gether with the sum of nine hundred dollars, which has heretofore been appropriated and paid by the Secretary of the Treasury of the United States to William B. Slaughter, for preparing the laws passed at the session of the Legislative Assembly in the years 1837 and 1838, begun and held at Burlington, and for distributing the same, which he failed to do; which sum of nine hundred dol. lars the fiscal agent is hereby directed and required to deduct from any former appropriations made to the said William, B. Slaughter which remain in his hands and unpaid by him, and to pay the same to the said James G. Edwards. Pending the question on the amendment, the following message was received from the Council by their Secretary. "Mr. Speaker-The Council have non-concurred in the amendment made by this House to the second of resolutions No. 6, entitled "Resolutions relative to the publication of the laws." A call of the House was then moved by Mr. Bracken, and was disagreed to. Mr. Sholes moved an amendment to the amendment, as follows: Strike out the word "eleven" in the first line, and insert the word "sixteen." Strike out the word "nine" wherever it occurs and insert the word "four" in lieu thereof. Strike out all in the amendment which relates to preparing the laws of 1837 and 1838 for publication. The question was then taken on agreeing to the amendment to the amendment, and was decided in the affirmative, The ayes and noes being called for, Those who voted in the affirmative are Messrs. Beardsley, Bil. lings, Brunson, Childs, Conroe, Cruson, Hoyt, Jenkins, Newman, Shackelford, Sholes, Stevens, Street and Sutherland-14. Those who voted in the negative are Messrs. Bracken, Craig, Longstreet, McGregor, Story, Wells and Dewey-7. The question was then taken on agreeing to the amendment as amended. And the ayes and noes being called for, were as follows: Ayes--Messrs. Beardsley, Bracken, Conroe, Craig, Longstreet, McGregor, Newman, Story, Sutherland, Wells and Dewey, speaker-11. Noes-Messrs. Billings, Brunson, Childs, Cruson, Hoyt, Jenkins, Ray, Shackelford, Sholes, Stevens and Street-11. The House being equally divided the amendment was lost. Mr. Bracken then moved the following amendment to the bill: SEC. 2. That Samuel B. Knapp, fiscal agent, is hereby directed and required to retain in his hands, out of any money heretofore appropriated to Wm. B. Slaughter, the sum of five hundred dollars, appropriated to William B. Slaughter, Secretary of the Territory, for preparing, indexing, paging, &c. the laws passed at Burlington, at the session of the Legislative Assembly in the years 1837 and 1838; which sum was paid to the said Wm. B. Slaughter by the Secretary of the Treasury of the Uni ted States, and which services he never performed: also, the sum of four hundred dollars, appropriated and paid to the said Wm. B. Slaughter for distributing the laws of that session; which service he never performed; and the said fiscal agent is hereby required to appropriate the said sums to the payment of the expenses of the present session of the Legislative Assembly. The question being taken on agreeing to the said amendment, was decided in the negative. The ayes and noes being called for, Those who voted in the affirmative are Messrs. Bracken, Craig, Cruson, McGregor, Story and Dewey, speaker-6. These who voted in the negative are Messrs. Beardsley, Billings, Brunson, Childs, Conroe, Hoyt, Jenkins, Longstreet, Newman, Shackelford, Shew, Sholes, Stevens, Street, Sutherland and Whi ton--16. The said bill was then ordered to be engrossed for the third reading. The House then took up resolution No. 6, (C. F.) entitled “Resolutions relative to the publication of the laws," and receded from their amendment to which the Council had disagreed. Ordered, That the Council be acquainted therewith. 7 O'CLOCK, P. M. Mr. Conroe, from the committee on engrossed bills, reported the following to be correctly engrossed, to wit: No. 13. "A bill to provide for the compensation of the officers of the Legislative Assembly and for other purposes;" Which was then read the third time, passed and the title thereof agreed to. Ordered, That the Council be requested to concur therein. On motion of Mr. Sholes, Ordered, That the Clerk transmit the report of the select com mittee on the petition and account of James G. Edwards to the Council. Mr. Sholes, from the committee on enrolment, reported the following to be correctly enrolled; which were signed by the Speaker and ordered to be presented to the President of the Council for his signature, to wit: "Resolution relative to adjournment;" and "Resolutions relative to publication of the laws." The Speaker submitted a message from the Governor, notifying the House that he had on this day approved the following, to wit: "An act relating to the duties of register of deeds of the county of Dane." "An act relating to the general election for the year 1840;" and "An act to organize the county of Washington and for other purposes." On motion of Mr. Sholes, The House took a recess for one hour. The time for which the House took a recess having expired, the House resumed its session. The Secretary of the Council being introduced, delivered the following message: "Mr. Speaker-The Governor has notified the Council that he did on this day examine and approve the following: "An act concerning the Supreme Court;" and "Resolution to amend a resolution concerning the settlement of the accounts of the late acting commissioner." The Council have concurred in bill No. 13, of this House, entitled "A bill to provide for the compensation of the officers of the Legislative Assembly and for other purposes." with amendments thereto; in which amendments I am directed to ask the concur. rence of this House." The House then took up the said bill No. 13, returned with amendmeuts. On motion of Mr. Whiton, Ordered, That the sense of the House be taken separately on each amendment. The question was then taken separately on the several amend. ments; and the first, second, third, fourth and fifth amendments of the Council were concurred in. On concurring in the sixth amendment, Mr. Bracken moved that the Clerk be ordered to request the Council to transmit to this House the report of W. B. Slaughter, relating to said amendment; Which was disagreed to. The question was then taken on concurring in the said amend. ment. And the ayes and noes being called thereon, were as follows: Ayes-Messrs. Beardsley, Bracken, Brunson, Childs, Craig, Hoyt, Longstreet, Newman, Ray, Shackelford, Shew, Stevens, Story, Street, Sutherland and Dewey-16. Noes-Messrs. Cruson, Jenkins, Wells and Whiton-4. So the sixth amendment was concurred in. Mr. Whiton offered the following amendment to the seventh amendment of the Council : Add thereto the following: "Provided, That the said Samuel B. Knapp shall not receive the said money from the Secretary of the Treasury of the United States unless he shall advance to the members and officers of the Legislature pay for their attendance during the present session." Mr. Wells called for the previous question. And the ayes and noes were called for, and were as follows: Ayes-Messrs. Beardsley, Bracken, Brunson, Conroe, Craig, Cruson, Hoyt, Newman, Shackelford, Shew, Story, Street, Sutherland and Wells-14. Noes-Messrs. Billings, Childs, Jenkins, Longstreet, Ray, Stevens, Whiten and Dewey-8. So the main question was ordered. The main question was then put in these words: "Will the House concur in the seventh amendment of the Council to the said bill," and was decided in the affirmative. The question was then taken on concurring in the 8th amend. ment to the said bill. And the ayes and noes being called, were as follows: Ayes-Messrs.
