The house resolved itself into committee of the whole on said bill, Mr. Engle in the chair. After some time the committee rose, and by their chairman reported the progress made therein, and asked leave to sit again. Leave was granted.

Mr. McWilliams, from the committee on enrolments, reported the following acts and memorials to be correctly enrolled: "An act to authorize the several counties in this territory to hold and convey real estate, to sue and be sued, and for other purposes."

"An act to make valid the location of a territorial road from Racine to Janesville."

"An act to incorporate the Dubuque Seminary."

"An act to divorce Mary Williams from her husband Thomas Williams."

"Memorial for the improvement of the Des Moines and Rock river rapids in the Mississippi river."--" A memorial to Congress for the extension of the right of citizenship to the Stockbridge Indians on the east shore of Lake Winnebago in this territory."

Said acts and memorials were then presented to, signed by the speaker, and

Ordered to be sent to the president of the Council for his sig

nature.

Mr. Chance offered the following resolution:

Resolved, That no new business be received by this house after Wednesday next.

Mr. Nowlin moved to amend by striking out "Wednesday," and inserting" Saturday;" which was agreed to.

On motion,

The resolution as amended was laid on the table.

The house adjourned.

Thursday, January 9, 1838.

The following message was received from the executive: "Territory of Wisconsin, Executive Department,

Burlington, January 8, 1838.

"To the honourable, the speaker of the House of Representatives: "Sir, I have this day examined and approved, 'An act to divorce Mary Williams from her husband Thomas Williams;' and herewith return it to the House of Representatives, where it originated.

"I have also returned, without my signature, An act to incorporate the Dubuque Seminary,' with my objection to the phraseology of the proviso attached to the fourth section of the bill, viz: Provided they shall not contravene the constitution of the United States or of this territory.' The insertion of the words, the laws,' between the words 'or' and ' of,' in this paragraph, seem to be necessary in order to render the sentence complete. To the provisions of the bill I have no objection. " HENRY DODGE."

Ordered, that said message do lie on the table. The following preamble and resolution from the Council. were then considered.

"Whereas, by the eleventh section of the act to establish the territorial government of Wisconsin, a sufficient sum is to be annually appropriated, to be expended by the secretary of the territory, to defray the expense of printing the laws, and for other purposes; therefore, be it

"Resolved, By the Council and House of Representatives of the territory of Wisconsin, That the secretary of the territory be and he is hereby authorized to employ some suitable person or persons to print and publish the laws passed at the present session of the legislative assembly, in accordance with the above provision of the organic act; who shall, at an early day of the next session of the legislative assembly, make a report thereto of the cost of such printing."

Mr. Engle offered the following amendment:
Strike out the preamble and all after the word "resolved,"

and insert

By the Council and House of Representatives of Wisconsin territory, That James Clarke & Co., be employed to print the laws which may be passed at the present session, and that they be allowed the usual prices given to printers of Congress for similar work."

Mr. Nowlin moved the following amendment to the amend

ment:

Strike out "Jas. Clarke & Co." and insert " Messrs. Corriell, King, and Russell, editors of the Iowa News."

Mr. Sheldon called for the previous question.

The yeas and nays being called for, were as follow: Yeas-Messrs. Box, Cox, Engle, Jenkins, Quigley, Sheldon, Smith, Sholes, Teas, Wheeler, and Leffler, speaker-11.

Nays:-Messrs. Blair, Boyls, Brunson, Brunet, Childs, Chance, McKnight, M'Williams, Nowlin, Parkinson, Reynolds, and Shanley-12.

So the house refused to put the main question.

The question was then taken on the amendment to the amendment offered by Mr. Nowlin, and it was lost.

Mr. Childs offered the following, as a substitute to the amendment offered by Mr. Engle:

Insert after the word "resolved," "that the Council and House of Representatives, (the Council concurring) meet in the Representatives' Hall on Saturday next, at 3 o'clock, P. M., and proceed to elect a printer to print the laws passed at the present session."

The yeas and nays being called for on the adoption of the amendment offered by Mr. Childs, were as follow:

Yeas:-Messrs. Box, Boyls, Brunson, Childs, Cornwall, Cox, Jenkins, M'Knight, Nowlin, Parkinson, Reynolds, Smith, Shanley, Teas, and Leffler, speaker—16.

Nays:-Messrs. Blair, Chance, Engle, M Williams, Quigley, Sheldon, Sholes, and Wheeler-8.

So the amendment offered by Mr. Childs was substituted for the amendment offered by Mr. Engle.

The question then recurred on the amendment of Mr. Childs as a substitute to the preamble and resolution of the Council, and on this question the yeas and nays being called for, were as follow:

Yeas:-Messrs. Boyls, Brunson, Brunet, Childs, Cornwall, Jenkins, McKnight, Parkinson, Reynolds, Shanley, Sholes, and Teas-12.

Nays:-Messrs. Blair, Box, Chance, Cox, Engle, M'Williams, Nowlin, Quigley, Sheldon, Smith, Wheeler, and Leffler, speaker-12.

So the house refused to adopt the amendment as a substitute to the original resolution from the Council.

Mr. Cox offered the following amendment to the resolution of the Council:

"Strike out all after the word Wisconsin,' and insert

"That the Council and House of Representatives meet in the Representatives' Hall on Saturday next, at three o'clock, P. M., and proceed to elect a printer by joint ballot to print the laws passed at the present session.""

And on this question the yeas and nays being called for, were as follow:

Yeas:-Messrs. Box, Boyls, Brunson, Brunet, Childs, Cornwall, Cox, Jenkins, M'Knight, Parkinson, Reynolds, Smith, Shanley, Sholes, and Teas-15.

Nays:-Messrs. M'Williams, Nowlin, Quigley, Sheldon, Wheeler, and Leffler, speaker-9.

So the amendment to the resolution was agreed to.

The original resolution of the Council as amended, was then concurred in.

Ordered that the Council be informed.

Mr. M Williams, from the committee on enrolments, reported

"An act to incorporate the Wisconsin Insurance Company at Green Bay ;" and

"An act relating to the militia and public defence of the territory of Wisconsin;" to be correctly enrolled.

Said acts were then presented to, signed by the speaker, and

ordered to be sent to the president of the Council for his signa

ture.

Mr. Teas, from the committee on roads and highways, reported bill No. 121, entitled "A bill to authorize the commissioners of Des Moines county to levy a tax to build bridges;" Which was laid on the table.

Mr. Sheldon, from the committee of conference to which were referred bills No. 5, 30, and 32, Council file, entitled

"A bill regulating and defining the extent of the right of possession on lands belonging to the government of the United States, and for other purposes." "A bill to divorce Abraham Jones and Lucinda Jones from the bonds of matrimony, and for other purposes," and "A bill to divorce Martha Newton from her husband John C. Newton, together with the substitutes therefor, which had passed the House of Representatives, and which had been sent back from the Council with the original bills, asking the action of the house upon the original bills sent them, made the following report:

"The committee cannot agree upon recommending any course to the two houses, with regard to the proper course of the action to be had upon the bills above named.

"The bills thus lost on a mere difference of opinion about form, can again be introduced as original bills in either house, and this, after a full and free discussion and consultation, is the only course which the committee can agree upon recommending. They ask, therefore, the adoption of the following resolution:

"Resolved, That the said committee of conference be discharged from the further consideration of the subject; which was agreed to."

Mr. Teas, from the select committee to which was referred bill No. 39, Council file, entitled "A bill providing for, and regulating general elections in this territory;" reported said bill with amendments.

Mr. Childs, from the committee on finance, reported

Bill No. 122, entitled "A bill to provide for a territorial revenue."
