IX. THE expenfe of maintaining and endeavoring to cure a registered infane, shall be paid by the public, and reimburled out of his eltate, (if any fuch there be); and in cafe of an infant, not an orphan, shall be reimbu parent, if of fufficient ability to fupport fuch infant; to be adjulged of, and certified by the court of that county where the parent refides, and may ja either cafe be recovered by an action, in the name of the directors, who shail account for what shall thus come to their hands.

XIV. ANY director who shall remove to the distance of twenty miles or upwards, from the faid hofpital, shall be confidered as having vacated his office. XV. NOT more than two perfons shall be paid as a guard for removing any infane perfon to the faid hofpital; which two shall have the fame allow ance made them for their fervices, as is at prefent allowed to guards employed in removing criminals, and who shall be paid by the court of directors, out of the monies appropriated for the ufe of the hofpital. e

XVI. WHERE any perfop of unfound mind, is, or shall be feized or poffeffed of any lands, tenements, or hereditaments, in trust, or by way of mortgage, the committee appointed for the care of fuch perfon, on the petition of one or more of the parties interested, and after hearing them all, may execute any fuch deed, or perform any other fuch act, as the trustee or mortgagee, if he were of found mind, might have' executed or performed. And fuch deed or other aft shall be as valid, except that he shall not be bound by a warranty or other covenant contained in the deed. Such committee may also make or take a furrenmay require, and der of a former leafe, or take or make a new leafe, as the cafe may be as it shall seem moft for the advantage of fuch infane perion; out of whofe eftate, any fine that may be advanced, and all other juft expenfes that incurred in order to obtain a new leafe to him, shall be reimbursed, and the new leafe shall not only be chargeable with fuch fine and expenfes, but shall remain fubject to all incumbrances which the leafe furrendered would have been subject to. 2

XVII. THE lands, tenements and chattels, of all ideots and lunatics whatfoever, shall be kept in like manner as is herein before directed, in the cafe of fuch as be fent to the hofpital, fafely, without waste or deftruction; and they and their household, shall live and be maintained competently, with the profits of the fame; and the refidue, befides their fuftentation, shall be kept for their ufe, to be delivered unto them when they come to right mind; and if they die in fuch Itate, their lands and chattels shall be diftributed in the manner directed by the act, intituled, "An act to reduce into one, the feveral acts directing the "course of defcents." e

XVIII: ALL and every act and acts, claufe and claufes of acts, concerning any matter or thing within the purview of this act, are, and shall be henceforth repealed. XIX.

CHAP. CXXI.

An Act to regulate Impresses.+

[Paffed the 24th of December, 1792.]

E it enacted by the General Affembly, That if any officer, foldier, commiffary, quarter-mafter, or other perfon, shall prefume to take from a. ny citizen or citizens of this commonwealth, any part of their property by way of imprefs, unless it be by warrant from the executive in cafe of actual invafion, or by the sheriffs or ferjeants bringing criminals to a diftrict court, or in fuch other cafes as is or shall be exprefsly allowed by law, it shall be lawful for any magiftrate in the county or corporation where the offence is committed, upon information on oath, to iffue his warrant for the immediate taking and fafe keeping of fuch offender or offenders, till they are delivered by due courfe of law; and all officers of the militia are hereby enjoined to fupport the civil power in fecuring and bringing fuch offenders to juftice.

II. ALL and every act and acts, claufe and claufes of acts, containing any thing within the purview of this act, (except as hereinafter provided) shall be, and the fame are hereby repealed: Provided always, that nothing in this act contained shall be conftrued to repeal any act heretofore made, for fo much thereof as may relate to any offence committed or done before the commencement of this act.

III. THIS aft shall commence in force, from and after the paffing thereof.

An Act concerning tributary Indians.

tence, or upon any confideration, to bargain and fell, or demife to any perfon or perfons, other than to fome of their own nation, or their pofterity, in fee, for life or for years, the lands laid out and appropriated for the ufe of fuch Indians, or any part or parcel thereof; or to bargain and fell as aforefaid, any other land whatsoever now actually poffeffed, or juftly claimed, and pretended to by the faid Indians, or any of them, by virtue of any articles of peace made and concluded with fuch Indians by this commonwealth, or by the government exifting previous to the establishment of this commonwealth, or by virtue of any other right and title whatsoever; and every bargain, fale, or demife, hereafter made contrary to this act as aforefaid, shall be, and is hereby declared to be null and void to all intents, conftructions, and purposes, a

II. IF any perfon or perfons (other than the Indians and their pofterity) shall from and after the publication of this act, prefume to purchase or obtain any deed, or conveyance in fee, or any leafe for years, from any of the tributary Indians, of any lands, tenements, or hereditaments, laid out or appropriated, or now actually poffeffed, or justly claimed, or pretended to by the faid Indians, or shall occupy or tend any of the faid lands by permiffion of the faid Indians, or otherwife, every perfon fo offending, and being thereof lawfully convicted in any court of record within this commonwealth, shall forfeit and pay the fum of one dollar and fixty-feven cents for every acre of land fo purchased, leafed, or occupied, and fo for every year fuch perfon or perfons may hold poffeffion of fuch lands, by virtue of fuch purchase or leafe; one moiety of which penalty shall accrue to the commonwealth, the other moiety to the informer; to be recovered by action of debt or information in any court of record within this commonwealth.

III. THE Indians tributary to this government, shall be well fecured and defended in their perfons, goods and properties; and whosoever shall defraud or take from them their goods, or do hurt or injury to their perfons, shall make fatisfaction, and be punished for the fame according to law, as if the Indian sufferer had been a citizen of this commonwealth.

IV. ALL acts or parts of acts, coming within the purview of this act, shall be, and are hereby repealed. Provided always, that nothing in this act shall (a) 1705, cb. 14.
