An Act to amend the Act," Concerning Grand-Furies, Petit-Juries, and Venire

I.

WHER

[Paffed the 9th of December, 1793.]

WHEREAS, under the existing law, concerning grand juries, petit- Preamble.
juries, and venire-men, the grand-juries of the district, county, and

corporation courts, are not in pofitive and explicit terms directed to be citizens
of this ftate, whereby it hath fometimes happened, that perfons not citizens of

this commonwealth, have been fummoned and impannelled as grand-jurors in

the faid courts: For remedy whereof,

II. BE it enacted, That hereafter every grand-juror, fummoned to attend Grand jurors must be any district, county, dr corporation court, or impannelled to ferve in the fame, citizens.

grand juries, petit-juries, and venire-men," be alfo a citizen of this common

wealth.

CHAP. CLIX.

An Act to amend an Act, reducing into one, the feveral Acts to oblige Veffels coming from Foreign Parts to perform Quarantine.||

HEREAS by the act, intituled, "An act reducing into one, the feve- Preamble ral acts to oblige veffels coming from foreign parts to perform quarantine," no provifion is made to compel perfons coming into this commonwealth by land, from places infected with contagious diseases, to perform quarantine : For remedy whereof,

BE it enacted, That the governor, with advice of the council, fhall appoint perfons to fuperintend the performance of quarantine, in fuch places, and from time to time, as he fhall judge neceffary; the perfon fo appointed, fhall examine all perfons coming into this commonwealth by land, from places infected with any contagious difeafes, and compel them to perform a quarantine of fo many days, and under fuch regulations, as fhall be directed and preferibed by the governor, with advice of council, for the prefervation of the health of the citizens of this commonwealth.

AND whereas by the faid act, the malter or owner of a veffel is compelled to defray the expenfes attending their veffel, after quarantine is performed, which in fome cafes is unreasonable: Be it therefore enacted, that the governor, with advice of council, be, and is hereby empowered to exempt quarantine. the owner from the payment of fuch expenfes, whenever he fhall think it right and just so to do.

IV. AND be it further enacted, That the veffels which have lately performed quarantine, be, and they are hereby releafed from the payment of the charges which accrued thereon.

V. THIS act fhall commence and be in force, from and after the paffing

CHAP. CLX.

An Act to amend the Act, intituled, "An Act for afcertaining the Salaries to the
Officers of Civil Government."

E it enacted, That fo much of the act of the laft feflion of the General Affembly, intituled, "An act for alertaining the falaries of the officers of the civil government," as relates to the falary of the clerk of the general court, fhall be, and the fame is hereby repealed.

II. AND be it further enacted, That the clerk of the faid court fhall rethe general court for ex. ceive for his ex-officio fervices, the fum of two hundred and fifty dollars per

III. IN cafe of a vacancy in the office of clerk of the general court, during vacation, any three judges of the faid court (of whom the fenior justice fhall be one) fhall appoint a clerk, who upon taking the oath required by law, before any juftice of the peace, fhall continue in office, until a clerk fhall be appointed by the faid court. Provided nevertheless, That the clerk of the general court now in office, may continue to hold the fame until the next meeting of the general court; any thing in any law to the contrary thereof, notwithstanding.

IV. AND be it further enacted, That the prefent judge of the high court of chancery, thall during his continuance in office, be allowed a fum, not exceeding two hundred and fifty dollars per annum, for the purpofe of employing a clerk.

V. THIS act fhall commence in force, from and after the first day of Fanuary next.

CHAP. CLXI.

An Act to amend an Act, intituled, "An Act to empower the High Sheriffs to proceed in a fummary Way, against their Deputies."

HEREAS the laws heretofore paffed, have in many inflances been found inadequate to indemnify the sheriffs of this conn:onwealth against the conduct and default of their deputies, and in molt cafes they have been obliged to fubmit to a recovery firft had and obtained againft them before they could legally proceed against their deputies, whereby much injury and injuftice has arifen to the fheriffs: Be it therefore enacted, that where any fine, amercement, peralty or judgment, has been affcffed or rendered, or which may be affeffed or rendered against any theriff heretofore or now in office, or which may hereafter come into office, his heirs, executors or adminiftrators, for or on account of any default or mifconduct of any deputy of fuch sheriff, it shall and may be lawful for the court of the county, whercof fuch theriff hath been, now is, or fhall be fheriff, or for the district court including fuch county, upon motion to them made by fuch fheriff, his heirs, executors or administrators, to give judgment against fuch deputy, and his fecurities, their heirs, executors of adminiftrators, for the full amount of all fuch fines, amne cements, penalties or judgments, and to award execution for the fame provided that fuch deputy and his fecurities, their heirs, executors or adminiftrators have ten days previ

ous notice of fuch motion.

II. AND, be it farther enacted, That where any deputy sheriff heretofore or now in office, or which may hereafter come into office, hath been or thail be found in arrears, for any money, tobacco or other thing received, or which ought to be received by fuch deputy, by virtue of his office, and for which the principal of fuch deputy, his heirs, executors or adminiftrators, is or may be chargeable, and fhall not immediately pay or deliver the fame to the perfon or perfons entitled thereto, it fhall and may be lawful for either of the faid courts, upon motion to them made by fuch fheriff, his heirs, executors or adminiftrators, to give the fame judgment against fuch deputy, and his fecurities, their heirs, executors or adminiftrators, as fuch theriff, his heirs, executors or adminiftrators, might by motion against him or them, on account of fuch arrears, mifconduct or default, be liable to, and to award execution for the fame ; pro
