The resolution submitted yesterday by Mr. Bacon, on the subject of the Library, was taken up and read, and on motion, adopted.

On motion of Mr. Torrey,

Resolved, That the clergyman, invited to officiate as chaplains during the present session of the Council, and the Secretary and clerks of the Council, be admitted to the privileges of the Library room, and the use of the books during the session, and that the Secretary be directed to inform the individuals first mentioned, of the passage of this resolution,

The following resolutions were submitted by Mr. Martin, read and laid on the table.

Resolved, That the Legislative Council do now proceed to the election of a Clerk and Sergeant-at-arms, which offices are vacant by reason of the non acceptance thereof, by the persons elected on the 7th inst.

Resolved, That the committee on the Judiciary be instructed to inquire into the expediency of repealing so much of the law concerning the foreclosure of mortgages, as requires a notice of sale to be published in a newspaper printed at Detroit.

Resolved, That the committee on the Judiciary be instructed to inquire into the expediency of repealing the 33d section of the act concerning the Supreme, Circuit and County courts, passed April 13, 1827, so that bail may be taken in all civil cases, provided in the 3d section of the act concerning bail.

On motion of Mr. Hascall,

Resolved, That that part of the Acting Governor's message which relates to the "present organization and condition of the Judiciary," and "the jurisdiction now exercised by justices of the peace," be referred to the committee on the Judiciary; that which relates to Acts authorising the imposition of taxes, to the compensation of jurors, and to the admission of Michigan into the Union, to the committee on Territorial Affairs; that part which relates to common schools, to the committee on Schools; and that part which relates to the printing and promulgation of the laws, to the committee on Printing.

On motion of Mr. Kingsley,

Resolved, That the committee on the Library be instructed to procure one or more copies of the latest revised codes of the statute laws of the State of New-York, Pennsylvania, and Ohio, to be placed in the Library.

Mr. Bacon gave notice that he should, to-morrow, ask leave to bring in "A Bill to create the office of Culler of Staves and Heading," in the several organized counties of this Territory.

Mr. Durocher gave notice that he should, to-morrow, ask leave to bring in "A Bill to amend an act, entitled an Act to amend an act to incorporate the village of Monroe, and for other purposes," approved, May 29, 1828.

The Council adjourned to to-morrow, at 11 o'clock, A. M. FRIDAY, May 11, 1832. The oath of office was administered by the President to O. D. Richardson, as enrolling clerk.

The following petitions and papers were presented, read, and severally referred:

By Mr. Hascall, the petition of O. Clark, and others of Oakland county, for authority to Laban Smith to solemnize rites of matrimony in said county. Referred to the committee on the Judiciary.

The petition of certain inhabitants of Oakland county, praying the revision of the "act for the assessment and collection of county and township taxes." Referred to the committee on Territorial Affairs.

By Mr. Moran, a petition from sundry citizens of the Territory, praying a limitation of the jurisdiction of justices of the peace;

And a further petition from E. P. Hastings, and others, praying an extension of the limits of the city of Detroit. Referred to the committee on the Judiciary.

By Mr. Torrey, the petition of J. O. Lewis and others, respecting a map and directory of the City of Detroit. Referred to the committee on Expenditures.

And the petition of Charles Sacket and others, praying a limitation of the jurisdiction of justices of the peace ;

And the petition of O. Newberry and others, praying an act of incorporation of the Lake Michigan Steam Boat Company. Referred to the committee on the Judiciary.

By Mr. Britain, a petition of certain inhabitants of the county of Cass, praying the organization of a new township, to be called Colon;

A petition from certain inhabitants of Berrien county for the organization of a new township, to be called Berrien ;

A petition from certain inhabitants of the town of Ottawa, for the setting off therefrom of a new township, to be called Porter;

A petition from certain inhabitants of Washtenaw, for the setting off from the town of Dexter of a new township;

A petition from certain inhabitants of St. Joseph county, for the establishment of a Ferry at the Parc des Vaches, and a license to Antoine Antoilla to keep the same;

Which petitions were referred to the committee on Territorial Affairs.

By Mr. Hascall, a petition from certain citizens from Oakland, praying a revision of the probate law. The petition was laid on the table.

By Mr. Bacon, an account of Allan Farquhar against the Territory, for services in apprehending certain fugitives from justice. Referred to the committee on claims.

The President announced that hereafter the rules for the daily transaction of business would be so modified as to admit the introduction of resolutions after the offering and disposition of petitions and memorials.

Mr. Bacon offered a resolution, providing for the appointment of a Fiscal Agent of the Council, which was read the first time. The 14th rule being suspended, the resolution was read a second time, and ordered for a third reading on Monday.

Mr. Sprague submitted the following resolution, which was read, and laid on the table.

Resolved, That a select committee of three be appointed, to make inquiry into the present system of probate laws, to see whether they need revision or amendment; also to make inquiry into the practise under those laws, in the different probate courts in this Territory; to see whether it be according to the provisions of law, and uniform in the several counties. and in order to ascertain the latter, that said committee be authorized to send for persons and papers if, in their opinion, it shall be expedient. And further, that said committee make report with all convenient speed, by bill or otherwise.

On motion of Mr. Torrey,

Ordered, That the memorial of William Woodbridge and Edward A. Brush, in behalf of the supervisors of the county of Wayne, be referred to a select committee of three members, with leave to report on the matters therein set forth, by bill or otherwise.

On motion of Mr. Bacon,

Ordered, That the petition of William Bliss, presented yesterday, be referred to the committee on the Judiciary.

Mr. Martin called up the resolution submitted by him yesterday, relative to a new election of clerk and sergeant-atThe resolution having been read, and, by consent of the Council, modified by striking out so much as related to a new election of clerk,

arms.

Mr. Martin moved that the resolution be adopted.

Mr. Sprague moved to postpone the further consideration thereof until Monday next.

The question on the motion to postpone being taken the motion was lost.

The question recurring, on the motion to adopt the resolution, was decided in the negative.

So the resolution was rejected.

Mr. Torrey, having asked and obtained leave, presented the petition of J. Kingsley and others, praying an alteration of the Territorial road leading from a point near Ten Eyck's to Dexter; which was read and laid on the table.

On motion of Mr. Renwick,

Resolved, That the committee on Territorial Affairs be instructed to inquire whether the act of the last session of the Legislature, appointing commissioners to lay out and establish a territorial road, commencing at or near Ten Eyck's, on the Chicago road, thence on a westerly course until it reach the meridian line, has been complied with; and report the result to this house.

On motion of Mr. Torrey,

Ordered, That the petition last presented by him be referred to the committee on Internal Improvements.

Mr. Hascall gave notice that he should, at a future day, ask leave to bring in "a Bill to abolish imprisonment for debt." The "Bill to postpone the May term of the Supreme Court," was taken up, and read a third time.

On motion of Mr. Torrey, the blank was filled with the words, "third Monday."

Mr. Torrey moved that the bill pass.

The question being taken, it was decided that the bill pass, and that the title thereof be

"An Act to" &c.

Mr. Bacon, agreeably to previous notice, moved for leave to bring in "A Bill to create the office of Culler of Staves and Heading, in the several organized counties in this Territory."

Leave being granted, Messrs. Bacon, Sprague, and Durocher, were appointed a committee to bring in the bill.

The Council adjourned to Monday, at 11 o'clock, A. M. MONDAY, May, 14, 1832. The oath of office was administered by the President to James T. Allen, sergeant-at-arms.

The following petitions and papers were presented, read, and severally referred:

By Mr. Sprague, a petition from certain citizens of the town of Southfield, Oakland county, for authority to lay a tax of one per cent. for the support of common schools. Referred to the committee on Schools.

A petition from B. F. Stickney and others, for a continuation of the Territorial road from the town of Vistula to the Grand River, upon a route therein set forth.

And a similar petition, for the establishment of a road, to lead from the town of Vistula, on á route therein stated to the Chicago road. Referred to the committee on Internal Improvements.. By Mr. Britain, a petition of J. Beeson and others, bfor the incorporation of a bank, to be established at Niles, St. Joseph county. Referred to the committee on the Judiciary.

By Mr. Martin, the claim of J. Foley, sheriff of Jo Daviess county, for services and expenses in apprehending George Madeira, a fugitive from justice.

The petition of J. D. Doty and others, for an act of incorporation of the Wisconsin Internal Improvement Company. Referred to the committee on Internal Improvements.

By Mr. Durocher, an account of the Secretary of the Territory, for expenses incurred in furnishing for the Council, certain lists of officers in the Territory, in compliance with a resolution of the Council, adopted at its last session. Referred to the committee on Expenditures.
