IN THE SEVENTEENTH YEAR OF THE COMMONWEALTH. 243 prefume to fell, or expofe to fale or barter, any barrel of pork, beef, tar, pitch, or turpentine, of lefs weight or guage, he or the thall forfeit and pay to the informer four dollars for every fuch barrel of pork or beef, and one dollar for every fuch barrel of tar, pitch, or turpentine, fold or expofed to fale or barter in this commonwealth; recoverable with cofs by the informer, before any How recoverable. juftice of the county where fuch offence fhall be committed, although the penalty fhall exceed five dollars; and every juftice of the peace, upon fuch complaint before him made, and due proof of fuch offence, fhall and may by vir tue of this act, give judgment for the whole penalty, and award execution thereupon, any law to the contrary thereof notwithstanding.

V. PROVIDED nevertheless, That from fuch judgment for more than five dollars, the party grieved may appeal to the next court to be held for the county wherein fuch complaint was made, the appellant entering into bond, with fufficient fecurity, before the juftice by whom the judgment shall be given, that he will profecute his appeal with effect, and pay the fame judgment, and all cofts awarded by the court, if the judgment thall be affirmed; and the juftice of the peace taking fuch bond, fhall return the fame, together with the whole record of his proceedings in the caule, to the fame court to which fuch appeal shall be, which court thall and may receive, hear, and finally determine the fame.

VI. EVERY feller or exporter of beef, pork, tar, pitch, or turpentine, Oath of feller or ex packed or filled in this commonwealth, and ftamped or branded, shall make oath porter of pork beef, before a justice of peace, at the time of the delivery of the goods fold or ex- tar, pitch, or turpenported, that the feveral barrels by him then fold or exported, are the fame that were infpected and paffed, and do contain the full quantity, without embezzlement or alteration, to his knowledge; and every perfon taking a falfe path, and being lawfully convicted thereof, thall fuffer the pains and penalties inflicted on perfons guilty of wilful and corrupt perjury; and moreover thall forfeit and pay the fum of one hundred and fifty dollars; to be recovered by any perfon or perfons that will fue for the fame, to his or their own ule.

VII. EVERY Cooper, and the mafter or owner of every fervant or flave, who fhall fet up barrels for pork, beef, tar, pitch, or turpentine, fhall make the fame in the following manner, to wit; barrels for pork and beef, fhall be made with good, ftrong, well feafoned white oak timber, clear of fap, and not lefs than five-eighths of an inch thick, tight and well hooped, with twelve hoops at leaft; and in the barrels for turpentine, there fhall be no fap pine timber, and they shall be hooped two-thirds of their length: Every barrel for pork or beef, to contain from twenty-nine to thirty-one gallons each; and every bar rel for tar, pitch, or turpentine, thirty-one gallons and a half at leaft, with his name, or the name of the matter of the fervant or flave, at length, ftamped or branded upon every barrel, under the penalty of forty-two cents for every barrel fet up for fale or exportation, and not fo ftamped or branded, of lefs contents than aforefaid.

VIII. THE feveral fines and forfeitures impofed by this act, (except fuch Fines, &e. how recom as are otherwife recoverable) shall and may be recovered to the ufe of the in former, where the fame shall not exceed five dollars, before any juftice of the peace; and for any fum above five dollars, and not exceeding twenty dollars, by petition in any county court; and for all fums above twenty dollars, in any court of record within this commonwealth, by action of debt or information, with cofts of fuit.

IX. ALL acts and parts of acts, coming within the purview of this act, Repealing claufe? shall be, and are hereby repealed. Provided always, That nothing in this Pravito.

WHEREAS it is neceffary to compel veffels arriving in this country from foreign parts of the world, to perform quarantine in certain

shall judge it probable that any plague or other infectious disease may be brought, shall be obliged to make their quarantine in fuch place, during fuch time, and in fuch manner as shall be directed by the governor, by his order in council, notified by proclamation, to be published in the Virginia gazette: And until they shall be difcharged from the quarantine, no fuch perfons or merchandize shall come or be brought on shore, or go or be put on board of any other veffel in the commonwealth, but in fuch manner, in fuch cafes, and by fuch licenfe, as shall be permitted by the order; and the veffels and perfons receiving goods out of her, shall be fubject to the orders concerning quarantine, and for preventing infection, which shall be made by the governor and council, and notified as aforefaid.

III. THE master of a veffel coming from fea, on board of which there shall be a perfon infected with the plague or other peftilential difeafe, shail immediately make the cafe known to fuch perfon as shall be appointed for the purpofe, in the manner as is hereinafter directed, who shall give intelligence thereof with all (peed to the governor, that measures may be taken for fupport of the crew, and precautions ufed to prevent the fpreading of the infection; and the mafter shall not enter into any port, but shall remain in fome open road, and shall avoid and hinder all intercourfe with other veffels or perfons, nor shall any of the paffengers or crew go on shore, until the order of the governor and council shall be received by the matter. Whofoever shall offend against this act, in either or any of the afore mentioned inftances, shall be amerced the fum of fifteen hundred dollars.

IV. WHEN a place shall be infected with the plague or other peftilentia! difeafe, or when the governor, with the advice of council, shall have notified by proclamation published in the Virginia gazette, that it is judged probable the plague or other peftilential difeafe may be brought from any place, if a veffel from fuch place shall be coming into a port of the commonwealth, the person who shall be authorifed to fee quarantine performed, shall go off, or caufe fome other to go off to the veffel, and at a convenient diftance require the commander, to declare what is his name, at what place the cargo was taken on board, at what places the veffel touched in her paffage, whether any of those places were infected with the plague or any other peftilential difeafe, how long the veffel had been in her paffage, how many perfons were on board when the fet fail, whether any on board during the voyage had been infected with the plague or other peftilential difeafe, and who they are, how many died in the voyage, and of what distemper, what veffels he or any of his company with his privity went on board of, and whether any of their company had been on board of his veffel, in their voyage, and to what places thofe veffels belonged, and what are the contents of his lading.

V. THE mafter of a veffel coming from a place infected with the plague or other peftilential difeafe, or having any perfon on board fo infected, who fhall conceal it, or who fhall not give true anfwers to the queftions fo to be propounded to him, fhall be amerced the fum of fifteen hundred dollars.

VI. THE mafter of a veffel ordered to perform quarantine, when he fall be required, after his arrival at the place appointed, thall deliver to the officer authorifed to fee it performed there, the bills of health and manifefts he fhall have received during the voyage, with his log book and journal; and refusing or neglecting fo to do, or to repair in convenient time after notice to the place appointed, or escaping from thence before quarantine performed, fhall be amerced the fum of fifteen hundred dollars.
