On motion of Mr. Dowling, and by unanimous consent, the rules were suspended and said bill ordered to a third reading and referred to the committee on taxation and retrenchment, retaining its place in the order of third reading.

Mr. Foley introduced a bill (Int. No. 1157) entitled “An act to amend the Real Property Law, in relation to the sale and mortgage of cemetery lands," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Foley, and by unanimous consent, the rules were suspended and said bill ordered to a third reading.

The Assembly sent for concurrence the bill (No. 1285, Rec. No. 255) entitled "An act in relation to the paving of certain streets in the village of Ellicottville and to the payment of the share of the village of the cost of such paving," which was read the first time, and by unanimous consent was also read the second time and referred to the committee of villages.

amend the Legislative Law, in relation to the compensation of sergeants-at-arms of the Legislature, and making an appropriation for the additional compensation," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Slater, and by unanimous consent, the rules were suspended and said bill ordered to a third reading and referred to the committee on finance, retaining its place in the order of third reading.

Also, a bill (No. 747, Rec. No. 260) entitled "An act to amend the Code of Criminal Procedure, in relation to confinement pending the determination of an appeal of persons convicted of murder in the first degree," which was read the first time, and by unanimous consent was also read the second time and referred to the committee on codes.

Also, a bill (No. 649, Rec. No. 261) entitled "An act to amend the Code of Civil Procedure, in relation to proceedings in the surrogate's court," which was read the first time, and by unanimous consent was also read the second time and referred to the committee on codes.

On motion of Mr. Graves, and by unanimous consent, said bill was subsituted for Senate bill (No. 1166, Int. No. 810), now on the order of third reading.

Also, a bill (No. 780, Rec. No. 266) entitled "An act to authorize the board of trustees of the village of Ossining to make a reapportionment and reassessment of the portion of the expense of the sewer system of such village chargeable to the property benefited, and to refund to the persons entitled thereto the amount of any deductions made by such reapportionment and reassessment," which was read the first time, and by unanimous consent was also read the second time.

Also, a bill (No. 1511, Rec. No. 267) entitled "An act to authorize the Commissioners of the Land Office to grant and release to the city of New York certain lands under water in the Atlantic ocean in the boroughs of Brooklyn and Queens, to provide for the protection of adjacent uplands, the improvement of such lands under water and uplands and the acquisition of property for any such purpose, by such city, and to prescribe the method for defraying the cost," which was read the first time, and by unanimous consent was also read the second time and referred to the committee on finance.

Also, a bill (No. 1422, Rec. No. 268) entitled "An act authorizing the city of Lockport to issue bonds for the purpose of acquiring property located in the city of North Tonawanda, New York, belonging to the Tonawanda Iron and Steel Company, for the use of the system of waterworks for said city, and to be used as a pumping station, and to settle the condemnation action commenced by said city against said steel company for the taking thereof and costs and disbursements in connection therewith," which was read the first time, and by unanimous consent was also read the second time.
