Browning, who had served as Clerk of the Court since August 15, 1958, resigned, effective October 23, 1961, to accept appointment as a Judge of the United States Court of Appeals for the Ninth Circuit. Mr. John F. Davis, who had served for many years as an Assistant to the Solicitor General and who had argued more than 50 cases before the Court, was appointed to succeed Judge Browning as Clerk of the Court and assumed his duties on October 23, 1961.
