montrose.” No. 101, entitled "A bill to authorize Henry Holtzbroker to keep a ferry." After some time the committee rose, and by their chairman, reported bills Nos. 69, 72, 73, 74, 76, 91, and 101, without amendments, and bills Nos. 68, 75, 92, and 94, with amendments. Mr. Quigley moved to lay bill No. 75 on the table, and on this question, the yeas and nays being called for, were as follow: Yeas:-Messrs. Chance, Cox, M Williams, Quigley, Smith, and Sholes-6. Nays:-Messrs. Blair, Box, Boyls, Brunson, Brunet, Childs, Cornwall, Jenkins, M'Knight, Nowlin, Parkinson, Reynolds, Shanley, Teas, Wheeler, Leffler, speaker-16. So the house refused to lay the bill on the table. On motion of Mr. Teas, The second section of said bill was stricken out, and the following inserted as a substitute therefor: "That no district court or board of county commissioners shall grant to any person or persons the right to establish a ferry across said river within two miles immediately above the lower line of Broadway street within said town of Fort Madison." On motion of Mr. Chance, Ordered, that all the bills and petitions lying upon the table relative to the establishment of ferries be referred to a select committee. Messrs. Chance, Childs, Nowlin, Brunet, Cox, and Cornwall were appointed the committee. On motion of Mr. Blair, Ordered that the petitions of sundry citizens of Louisa county for ferries across the Iowa river, be referred to the same committee; and that the committee to which they were previously referred be discharged. Mr. Chance moved to reconsider the vote instructing the committee, composed of the entire delegation of the county of Des Moines, to bring in a bill relative to the division of Des Moines county; Which was disagreed to. Mr. Teas, by leave, presented the petitions of sundry citizens of Des Moines county, relative to the division of said county. Referred to the committee composed of the delegation of the county of Des Moines. On motion of Mr. Cox, Resolved, That the select committee composed of the Des Moines delegation, for the purpose of dividing the original county of Des Moines, be instructed to report to this house the number of petitioners for each particular division, as well as the number praying for the location of certain county seats. The house adjourned till 3 o'clock, P. M. 3 O'CLOCK, P. M. Bill No. 105, entitled "A bill to incorporate the stockholders of the State Bank of Wisconsin, at Prairie du Chien," was taken up. On motion of Mr. Brunson, the house resolved itself into a committee of the whole on said bill; Mr. Sheldon in the chair. After some time the committee rose, and, by their chairman, reported said bill without amendments. On motion of Mr. Cox, The following amendments were made :-Strike out "Council," in sec. 6, and insert "Assembly." Insert, in 1st sec., 7th line, after the word "and," the words "that books of." |
