Thursday, January 13, 1842.

Mr. Strong presented the remonstrance of citizens of Dane county against the nomination of Augustus A. Bird to be Sheriff of the county of Dane;

Which was read, and referred to the committee on Executive Nominations.

Mr. Arndt presented a resolution, as follows:

Resolved, That His Excellency the Governor be requested to communicate to the Council any reports which he may have received from Byron Kilbourn, Esq., Loan-Agent, relative to the negotiation of a loan for the Milwaukee and Rock River Canal, since his communication to this House of the 10th ultimo.

Mr. Martin presented the following:

Resolved, That the committee on the Judiciary inquire into the expediency of memorializing Congress to re-organize the Judicial system of the Territory, and to provide for the appointment of four or more Judges of the Supreme Court, with reduced salaries.

Mr. Maxwell, from the committee on Executive Nomitions, to whom had been submitted several communications from the Governor, making nominations to office, made a report thereon;

Mr. Martin, in accordance with notice given, obtained leave to introduce bill No. 15, entitled "A bill to provide

for the construction of certain works of internal improvements;"

Which was read a first and second times, and ordered to be printed.

On motion of Mr. Arndt, the resolution offered by him this morning, calling upon the Governor for certain information, was taken up, considered, and adopted.

On motion of Mr. Martin, the resolution offered by him this morning, instructing the committee on the Judiciary to inquire into the expediency of memorializing Congress relative to a change in the Judicial system of the Territory, was taken up, considered, and adopted.

On motion of Mr. Maxwell,

Ordered, That the Council do proceed to the consideration of Executive business.

And, pending the consideration of the Executive business, The following communication from His Excellency the Governor, was received by his private secretary, together with the accompanying papers, viz:

"To the Honorable

"the Legislative Council of Wiskonsan:

"A member of your body, who assumes to be the leader of a political party in this Territory, having, in a speech delivered before the Council, as I am informed, endeavored to create the impression that I had not, in my official address to the two Houses, on the 10th ultimo, stated correctly the language of my predecessor on a point of great im-` portance in the administration of the Territorial Govern

ment, to wit, whether the laws take effect before they are submitted to Congress,-1 beg leave to offer for your consideration the following correspondence.

"I feel authorized to assure your Honorable Body that the member, when he made his speech, had himself examined the record from which I had made the quotation, that he then found the language of Governor Dodge was as stated by me, and therefore knew that every word of the quotation was correct. J. D. DOTY.

"Executive Office, Madi-on, Jan. 12, 1812."

And the same having been read,

Mr. Martin moved to lay the communication and accompanying papers on the table for the present.

The motion was disagreed to, ayes 5, noes 7;
And, the ayes and noes being called for,

Those who voted in the affirmative, are Messrs. Bullen, Janes, Martin, Upham, and Collins, (President;)

Those who voted in the negative are, Messrs. Arndt, Brigham, Learned, Maxwell, Rountree, Tweedy, and Vineyard.

Mr. Arndt then moved that the communication and documents accompanying it, be printed;

Mr. Vineyard moved to amend the motion, by directing that two thousand copies thereof be printed.

The amendment was agreed to, and the motion to print two thousand copies was adopted.

Mr. Vineyard then moved that two thousand copies of so much of the speech of the member referred to in the

communication of His Excellency, as relates to the subject of said communication, be also printed.

And, the question being taken thereon, it was determined in the negative-ayes 4, noes 8.

The ayes and noes being called for,

Those who voted in the affirmative, are Messrs. Janes, Upham, Vineyard, and Collins, (i'r sident;)

Those who voted in the negative, are Messrs. Arndt, Bullen, Brigham, Learned, Martin, Maxwell, Rountree, and Tweedy.

The Council then resumed the consideration of Executive business.

And, the same being disposed of,

The following Message was received from the House of Representatives, by the Clerk thereof, viz:

"Mr. President:-The House of Representatives has passed No. 2, entitled Preamble and resolution relative to a Penitentiary;' and has concurred in bill No. 6, of this House, entitled A bill to incorporate the trustees of the Platteville Academy,' with an amendment; in which resolution and amendment I am directed to request the concurrence of this House."

On motion of Mr. Martin,

Ordered, That the vote of this morning, by which the Council directed two thousand copies of the communica tion received from His Excellency the Governor, this day, together with the accompanying papers, to be printed, be reconsidered.

The question then recurred on the motion to print two

thousand copies of said communication and accompanying papers; when,

Mr. Tweedy moved to amend the motion so as to require that the usual number of copies of the communication and accompanying papers, together with so much of the speech of the member referred to in said communication, be printed.

And the question being put thereon, it was determined in the affirmative-ayes 10, noes 2;

The ayes and noes being called for,

Those who voted in the affirmative, are Messrs. Bullen, Brigham, Janes, Learned, Maxwell, Tweedy, Upham, Vineyard, and Collins, (President.)

Those who voted in the negative, are Messrs. Arndt and Rountree.

On motion of Mr. Martin, the Council was resolved into committee of the whole, Mr. Maxwell in the chair, for the further consideration of bill No. 1, entitled “A bill to amend the act of the Revised Statutes, entitled an act concerning the writ of attachment;"" and, after some time, the committee rose, reported progress, and asked leave to sit again thereon.

Leave was granted.

On motion of Mr. Strong, the Council adjourned.
