SIR-I am instructed by the House to return to the Senate the following bill:

Senate bill No. 50, entitled

A bill to provide for the appointment of a commissioner of railroads, and to define his powers, duties, and fix his compensation,

And to inform the Senate that the House has amended the same as follows:

First, By striking out all of section 5, after the words "Auditor General;"

Second, By inserting in amended section 5, after the words, "the incidental expenses of his office," the words, "together with all actual cash outlay for railroad fares;"

Third, By adding at the end of line 33, section 7, the words, "including amounts paid for the use of palace and sleepingcars; "

Fourth, By adding at the end of line 26, section 7, the words, "including the mileage of rented cars ;".

Fifth, By striking out in line 2, section 8, the words to his duty as such commissioner," and inserting in lieu thereof the words "to the duties of his office, relating to the management of their respective corporations;

Sixth, By inserting in line 2, section 16, after the word. "terminate," the words, "at the same place;"

Seventh, By inserting in line 3, section 16, after the word "terminating," the words "at the same place;"

Eighth, By striking out in line 3, section 19, the word "shall" and inserting in lieu thereof the words "may if he deem it expedient;"

Ninth, By striking out all of section 6, after the word "therefrom;"

In the passage of which, as thus amended, the House has concurred by a majority vote of all the members elect, and has ordered the same to take immediate effect by a vote of twothirds of all the members elect.

SIR-I am instructed by the House to return to the Senate the following bill:

Senate bill No. 221, entitled

A bill to grant a special charter to the village of Morenci, heretofore incorporated by the board of supervisors of the county of Lenawee;

And to inform the Senate that the House has amended the same as follows:

First. Strike out in second line, section 3, article 5, "village of Morenci" and insert "people of the State of Michigan."

Second. Strike out "gift enterprises" in lines 35 and 36, section 3, article 6.

Third. Insert "gift enterprises and" in line 34, section 3, article 6, after word "punish."

Fourth. Strike out "eating" in line 36, section 3, article 6. Fifth. Strike out all after word "destroyed" in line 167, section 3, article 6, to and including the word "and" in line 174, and insert the following: "Any person interested in any such building so destroyed or injured, may at any time within three months thereafter, apply to the board of trustees to pay to him the damages sustained, and may agree with said board as to such damages; and said board may order the damages so agreed upon out of the contingent fund of said village. No action shall be commenced against any person so assisting, or against said village for any such damages, unless the person claiming the same shall have presented his said claim to said board within said three months; and a reasonable time shall have elapsed after said claim shall have been so presented to enable said board to agree with him as to such damages, and to pay the same before the commencement of said action.

Sixth. Strike out "such damage" in line 176, section 3, article 6, and insert "the damages which may have been so, agreed upon, or which may have been so recovered in any action brought to recover the same."

Seventh. Strike out "without" in 13th line, section 1, article 19, and insert "within ;" strike out "village" in 14th line same section, and insert "township of Seneca."

Eighth. Strike out "may be used or appointed" in line 3, section 1, article 28.

Ninth. Strike out "shall be appropriated to the support of the township libraries, as provided by the constitution," in lines 5, 6, and 7, section 1, article 28, and insert in line 5, after word "act," the following: "May be used or appropriated : Provided, That any moneys otherwise appropriated by the constitution or general laws of the State for library purposes shall be appropriated;"

In the passage of which as thus amended the House has concurred by a majority vote of all the members elect, and has ordered the same to take immediate effect by a vote of two-thirds of all the members elect.

SPECIAL ORDER,

The President announced that the hour of 7 o'clock had arrived, the time fixed for the consideration of House joint resolution No. 2, entitled

Joint resolution asking Congress for an appropriation for the survey of the Michigan Ship Canal;

On motion of Mr. Childs,

The Senate went into committee of the whole for the consideration of the above named joint resolution,

Mr. King in the chair.

After some time spent therein, the committee rose, and through the chairman, made the following report:

The committee of the whole have had under consideration the following entitled joint resolution:

House joint resolution No. 2, entitled

Joint resolution asking Congress for an appropriation for the survey of the Michigan Ship Canal;

Have made no amendment thereto, and have directed their chairman to report the same back to the Senate, and recommend its passage.
