On motion of Mr. Childs, The house resolved itself into a committee of the whole on said bill, Mr. Chance in the chair. After some time the committee rose, and by their chairman reported said bill without amendment. The bill was then ordered to be engrossed for the third reading. The 16th rule was then suspended with reference to said bill, which was then read the third time, passed, and title thereof agreed to. Ordered to be sent to the Council for concurrence. Bill No. 39, Council file, entitled "A bill providing for and regulating general elections in this territory," was read the second time. On motion of Mr. Quigley, The house resolved itself into the committee of the whole on said bill, Mr. Sholes in the chair. After some time the committee rose, and by their chairman reported progress, and asked leave to sit again. Leave was granted. Bill No. 88, entitled "A bill to prevent disasters on steamboats navigating the waters within the territory of Wisconsin," was read the second time. On motion of Mr. Nowlin, the house resolved itself into the committee of the whole on said bill, Mr. Wheeler in the chair. After some time the committee rose, and by their chairman reported said bill without amendment. The bill was then ordered to be engrossed for the third reading. The 16th rule was then suspended with reference to said bill, which was read the third time, passed, and the title thereof agreed to. Ordered to be sent to the Council for concurrence. Friday, January 12, 1838. Mr. Teas presented the petition of David James, praying for the exclusive right to keep a ferry across the Mississippi river, at Burlington. Referred to the committee of the whole house. Mr. Sheldon, from the committee on the militia to which an act relating to the militia and public defence of the territory of Wisconsin, returned by the executive without his signature, together with the message relating thereto, was referred, made the following report, and introduced Bill No. 4, entitled "A bill entitled an act relating to the militia and public defence of the territory of Wisconsin." The committee on the militia, to which was referred the bill entitled "An act relating to the militia and public defence of the territory of Wisconsin," which was returned to this house on the 9th instant, by the governor without his signature, in consequence of the numerous mis-spellings, clerical errors, and important mistakes, made in the enrolment of said bill, respectfully report that they have carefully compared the bill, as enrolled, with the bill as it passed this house, have made all the necessary corrections, and re-copied all the sheets on which were any errors; they therefore report the bill back to the house, as in a proper condition to be again passed without even the formality of a reading in committee of the whole. The report was adopted, and the bill was read the first and second times. On motion of Mr. Engle, the several rules were suspended with reference to said bill, which was then read the third time, passed, and the title thereof agreed to. Ordered to be sent to the Council for concurrence. Mr. M Williams, from the committee on enrolment, reported the following acts and memorials to be correctly enrolled, viz: "An act to locate and establish a territorial road from Fort Howard to Fort Winnebago, on the west side of Fox river, and for other purposes:" "An act for the benefit of the towns of Belleview and Peru, in the original county of Dubuque ;" "An act to abolish imprisonment for debt, and for other purposes:" “An act to establish a county to be called Portage, defining its territory, &c.:" "An act concerning debtors and their sureties:" "An act to divorce Louisa Ann Sibley from her husband William T. Sibley:" 66 "A memorial to Congress for the relief of Major Jeremiah Smith:" "A memorial to Congress for an appropriation for a road from Racine to the Mississippi river.” The said acts and memorials were then presented to, signed by the speaker, and ordered to be transmitted to the president of the Council for his signature. Mr. Engle, from the select committee to which was referred bill No. 62, entitled "A bill for an act to amend an act entitled • An act to establish the judicial districts of the territory of Wisconsin, and for other purposes,' and to regulate the time of holding courts in the several counties of this territory," reported the same back with a substitute therefor; which was read the first time, and laid on the table. Mr. Sheldon, from the select committee to which was referred the petition of sundry citizens of Racine county, praying for the charter of a rail road, &c., reported bill No. 133, entitled "A bill to incorporate the Racine and Rock river Rail Road Company;" which was read the first and second times, and laid on the table. The resolution of the Council, as amended, relative to printing the laws passed at the present session, was then taken up. Mr. Cox moved to amend the resolution by striking out the words "Messrs. James Clarke and Co.," and inserting "William S. Hamilton, editor of the Miners' Free Press, of Mineral Point." The yeas and nays being called for on this amendment, were as follow: Yeas:-Messrs. Boyls, Brunson, Cox, Jenkins, M‘Knight, Parkinson, Reynolds, Smith, Shanley, and Teas-10. Nays:-Messrs. Blair, Box, Brunet, Cornwall, Chance, Engle, M'Williams, Nowlin, Quigley, Sheldon, Sholes, Wheeler, and Leffler, speaker-13. So the amendment was lost. Mr. Chance called for the previous question, And the yeas and nays being called for, were as follow: Yeas:-Messrs. Blair, Brunet, Cornwall, Chance, Engle, Nowlin, Quigley, Sheldon, Smith, Wheeler, and Leffler, speaker-11. Nays:-Messrs. Box, Boyls, Brunson, Cox, Jenkins, Parkinson, M‘Knight, M'Williams, Reynolds, Shanley, Sholes, and Teas-12. So the house refused to put the main question. Mr. Cox again moved to amend by inserting "Corriell, King, and Russell, editors of the Iowa News," and by striking out" Messrs. James Clarke and Co." The yeas and nays being called for on this amendment, were as follow: Yeas:-Messrs. Boyls, Cox, Jenkins, M'Knight, Reynolds, Nowlin, Quigley, Shanley, Teas, and Wheeler-10. Nays:-Messrs. The question then recurred on agreeing with the resolution of the Council as amended, and the yeas and nays being called for, were as follow: Yeas:-Messrs. Bill No. 132, entitled "A bill to amend an act entitled 'An act to establish the seat of government of the territory of Wisconsin, and to provide for the erection of public buildings,' was read the first and second times. On motion of Mr. Quigley, 999 The house resolved itself into a committee of the whole on said bill; Mr. Childs in the chair. After some time the committee rose, and by their chairman reported the progress made therein, and asked leave to sit again. Leave was granted.
