"An act to locate and establish a territorial road from Dubuque to A. Bankston's." The said acts were then presented to, signed by the speaker, and ordered to be transmitted to the president of the Council for his signature. Bill No. 4, entitled "A bill relating to the militia and public defence of the territory of Wisconsin," returned from the Council with amendments, was taken up, and the amendments were agreed to. Ordered that the clerk acquaint the Council therewith. A preamble and resolution sent from the Council authorizing the secretary of the territory to employ some suitable person or persons to publish the laws passed at the present session of the legislature, and requiring him to report the expense incurred to the next session, was taken up, read the first and second times, and, On motion of Mr. Parkinson, was laid on the table. The following memorial, sent from the Council for concurrence, was then taken up, entitled, "A memorial to congress for the extension of the right of citizenship to the Stockbridge Indians, residing on the west shore of Lake Winnebago, in this territory." The said memorial was concurred in with amendments. Mr. Chance, from the select committee to which bills Nos. 68, 72, 74, 94, 101, 115, and several petitions for ferries, were referred, reported bill No. 119, entitled "A bill to establish the several ferries herein named;" Which was laid on the table. Bill No. 39, Council file, entitled "A bill providing for and regulating general elections in this territory," was read the first and second times, and, On motion of Mr. Teas, was referred to a select committee, viz: Messrs. Teas, Cox, and Parkinson. Bill No. 56, entitled "A bill to provide for the election of county surveyors, and to define their powers," was taken up, and, On motion of Mr. Parkinson, The house resolved itself into a committee of the whole on said bill; Mr. Cox in the chair. After some time the committee rose, and by their chairman reported the bill with amendments. The amendments were agreed to, and the bill was ordered to be engrossed for a third reading. Bill No. 81, entitled "A bill to regulate and define the duties of county officers," was read the second time. On motion of Mr. Parkinson, The house went into a committee of the whole on said bill; Mr. Cornwall in the chair. After some time the committee rose, and by their chairman reported the bill to the house with amendments. The amendments were agreed to, and the bill was ordered to be engrossed for a third reading. On motion of Mr. Parkinson, The house adjourned. Monday, January 8, 1838. Mr. Engle, from the judiciary committee, to which bills Nos. 15, 41, and 46, Council file, were referred, reported the two former with amendments, and the latter without amendment. Bill No. 46, Council file, entitled "A bill to authorize the county commissioners to levy a tax for county purposes," was then read, and, On motion of Mr. Engle, was indefinitely postponed. being the report and resolutions of the committee respecting the charges preferred against Alexander M'Gregor. On motion of Mr. Engle, The said report and resolutions were postponed until Wednesday next. Bill No. 79, entitled "A bill for the benefit of mechanics," was referred to the following select committee, viz: Messrs. Shanley, Childs, and Cornwall. Mr. Cox, by leave, introduced bill No. 120, entitled "A bill to provide for holding elections in the several counties of the territory of Wisconsin." On motion of Mr. Engle, The house resolved itself into committee of the whole on bill No. 41, Council file, entitled "A bill concerning grand and petit jurors," Mr. Cox in the chair. After some time, the committee rose, and by their chairman reported said bill with amendments. The amendments were agreed to, and the bill was ordered to be engrossed for the third reading. On motion of Mr. Quigley, The 16th rule was suspended in reference to said bill, which was then read the third time, passed, and the title agreed to. Ordered that the clerk acquaint the Council therewith. The following message was received from the Council by their secretary: "Mr. Speaker, The Council have concurred in all the amendments made by this house to the memorial to Congress for the extension of the rights of citizenship to the Stockbridge Indians, residing on the east shore of Lake Winnebago, in this territory. "The Council have also concurred in the 1st, 2d, 3d, 4th, 6th, 7th, 8th, and 10th amendments to bill No. 18 of the Council, entitled A bill for opening and repairing, or vacating public roads and highways,' and have disagreed to the 5th and 9th amendments, viz: sect., 35, in the 3d line, strike out the word 'two,' after the word 'highways,' and insert the word five;' sect. 56, strike out one,' in the first line, and insert 'two;' in the 4th line, strike out 'two,' and insert five;' in 6 6 the fifth line, strike out 'privileges,' and insert liabilities;' and in the last line, strike out one,' and insert two.' "The Council have adopted, "A memorial to Congress for the relief of Major Jeremiah Smith,' and 666 "A memorial to Congress for an appropriation for a road from Racine to the Mississippi river;' "In which I am directed to ask the concurrence of this house." And then he withdrew. Mr. Brunson reported bills Nos. 81 and 56 to be correctly engrossed. Bill No. 81, entitled "A bill to regulate and define the duties of the county officers in this territory," was read the third time. Mr. Sholes asked the unanimous consent of the house to amend the 4th section, by inserting after the word "territory," the following: "With the exception of the county of Brown;" which was refused. On the question of the passage of the bill, the yeas and nays were called for, and were as follow: Yeas:-Messrs. Blair, Box, Boyls, Brunson, Brunet, Childs, Cornwall, Chance, Cox, Jenkins, M'Knight, Nowlin, Parkinson, Quigley, Reynolds, Sheldon, Shanley, Wheeler, and Leffler, speaker-19. Nays:-Messrs. Engle, M'Williams, Smith, and Sholes-4. So the bill passed. The title thereof was amended to read, "A bill to require certain officers to reside or hold their offices at the seats of justice of their respective counties." Ordered, that the clerk request the Council to concur in the said bill. Bill No. 56, entitled "A bill to provide for electing county surveyors, and for other purposes," was then read the third time, passed, and the title agreed to. Ordered, that the clerk request the Council to concur in the said bill. Mr. Quigley, chairman of the select committee to which a resolution relative to the public buildings at Madison was referred, asked leave to report a bill from three members of said committee. A majority of the committee not having concurred in said report, leave was not granted. On motion of Mr. Parkinson, three members were added to said committee, viz: Messrs. Sholes, Parkinson, and Boyls. Mr. Nowlin moved to add four additional members, from the west side of the river. Which motion was disagreed to, On motion of Mr. Nowlin, The vote on the motion made by Mr. Parkinson, by which three members were added to the committee, was reconsidered. The motion of Mr. Parkinson was then withdrawn. On motion of Mr. Cox, one of the said committee, who had not concurred in the report of the chairman, The bill No. 132, entitled "A bill to amend an act to establish the seat of government of the territory of Wisconsin, and to provide for the erection of public buildings," was received, and laid on the table. Mr. Parkinson gave notice that he should, on to-morrow, by leave, introduce a bill for the benefit of the Iowa Lodge of Independent Order of Odd Fellows.
