BE it further enacted, That in cafe of the death or abfence of any perfon hereby required to hold an election, the fenior magiftrate in each county, city or borough refpectively, and in his abfence, inability or incapacity by being a candidate, the fecond, and fo on in fucceffion to the junior magiftrate, is hereby authorifed, empowered and required, to perform the duties of the perfon fo dying or being abfent-And the faid magiftrates in cafe of refufal, thall be fubject to all the penalties to which any fheriff or other perfon required to hold an election, is liable, and fhall be entitled to the fame compensation.

An Act to fix the Salaries of certain Officers.

E it enacted by the General Affembly, That the officers hereafter men- Salaries of certain offitioned, shall be allowed annually the following falaries: The keep. ce fixed. er of the Penitentiary houfe, the ium of one thousand two hundred dollars; the turnkey to the Penitentiary houfe, the fun of two hundred and fixty-fix dollars and fixty-fix cents; the clerk of the Penitentiary houfe, the fum of lix hundred and twenty-five dollars; the door-keeper of the capitol, and of the council, whofe duty is to keep the capitol clean, and obey the orders of the Executive, the fum of three hundred dollars; and the keeper of the keys of the capitol, the fum of two hundred dollars; to each of the under clerks in the Regifter's office, five hundred collars; to the keeper of the public feal, three hundred dollars; to the affiftant clerk of the council, one thousand dollars, which feveral fums fhall be paid quarterly out of the treasury, on warrants to be iffued by the auditor of public accounts.

7HEREAS it hath been reprefented that a collection has been made

lic and permanent nature, as are now in force within this commonwealth; and the faid Jofeph Caldwell having petitioned the legislature to fanction a publication of the fame in fuch manner, as to give them legal authority:

II. BE it enacted, That Hugh Holmes, Charles Magill, Robert White, and Archibald Magill, gentlemen, or any three of them, be, and they are hereby authorifed to examine the collection of the aforefaid acts, and all the notes and references refpecting the fame, made and propofed to be published by the faid Jofeph Caldwell; and if the faid committee fhall be of opinion, that the faid laws have been carefully collated, that the notes are accurately made, and that an edition thereof will be of public utility, upon a certificate to that ef fect, figned by three at least of the aforenamed perfons, published with the faid laws, and alfo that they are truly and accurately printed, they fhall be received, adjudged and considered, or equal authority with the originals from which they are taken, in all courts and other places within this commonwealth.

ALL. THIS act fhall be in force from the paffing thereof.

CHAP. I.

An Act for Equalizing the Land-Tax.

1. WHEREAS the land tax, as at prefent charged by the commiffion- Pream:bie,

ers of the feveral counties, is found to be very unequal, and from experience of the paft, it is certain that future valuations or affefliments (although attended with great expense and delay) will not produce that equality fo eifentially neceffary to the happiness of all the good citizens of this commonwealth: And whereas, by arranging the feveral counties whofe foil and fituation are nearly fimilar, into diftricts, a standard value is produced, whereby the accounts of every perfon within the faid district may be juttly regulated for all charges on land hereafter to be impofed, and a rule eftablished whereby in future the tax upon landed property may be laid with eafe and certainty, and collected with all poffible equality: Be it enacted, that the counties within this commonwealth fhall be laid off into four districts in manner following, that is to fay: The counties of Accomack, Northampton, Princefs dune, Norfelk, Nanfimond, Isle of Wight, Southampton, Surry, Sax, Prince George, Dinwiddie, Greenfville, Brunfavick, Chesterfield, Henrico, Charles City, James City, New-Kent, York, Warwick, King Queen, Elizabeto City, Hanover, Gloucefter, Middlefix, Effex, King William, Caroline, Spotfylvania, Lancaster, Northumberland, Richmond, Westmoreland, King George, Stafford, Prince William, Grecoland, Powhatan, Cumberland, Amelia, and Fairfax fhall compofe the first class. The counties of Loudoun, Fauquier, Culpeper, Orange, Louija, Fluvanna, Lunenburg, Mecklenburg, Prince Edward, Charlotte, Albemarle, Buckingham, Berkeley, Amberft, Campbell, Halifax, Bedford, and Frederick, fhall compole the second class. The counties of Pittsylvania, Henry, Botetourt, Shenandoah, Rockingham, Augufta, Rockbridge, and Hampshire, thall compofe the third claís: And the counties of Washington, Montgomery, Greenbrier, Monongalia, Obio,

B. do folemnly swear that I will to the best of my fkill and nagment, afcertain the true average price per acre of the lands within the feve ral counties of this commonwealth, agreeable to the returns male, and by comparing the fame to the ftandard by law established, will make out a just account of the land tax of every perfon charged in the faid returns agreeable to this det, and tranjmit the fame as by law required. So help me God. And each of the faid examiners, for their fervices herein, fhall receive from the treafurer of this commonwealth, by warrant from the auditors (which upon receipt of the books herein after mentioned, they are and fhall be empowered to grant) the fun of three hundred pounds.
