CHAPTER 43.

AN ACT to amend the charter of Benton, in Marshall county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the act to amend the charter of the town of Benton, in Marshall county, be so amended as to require the election for police judge and marshal to be held on the first Monday in August, 1862, and that the judge hold his office and be commissioned for the term of four years from each regular election, and until his successor is elected and qualified; and that the marshal be elected for the term of Term of office. two years, and hold his office until his successor is elected or appointed and qualified.

§ 2. CHAPTER 44.

AN ACT to amend the charter of the city of Louisville.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That so much of "An act to charter the city of LouRepeals act of isville," approved March 24, 1851, as requires or authorizes the election of watchmen by the qualified voters of said city, and prescribing their number and duties, and the tenure of office of watchmen, is hereby repealed.

CHAPTER 45.

AN ACT to authorize the Marshall county court to change the State road. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§1. That the county court of Marshall county be, and the same is hereby, authorized to change the State road in said county leading from Aurora to Paducah, in the same manner and under the same provisions that county courts are now authorized by existing laws to change county roads in the several counties of this Commonwealth: Provided, Said changes shall be confined to the premises of B. F. Chambers, on said road, and of John H. Dix, in the town of Briensburg.

§ 2. This act shall take effect from its passage.

CHAPTER 46.

AN ACT to allow the sheriff of Ohio county to execute process from the police court of the town of Hartford.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

That the sheriff of Ohio county is authorized to execute process from the police court of Hartford.

CHAPTER 48.

AN ACT for the benefit of common school district No 46, in Henderson

county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

That the commissioner of the common schools in the county of Henderson be, and he is, authorized and directed to pay to the trustees of district number forty-six,

in said county, the amount of the fund to which said di trict is entitled for the year 1861, under existing law according to the report of said trustees now on file in sai commissioner's office, and received by him after said com missioner had forwarded his report to the Superintenden of Public Instruction.

CHAPTER 52.

AN ACT for the benefit of Ashley Owens, of Rockcastle county. WHEREAS, The Governor of this Commonwealth, on the 12th day December, 1860, offered a reward of two hundred dollars for the apprehension of William Gardner Capps, a fugitive from justice, charged with the offense of killing one Jesse Burton, in Rockcastle county; and whereas, Ashley Owens apprehended said Capps and delivered him to the jailer of Rockcastle county, within the time prescribed in the proclamation of the Governor; and whereas, there is no sheriff in Rockcastle county, and in the opinion of the judge of the Rockcastle circuit court, no court could be opened and held without a sheriff, and the said Ashley Owens is prevented thereby from having his claim proven and certified to the Auditor for payment in the proper court of record; but the same having been properly proved, allowed, and certified in the Laurel circuit court, therefore,

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

That the Auditor be, and he is hereby, directed to draw his warrant on the treasury in favor Ashley Owens for the sum of two hundred dollars, to be paid out of any money in the treasury not otherwise appropriated.

CHAPTER 54.

AN ACT to alter boundary line of precinct No. 1, in Spencer county. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

That the boundary line between election precincts No. 1 and No. 3, in Spencer county, shall be, and is hereby, so altered as to include the residence of William J. Cook and Charles W. Beard in precinct No. 1.

CHAPTER 55.

AN ACT for the benefit of P. B. Adams, late sheriff of Graves county, and his

deputies.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§1. That P. B. Adams, late sheriff of Graves county, and each of his deputies, be allowed two years, from and after the passage of this act, in which to collect any and all taxes, fees, &c., which is due them, or either of them; and for the purpose of making such collections, they, or either of them, may levy and distrain for the same: Provided, however, That the said Adams and his deputies shall be liable to the parties aggrieved for illegally issuing or distraining any such fee bills, or illegally distraining for the taxes aforesaid.

§ 2. This act shall take effect from and after its passage. Approved September 26, 1861.

CHAPTER 56.

AN ACT for the benefit of Henry Forbes.

Be in enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the further time of two years, from and after the passage of this act, be allowed to Henry Forbes, late sheriff of Laurel county, to collect his uncollected taxes and fee bills, &c.; and may levy and distrain for the same, subject to responsibility for all violations of law in the collection of the same.

§ 2. This act to be in force from its passage.

CHAPTER 57.

AN ACT to authorize the county court of Cumberland county to increase the county levy of said county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

1. That the county court of Cumberland county, at their court of claims, are authorized to levy a poll-tax upon each tithable of said county not exceeding two dollars and fifty cents.

2. This act shall take effect from its passage, and continue in force until the extinguishment of the public debt created by said county for public buildings.

CHAPTER 58.

AN ACT for the benefit of school district No. 15, in Adair county. Be it enacted by the General Assembly of the Commonwealt of Kentucky:

§ 1. That the Auditor of Public Accounts be, and he i hereby, directed to draw his warrant on the Treasurer i favor of the trustees of common school district No. 15, i Adair county, for the proportion of the school fund to whic said district is entitled of the school fund of 1860.

CHAPTER 59.

AN ACT for the benefit of M. C. Hughes, sheriff of Gallatin county. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That M. C. Hughes, sheriff of Gallatin county, be, and he is hereby, allowed the further time until the 1st day of October, 1861, to make his return of delinquent tax payers for the year 1860.

§2. This act to be in force from its passage.

CHAPTER 60.

AN ACT for the benefit of W. D. Black, late sheriff of Pulaski county,

his sureties.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That it shall and may be lawful for W. D. Black, late sheriff of Pulaski county, and the sureties in his official bonds, to replevy the several judgments recovered against them by the Commonwealth of Kentucky in the Franklin circuit court for defalcation in the payment of the public revenue for said county, upon their executing bonds with good personal security, to be approved by the officer taking the same, undertaking to pay one third of the judgment in four months, and the remainder in twelve months from and after the time this act takes effect, and which bonds shall be executed in the same manner and in all respects have the same force and effect, as replevin bonds given under the laws now in force upon that subject.

§ 2. That the said W. D. Black, late sheriff as aforesaid, and his said sureties, be, and they are hereby, released from the payment of the several judgments for the dam
