SENATE OF THE STATE OF SOUTH CAROLINA.

MONDAY, NOVEMBER 28, 1859.

GENERAL ASSEMBLY of the State of South Carolina, begun and holden at Columbia on the 28th day of November, in the year of our Lord one thousand eight hundred and fifty-nine, being the fourth Monday in November, the day fixed by the Constitution for the meeting of the General Assembly. The members of the Senate assembled in the Senate Chamber, in the Capitol, at 12 o'clock, M.

The Hon. WILLIAM D. PORTER, Senator from St. Philip's and St. Michael's, President of the Senate, took the Chair; and the roll being called, the following Senators answered to their names, viz :

A quorum being present, the Senate proceeded with business.

On motion of Mr. MOSES, the reading of the Journal of the last day of the session of 1858 was dispensed with.

The PRESIDENT announced that in consequence of the Hon. James Chesnut, Jr., late Senator from Kershaw, having been elected Senator in the United States Congress; and in consequence of the death of Hon. E. Brownlee, late Senator from St. George's, Dorchester, he had issued writs of election for those Election Districts, respectively; thereupon the Senators elect, namely:

Hon. M. T. Appleby, Senator elect from St. George's, Dorchester; and Hon. A. Hamilton Boykin, Senator elect from Kershaw, appeared and presented their credentials, and were duly sworn as Senators from the Election Districts, respectively.

On motion of Mr. MOSES, a Message was sent to the House of Representatives, which was delivered orally by the Clerk, informing that House that the Senate had met, a quorum being present, and was ready to proceed with business.

On motion of the same Senator, a Committee was appointed to wait on his Excellency the Governor, and inform him that the Senate had met, a quorum being present, and was ready to receive any communication he might be pleased to make. Messrs. Moses and McAliley were appointed the

Committee.

Mr. ALLEN submitted the presentment of the Grand Jury for Barnwell District, Fall Term, 1859; which was read and referred to the Committee on Roads and Buildings, and was ordered to be printed.

Mr. McALILEY presented the Annual Report of the Commissioner of the New State House, for the year 1859; which was referred to the Committee on the New State House, and was ordered to be printed.

Mr. ZIMMERMAN presented the petition of the Town Council of Darlington for amendment and renewal of charter; which was referred to the Committee on Incorporations and Engrossed Acts.

The Senate then proceeded to the General Orders of the day, consisting

of the unfinished business of the last Session of the Legislature, which had been postponed for consideration to this.

On motion of Mr. BRYAN, resolutions in relation to the Slave Trade, offered by himself and the Senator from Richland, (Nos. 14 and 15 of the Calendar,) were referred to the Committee on Federal Relations.

Mr. DANTZLER offered the following resolutions, which were referred to the same Committee, and were ordered to be printed.

Resolved, That the several States of the South are of right, and ought to be, in fact, supreme upon the questions which affect the fortunes of domestic slavery.

Resolved, That the measures of the General Government, restrictive of the foreign slave trade, are in derogation of this right, and ought to be repealed.

The General Orders were suspended, and Mr. MOSES, from the Committee to wait on his Excellency the Governor, reported that the Committee had performed the duty assigned, and his Excellency had announced his intention to communicate with the Senate at 1, P. M., to-morrow. The General Orders were then resumed; and, on motion of Mr. MOSES, the papers were all passed over.

The following papers were presented by Mr. Lesesne, and were referred as follows:

The petition of McCarter & Dawson, for Legislative aid in the publication of certain Reports in Law and Equity of the State of South Carolina; which was referred to the Committee on the Judiciary; and

The account of McCarter & Co., for 3d installment printing certain volumes of Law and Equity reports under a resolution of the Legislature, which was referred to the Committee on the Judiciary; also,

The account of McCarter & Dawson for 101 volumes of Richardson's Equity Reports, and 111 volumes of Rlchardson's Law Reports; which was referred to the Committee on the Judiciary; also,

The petition of the Methodist Benevolent Society of Charleston, praying re-charter; which was referred to the Committee on Incorporations and Engrossed Acts.

Mr. LESSENE also gave notice that to-morrow he will ask leave to introduce

A Bill to regulate fees to be charged against the State in criminal cases, and to provide effectually for the collection of costs from defendants.

Mr. ALLEN presented the account of Dr. A. R. Norton, for a post mortem examination; which was referred to the Committee on the Lunatic Asylum and Medical Accounts.

Mr. O'BRYAN presented the Free School return for St. Bartholomew's,
