THIRTY-SECOND DAY

Guthrie, Oklahoma Territory,

Friday, February 10, 1905.

MORNING SESSION.

The Council was called to order by the President.

Prayer was offered by the Chaiplain.

The Journal of the preceding day was read and approved.

A message was received from the House transmitting Council Bill No. 3 and Council Bill No. 1.

Mr. Cralle presented petition No. 10, which was read and referred to Committee on Education.

Mr. Decker presented petition No. 11, which was read and filed. The following Bills were read the second time and referred to Committees:

Council Bill No. 125, by Mr. Threadgill, by request, to Committee on Private Corporations and Corporate Law; Council Bill No. 126, by Mr. Murphy, by request, Committee on County and County Affairs; Council Bill No. 128, by Mr. Cralle, Committee on Elections.

The rules were suspended and the Committee on Enrolled and Engrossed Bills reported Council Bills Nos. 94, 51, 40, 61, 71, 63, 96, 98, 45 correctly engrossed; report adopted.

Council Bill No. 75, by Mr. Sharrock, was read the third time, but the final vote was deferred.

Council Bill No. 117 was laid indefinitely on the table, on motion of Mr. Francis.

Council Bill No. 61, by Mr. Murphy, was read the third time and placed on its final passage. The question being "Shall the bill pass,” the roll was called and resulted as follows:

Ayes: Cralle, Hickam, Murphy, Scott, Woodson, 5; nays: Alexander, Decker, Francis, Menefee, Niblack, Sharrock, Threadgill, Mr. President, 8.

Mr. Alexander explained his vote: "The principle is good, but the machinery is faulty, consequently I vote 'no.' It is too expensive, for the benefit derived."

The bill was declared lost.

Council Bill No. 71, by Mr. Murphy, was read the third time and placed on its final passage. The question being, "Shall the bill pass," the roll was called and the vote resulted as follows:

Ayes: Alexander, Cralle, Francis, Hickam, Menefee, Murphy, Niblack, Scott, Sharrock, Threadgill, Woodson, Mr. President, 12; nays: Decker, 1.

The title of the bill was agreed to.

Council Bill No. 40, by Mr. Woodson, was read the third time and placed on its final passage. The question being, "Shall the bill pass," the roll was called and the vote resulted as follows:

Ayes: Alexander, Cralle, Decker, Francis, Hickam, Menefee, Murphy, Niblack, Scott, Sharrock, Threadgill, Woodson, Mr. President, 13. The title of the Bill was agreed to.

Council Bill No. 45 was read for the third time and placed on its final passage. The question being, "Shall the bill pass," the roll was called and the vote resulted as follows:

Ayes: Alexander, Cralle, Decker, Francis, Hickam, Menefee, Murphy, Niblack, Scott, Sharrock, Threadgill, Woodson, Mr. President, 13.

The title of the Bill was agreed to.

Council Bill No. 51 was read the third time and placed on its final passage. The question being, "Shall the bill pass," the roll was called and the vote resulted as follows:

Ayes: Alexander, Cralle, Decker, Francis, Hickam, Menefee, Murphy, Niblack, Scott, Sharrock, Threadgill, Woodson, Mr. President, 13.

The title of the Bill was agreed to.

Council Bill No. 96 was read the third time and placed on its final passage. The question being, "Shall the bill pass," the roll was called and the vote resulted as follows:

Ayes: Alexander, Cralle, Decker, Francis, Hickam, Menefee, Murphy, Niblack, Scott, Sharrock, Threadgill, Woodson, Mr. President, 13. The title of the Bill was agreed to.

Council Bill No. 98 was read for the third time and placed on its final passage. The question being, "Shall the bill pass," the roll was called and the vote resulted as follows:

Ayes: Alexander, Cralle, Decker, Francis, Hickam, Menefee, Murphy, Niblack, Scott, Sharrock, Threadgill, Woodson, Mr. President, 13.

The title of the Bill was agreed to.

Council Bill No. 63 was read the third time and placed on its final passage. The question being, "Shall the bill pass," the roll was called and the vote resulted as follows:

Ayes: Alexander, Cralle, Decker, Francis, Hickam, Ménefee, Murphy, Niblack, Scott, Sharrock, Threadgill, Woodson, Mr. President, 13.

The title of the Bill was agreed to.

Council Bill No. 94 was read for the third time and placed on its final passage. The question being, "Shall the bill pass," the roll was called and the vote resulted as follows:

Ayes: Alexander, Cralle, Decker, Francis, Hickam, Menefee, Murphy, Niblack, Scott, Sharrock, Threadgill, Woodson, Mr. President, 13.

The title of the Bill was amended and agreed to.

Council Bill No. 110 was read for the third time and placed on its final passage. The question being, "Shall the bill pass," the roll was called and the vote resulted as follows:

Ayes: Alexander, Cralle, Decker, Francis, Hickam, Menefee, Murphy, Niblack, Scott, Sharrock, Threadgill, Woodson, Mr. President, 13. The title of the Bill was agreed to.

On motion of Mr. Alexander, the Council took a recess until 2 o'clock.

AFTERNOON SESSION.

Council was called to order by the President.

Council Bill No. 75 was read for the third time and placed on its final passage. Mr. Scott moved that the enacting clause be stricken out.

A message was received from the House transmitting House Joint Resolution No. 8.

A message was received from the House transmitting House Bills Nos. 53 and 30.

The motion of Mr. Scott to strike out the enacting clause of Council Bill No. 75 was lost. The question being, "Shall the bill pass," the roll was called and the vote resulted as follows:

Ayes: Alexander, Cralle, Decker, Menefee, Niblack, Sharrock, Threadgill, 7; nays: Francis, Murphy, Scott, Woodson, Mr. President, 5; absent: Hickam, 1.

The title of the Bill was agreed to.

The following Bills and Resolutions were introduced and read for the first time:

Council Bill No. 129, by Mr. Francis, "An Act to define and punish slander of females."

Council Bill No. 130, by Mr. Francis, "An Act to require persons, co-partnerships and private corporations to report to the clerk of the

city or town in regard to fire insurance obtained by them in certain cases, to require such officer to keep a record of the same, and for other purposes.

Council Bill No. 131, by Mr. Francis, "An Act to punish horse. racing on public highways."

Council Bill No. 132, by Mr. Menefee, "An Act relating to liens for labor and materials furnished to owners of leaseholds for oil and gas purposes, and for material and labor for the construction of oil and gas pipe lines."

House Joint Resolution No. 8, by Mr. McBride, appropriating Fifteen Hundred Dollars to pay for printing the Governor's Message.

House Joint Resolution No. 11, by Mr. Ballinger, a memorial to Congress in regard to statehood.

The Committee on Education reported, recommending that House Bills Nos. 47, 109 and 17 do pass, that House Bills Nos. 75 and 61 do not pass, and returning petitions for files of the clerk; report adopted.

Mr. Francis introduced Council Resolution No. 12, by unanimous

consent.

The President signed House Bill No. 30 and House Bill No. 53. Council Resolution No. 12 was read and laid over by request of Mr. Alexander.

Mr. Alexander moved that a Committee of three be detailed to draft a Resolution, memoralizing Congress in regard to statehood; motion carried. Mr. President appointed as such Committee, Mr. Alexander, Mr. Scott and Mr. Francis.

On motion of Mr. Sharrock, the Council took a recess of twenty minutes.

The Council was called to order by the President.

On motion of Mr. Decker, the Council resolved itself into the Committee of the Whole, with Mr. Menefee in the Chair.
