The House then went into the committee of the whole on said bills, Mr. Story in the chair, and after some time spent therein, rose and reported the said bills to the House with amendments.

The report of the committee to bill No. 6, was amended, on motion of Mr. Shackelford, by excepting the county of Brown from the provisions contained in the third section of the bill, was then agreed to, and the bill ordered to be engrossed for a third reading.

The report of the committee on bill No. 1, (C. F.) was agreed to, and the bill ordered to a third reading.

On motion of Mr. Whiton,

The said bill was read the third time, passed, and the title thereof agreed to, by the special order of the House.

Ordered, That the clerk request the Council to concur in the amendment to the said bill.

Mr. Conroe, from the committee on engrossed bills reported bill No. 5, to be correctly engrossed, entitled "A bill to attach the county of Portage to the county of Dane."

Saturday, August 8, 1840.

The Speaker appointed Messrs. Sholes and Longstreet of the joint committee on the part of this House, under the sixth of the joint rules and orders of the two Houses.

Ordered, That the Council be acquainted therewith.

Mr. Story presented two petitions of inhabitants residing on the Milwaukee and Rock river canal lands, praying that the interest accruing on lands sold may be remitted and stayed until a loan shall be effected for the construction of said canal.

Referred to the committee on Internal Improvements.

On motion of Mr. Shew,

The following preamble and resolution were adopted:

Whereas, His Excellency the Governor of the Territory of Wisconsin was authorized by an act of the Legislative Assembly, approved February the 26th, 1839, entitled an act to provide for aiding in the construction of the Milwaukee and Rock river canal to borrow the sum of fifty thousand dollars for the above object, therefore

Resolved, That His Excellency the Governor of the Territory of Wisconsin be requested to transmit to this House what infor mation may be in his possession which relates to the loan which is authorized by the first section of the above recited act, and whether said loan has been effected, and what agent, if any, has been appointed to negociate the same.

Mr. Sholes, by leave, introduced the following joint preamble and resolutions, entitled

No. 2. "Joint Resolutions in explanation and amendment of the resolutions of the Legislative Assembly, passed at its last session, in relation to the Southern Boundary."

Which were read the first and second time, and referred to the committee on territorial affairs, with instructions to report on Monday next.

Mr. Conroe, from the committee on engrossed bills, reported bill No. 6, to be correctly engrossed, entitled "A bill to amend an act entitled 'an act to provide for the support of common schools, and for other purposes."

Mr. Longstreet, from the committee on Internal Improvements, to which were referred several petitions, reported bill No. 7, entitled "A bill to provide for staying the interest on the sale of the canal lands;"

Which was read the first and second time, and on motion of Mr. Shew, ordered to be printed.

The Secretary of the Council being introduced, delivered the following message:

"Mr. Speaker-The Council have passed a bill and resolution as follows, in which I am directed to ask the concurrence of this House, viz: No. 4, A bill to establish a territorial road from Madison to Frankfort, in Dodge county.' No. 1, "A resolution relative to adjournment.'

"And have concurred in the amendment of this House to bill No. 1, entitled A bill concerning the Supreme and District Courts.""

Mr. Whiton, from the select committee to which the subject was referred, reported bill No. 8, entitled "A bill relating to the duties of the Register of Deeds of the county of Dane;"

Which was read the first and second time.

The House took up the message from the Council, and the undermentioned bill and resolution were read the first and second time, viz :

Bill No. 3, entitled "A bill concerning taxes in Iowa county, for the year 1840," was taken up, and the question being on ordering the bill to be engrossed for a third reading.

Mr. Whiton moved a call of the House, and that the Sergeantat-Arms be sent after absent members;

Which was agreed to.

A call of the House was then had, and the Sergeant-at-Arms sent after Mr. Jenkins, who was not in his seat.

Mr. Sholes, by leave, presented the account of D. H. Richards, for further compensation for printing the local laws;

Which was referred to the following select committee, viz: Messrs. Sholes, Longstreet and Bracken,

The Sergeant-at-Arms having reported the attendance of Mr. Jenkins, a motion was made by Mr. Billings that bill No. 3 do lie on the table until Monday next;

Which was decided in the affirmative.

Mr. Wells presented two petitions of inhabitants of Washington county, praying to be organized for county and judicial purposes; Which were referred to the following select committee, with instructions to report on Monday next, viz: Messrs. Wells, Shew and Conroe.

Mr. Street moved that the 15th rule of this House be suspended, for the purpose of enabling him to introduce a bill without giving one day's notice.

And the ayes and noes being called for by Mr. McGregor, were taken, and were as follows:

Ayes-Messrs. Bracken, Brunson, Childs, Craig, Hoyt, Jenkins, Longstreet, Newman, Shew, Sholes, Stevens, Street, Sutherland, Wells and Dewey, speaker--15.

Mr. Street then introduced bill No. 10, entitled "A bill to amend an act concerning judgments and executions ;"

Which was read the first and second time.

Mr. Sholes moved that the said bill be referred to the Committee on the Judiciary.

Mr. Street moved to amend the motion to refer, by instructing the committee to report on Monday next;

Which amendment was disagreed to, and pending the question on referring the bill,
