Senator Wilson, chairman of the Committee on Insurance reported Senate bill No. 93, An act to repeal chapter 160, session laws of 1889, entitled "An act to authorize mutual fire insurance companies to provide for a guarantee fund to increase the security of its policyholders," and recommended that it be indefinitely postponed.

Senator Lockard, chairman of the Committee on Public Health, reported Senate bill No. 109, An act relating to the practice of pharmacy and the sales of poisons, and amendatory of section 118, article 10, of chapter 99, and repealing sections 260 and 261, article 7 of chapter 31 of the general statutes of Kansas, 1889, and recommended that it be passed.

Senator Howard, chairman of the Committee on Educational Institutions, reported Senate bill No. 142, An act to establish an experimental station at the State University of Kansas, to promote and conduct experiments for the destruction of chinchbugs by contagion or infection, and making an appropriation therefor, and recommended that it be referred to the Committee on Ways and Means, and the bill was so referred.

Senator Kelley of Crawford, chairman of the Committee on Railroads, reported Senate bill No. 47, An act to repeal section 1325 of the general Statutes of 1889, and recommended that it be not passed.

Also, Senate bill No. 135, An act to repeal chapter 139, laws of 1886, and recommended that it be not passed.

Also, Senate bill No. 171, An act to amend section 1 of the laws of 1886, and recommended that it be passed.

Also, Senate bill No. 23, An act to repeal chapter 139, laws of 1886, and recommended that it be not passed.

Senator Gillett, chairman of the Committee on Judiciary, reported Senate bill No. 35, An act with reference to the verdicts of juries, and to amend section 286 of the code of civil procedure, being paragraph 4381 of the general statutes of Kansas of 1889, and recommended that it be passed.

Also, Senate bill No. 164, An act to remove the political disabilities of certain persons, and recommended that it be passed.

Also, Senate bill No. 32, An act to amend section 584 of the code of civil procedure relating to costs, being paragrah 4685 of the general statutes of Kansas, 1889, and recommended that it be passed.

Also, Senate bill No. 51, An act to repeal chapter 166 of the session laws of 1887, being sections 36, 37, 38, 39, 40, 41, 42, 43, 44, 45, 46, 47, chapter 54, of the general statutes of Kansas of 1889, relating to jury commissioners, and recommended that it be passed.

Also, Senate bill No. 172, An act to prohibit the use of tobacco by persons under sixteen years of age in public places, and recommended that it be passed as amended.

Also, Senate bill No. 40, An act to amend section 2, chapter 107, session laws of 1889, being "An act to amend section 73 of chapter 80, general statutes of 1868," in relation to the code of civil procedure, and recommended that it be passed.

Also, Senate bill No. 74, An act to amend sections 4325 and 4326 of the general statutes of 1889, relating to all attachments in certain cases, and recommended that it be passed.

Senator Forney, chairman of the Commiteee on Engrossed Bills, reported Senate bill No. 94, An act to amend sections 9 and 16 of article 2 of an act entitled "An act to establish a code of criminal procedure," being chapter 82 of the general statutes of Kansas of 1889, back to the Senate correctly engrossed.

Also, Senate bill No. 79, An act to amend sections 77, 79, 80 and 81 of article 9 of chapter 105 of the general statutes of Kansas, 1889, entitled "An act relating to stock," back to the Senate correctly engrossed.

THIRD READING OF BILLS.

Senate bill No. 50, An act to repeal chapter 161 of session laws of 1872, being sections 43, 44, 45, 46, 47, 48, 49, 50, 51, and 52, of chapter 79 of the general statutes of Kansas, 1889, was read the third time.

Senator Osborn moved that all after the enacting clause be stricken out, and the following inserted:

SECTION 1. That section No. 4068 of the general statutes of 1889 be amended so as to read as follows: Section 4068. That in all counties having more than forty-five thousand inhabitants, the board of county commissioners shall appoint one person having the qualifications of an elector, who shall be styled commissioner of the poor, and who shall hold his office for two years, and who shall have under the control of the board of county commissioners, general care and supervision of the poor of such county.

SEC. 2. Original section No. 4068 of the general statutes of 1889, is hereby repealed.

SEC. 3. This act shall take effect and be in force from and after its publication in the official state paper.

A vote being had, the amendment prevailed.

Senator Osborn then moved that the title be amended, which motion prevailed.

The bill was then placed on third reading, and the question being, Shall the bill pass? the roll was called, with the following result: Yeas 30, nays 0.

Senators voting in favor of the passage of the bill were: Messrs. Bentley, Berry, Carroll of Leavenworth, Elliston, Emery, Forney, Harkness, Hays, Howard, Johnson, Kelley of Crawford, King, Kirkpatrick, Lockard, Long, McTaggart, Martin, Mohler, Murdock, Osborn, Rankin, Richter, Roe, Schilling, Senior, Smith, Tucker, Wheeler, Woodward, and Wright.

Senators absent or not voting were: Messrs. Buchan, Carroll of Miami, Gillett, Kelly of McPherson, Kimball, Mechem, Moody, Norton, Rush, and Wilson.

A constitutional majority having voted in favor of the passage of the bill, the bill passed, and the title as amended was agreed to.

Senate bill No. 94, An act to amend sections 9 and 16 of article 2 of an act entitled "An act to establish a code of criminal procedure," being chapter 82 of the general statutes of the state of Kansas of 1889, was read the third time, and the ques

tion being, Shall the bill pass? the roll was called, with the following result: Yeas 29, nays 0.

Senators voting in favor of the passage of the bill were: Messrs. Berry, Carroll of Leavenworth, Elliston, Emery, Forney, Harkness, Hays, Johnson, Kelley of Crawford, Kelly of McPherson, King, Kirkpatrick, Lockard, Long, McTaggart, Martin, Mohler, Murdock, Norton, Osborn, Richter, Roe, Schilling, Smith, Senior, Tucker, Wheeler, Woodward, and Wright.

Senators absent or not voting were: Messrs. Bentley, Buchan, Carroll of Miami, Gillett, Howard, Kimball, Mechem, Moody, Rankin, Rush, and Wilson.

A constitutional majority having voted in favor of the pas sage of the bill, the bill passed, and the title was agreed to, as amended.

Senate bill No. 79, An act to amend sections 77, 79, 80 and 81 of chapter 105, article 9 of the general statutes of 1889, entitled "An act relating to stock," was read the third time, and the question being, Shall the bill pass? the roll was called, with the following result: Yeas 23, nays 12.

Senators voting in favor of the passage of the bill were: Messrs. Bentley, Carroll of Leavenworth, Emery, Gillett, Hays, Johnson, Kelley of Crawford, Kelly of McPherson, King, Long, McTaggart, Martin, Mechem, Moody, Murdock, Osborn, Richter, Roe, Schilling, Senior, Tucker, Wilson, and Wright.

Senators voting in the negative were: Messrs. Berry, Elliston, Forney, Harkness, Howard, Kirkpatrick, Lockard, Rankin, Rush, Smith, Wheeler, and Woodward.

A constitutional majority having voted in favor of the passage of the bill, the bill passed, and the title was agreed to as amended.

ORIGINAL MOTIONS AND RESOLUTIONS.

Senator Roe moved to recall Senate bill No. 59 from the House.

Senator Martin demanded that the motion to recall be in writing. So ordered.

I move that Senate bill No. 59 be recalled from the House.
