CHAPTER 174.

AN ACT for the benefit of common school district No. 46, in Henderson county. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That an act, entitled "An act for the benefit of common school district No. 46, in Henderson county," and approved September, 1861, be, and the same is so amended, that the Auditor is authorized and directed to issue his warrant upon the treasury in favor of the common school commissioner for Henderson county, for the amount of the common school fund due and unpaid to the trustees for said district for the year 1860.

§ 2. This act shall take effect from and after its passage. Approved October 3, 1861.

CHAPTER 175.

AN ACT to amend the charter of the town of Mt. Sterling.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§1. That the sixth section of the charter of said town be so amended as to require the police judge thereof, before he enters upon the duties of his office, to give bond with approved security in the county court of Montgomery county, for the faithful payment of all money or moneys received by him for the use of the town, or any of its officers, into the treasury of the same, or to the officers respectively entitled thereto.

§2. This act to take effect and be in force from its passage.

CHAPTER 176.

AN ACT for the benefit of George W. Lewis, A. Hensley, John M. Todd, and
Sam. C. Sayres.

WHEREAS, George W. Lewis, A. Hensley, John M. Todd, and Sam'l C. Sayres, reporters for the Commonwealth and

Yeoman, for their full, accurate, and impartial reports of the proceedings of the General Assembly, are entitled to receive some testimonial of approbation; therefore,

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the Public Printer is hereby directed to furnish to each of them all such books and documents as, by law, the members of the General Assembly are entitled to receive for the present session.

§ 2. That this act shall take effect from its passage. Approved October 3, 1861.

CHAPTER 177.

AN ACT for the benefit of L. S. Lee, sheriff of Ballard county. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That L. S. Lee, sheriff of Ballard county, have the further time of two years to collect the fee bills of Henry Price, deceased, late sheriff of Ballard county: Provided, That said L. S. Lee, and his securities, shall be subject to the laws now in force for the collection of illegal fee bills. § 2. This act to take effect from and after its passage. Approved October 3, 1861.

CHAPTER 178.

AN ACT for the benefit of Jacob Corbett, clerk of the county and circuit courts of Ballard county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That Jacob Corbett, clerk of the county and circuit courts of Ballard county, have the further time of two years to issue and collect his fee bills: Provided, however, That he and his securities shall be subject to the laws now in force in reference to the issuing and collecting illegal fee bills.

§ 2. This act to take effect from its passage.

CHAPTER 179.

AN ACT to amend the charter of the Masonic Temple Company. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That an act, entitled "An act to charter the Masonic

Temple Company," approved February 2, 1860, be amended in this that the stockholders in the Masonic Fraternity, of Louisville, may have the further time of sixty days, from and after the passage of this act, to commute their stock in said company into stock in the Masonic Temple Company, as provided in the act aforesaid.

§2. That the board of managers of the Masonic Temple Company are authorized to make such arrangements with the stockholders in the old company, for the payment of stock in the new company, as they may deem right and proper.

3. This act to take effect from its passage.

CHAPTER 180.

AN ACT to appoint commissioners to re-district Carter county into magistrate: and constables' districts.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§1. That James W. Scott, James Garvin, John Armstrong, John Y. Montgomery, and Wm. Bowling, be, and they are hereby, appointed to lay off Carter county into eight magistrates' and constables' districts, as nearly as is convenient of equal voting population, designating in each district a suitable place for holding elections. Said districts shall, when formed, be the election precincts for all elections required to be held, by law or the constitution, in said county.

§2. Said commissioners shall be governed in every other respect by the act originally laying off the counties of the State into magistrates' and constables' districts, and report to the Secretary of State on or before the first day of March, 1862.

§3. The magistrates and constables now in office in said county, shall continue their jurisdiction in the districts as heretofore established, until their terms of office shall have expired; but all officers hereafter elected in said county shall be controlled by the provisions of this act. § 4. This act shall have effect from its passage.

CHAPTER 185.

AN ACT for the benefit of the Odd Fellows' Hall in Covington.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the property in the city of Covington, known

as the Odd Fellows' Hall, shall hereafter be exempt from taxation for revenue purposes by the State so long as used for the purpose intended in the charter: Provided, however, That nothing in this act shall be so construed as to exempt from taxation any interest held by private individuals in said property.

§ 2. This act shall take effect from and after its passage. Approved October 3, 1861.

CHAPTER 186.

AN ACT empowering the jailer of Franklin county to appoint a deputy jailer. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That Harry R. Miller, jailer of Franklin county, be, and he is hereby, empowered and authorized to appoint a deputy jailer for said county.

2. Said deputy shall exercise all the powers and duties of the jailer of Franklin county.

§ 3. The jailer of Franklin county and his sureties shall be responsible for the official acts of said deputy to the same extent that they are now responsible for the official acts of the jailer of said county: Provided, The sureties of the jailer shall enter their consent to the appointment under this act in the Franklin county court.

§ 4. This act shall take effect from and after its passage. Approved October 3, 1861.

CHAPTER 193.

AN ACT for the benefit of John W. Clay, late sheriff of Montgomery county. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That John W. Clay, late sheriff of Montgomery county, and his deputies, be allowed the further time of two years in which to collect his fee bills, and in which to levy and collect the uncollected tax for the years 1855, 1856, 1857, 1858, 1859.

§ 2. That if said Clay shall, under the provisions of this act, levy or collect, or attempt to levy or collect, any illegal fee bill or illegal tax, which are not justly due and unpaid, he shall be liable to all the pains and penalties now in force against sheriffs for the collection of illegal fee bills and tax.

§ 3. This act shall go into effect so soon as said Clay shall execute, before the Montgomery county court, a covenant with good security, conditioned to pay any and all

persons that may be injured by any such illegal or improper levy made under this act.

CHAPTER 194.

AN ACT for the benefit of W. B. Estis, of Knox county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the Auditor of Public Accounts is hereby directed to draw his warrant in favor of W. B. Estis, of Knox county, for twenty-one dollars, upon the Treasurer of Kentucky, for services rendered by said Estis in going from Barbourville, Knox county, Kentucky, to Washington county, Tennessee, to bring back William Foster, charged with felony by indictment in the Knox circuit court; and the same is to be paid out of any money not otherwise appropriated.

§2. This act to take effect from its passage.

CHAPTER 195.

AN ACT to amend the charter of the city of Covington.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the charter of the city of Covington be amended, and the council of said city is hereby authorized to pass such ordinance as shall allow fees to the marshal and jailer in said city, in cases of arrest and confinement for misdemeanor in the said city, as in their judgment may be deemed proper: Provided, however, Nothing herein shall be construed to interfere with the fees now allowed by law to such officers.

§ 2. This act shall take effect from and after its passage. Approved October 4, 1861.

AN ACT for the benefit of the sheriff of Washington county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§1. That the sheriff of Washington county be allowed until the 10th day of October, 1861, to return his delinquent
