The Senators holding over and the Senators elect of the State of Indiana met in the Senate Chamber in the State Capitol on January 4, 1923, at ten o'clock a. m., this being the time fixed by the Constitution of the State of Indiana for the convening of same, viz.: "Commencing on the Thursday after the first Monday of January of every second year after the adoption of the Constitution in the year of our Lord, one thousand eight hundred and fifty-three."

Lieutenant-Governor Emmett F. Branch, President of the Senate, called the Senate to order.

Prayer was offered by Rev. Ray Montgomery of the Christian Church of Martinsville.

The following named Senators elected in 1920 for the constitutional term of four years, appeared and answered to their names: Adams, Baxter, Beardsley, Behmer, Buchanan, Cann, Cleveland, Dunn, English, Fitch, Hartzell, Hays, Hill, Henley, Holmes, Leonard, Lindley, Miller, Moorhead, Nejdl, Nichols, Richards, Steele, Swain, Van Orman.

Lieutenant-Governor Emmett F. Branch ordered the roll call of the Senators elected in 1922, and the following Senators answered present: Barker, Batt, Brown, Chambers, Cravens, Crosby, Daily, Davis, Durham, Easton, Erni, Harlan, Harmon, Hodges, King, Lambert, Lochard, Lutz, Merry, Penrod, Perkins, Saunders, Shirley, Southworth, Sweeney. Each presented his certificate of election.

The oath of office was administered by Judge Willis C. McMahan of the Appellate Court.

Nomination of President pro tem. was now declared in order and Senator Nejdl and Senator Cravens were placed in nomination. There being no further nominations, President orders roll call, which was as follows: those voting for Nejdl were: Adams, Barker, Baxter, Beardsley, Behmer, Brown, Buchanan, Cann, Cleveland, Cravens, Daily, Dunn, English, Fitch, Harlan, Hartzell, Hill, Hodges, Holmes, Lambert, Leonard, Lindley, Merry, Miller, Moorhead, Nichols, Richards, Southworth,

Steele, Swain, Van Orman; total votes 31; those voting for Cravens were: Batt, Chambers, Crosby, Durham, Easton, Erni, Harmon, Hays, King, Lochard, Lutz, Nejdl, Perkins, Saunders, Shirley, Sweeney; total votes 16.

Nejdl having received a majority, was declared elected President pro tem. of the Senate.

Nominations being in order for Principal Secretary, Zell C. Swain was placed in nomination by Senator Southworth. There being no other candidate, he was declared elected by acclamation.

Nominations being in order for Assistant Secretary, Miss Ferne Ale was placed in nomination by Senator Brown. There being no other candidate, she was declared elected by acclamation.

Nomination for Principal Doorkeeper being in order, Jerome Brown was placed in nomination. There being no other candidate, he was declared elected by acclamation.

The officers-elect presented themselves at the bar of the Senate and were sworn to support the Constitution of the United States, and the Constitution of the State of Indiana, and to perform the duties of their respective offices to the best of their abilities, by Judge Willis C. McMahan of the Appellate Court.

SENATE RESOLUTION.

Senator Fitch offered the following resolution:

MR. PRESIDENT:

I offer the following resolution and move its adoption:
RESOLVED:

That George Graham, the Postmaster of the Senate, be authorized to receive from the Postmaster of Indianapolis, the mail of the Senate and the employees thereof that may be directed to the General Delivery or in care of the Senate, and that the Secretary be directed to send a certified copy of the resolution to the said Postmaster of Indianapolis.

The resolution was adopted.

FITCH, Senator.

Senator Cravens asked that Senator Harmon be excused on account of his father's illness. Which request was granted.

SENATE MOTION.

Senator English presented the following motion:

MR. PRESIDENT:

I move that a committee of five be appointed to notify the House that the Senate has met, formed a quorum and organized by the election of

President Pro Tem.-James J. Nejdl.

Principal Secretary-Zell C. Swain.

Assistant Secretary-Ferne Ale.

Principal Doorkeeper-Jerome Brown.

and is prepared to proceed with legislative business.

ENGLISH, Senator.

The motion prevailed and the chair appointed the following com

mittee:

Senators English, Cleveland, Dunn, Cravens, Lutz.

SENATE RESOLUTION.

Senator Hill offered the following resolution:

MR. PRESIDENT:

I offer the following resolution and move its adoption: RESOLVED: That there be appointed by the President of the Senate a committee of four to act with a like committee of the House, to wait upon the Governor, to notify him of the organization of both Houses of the General Assembly, and that they are ready for the transaction of public business, and to learn the time the Governor will deliver his message.

HILL, Senator.

The resolution was adopted, and the chair appointed the following committee:

Senators Hill, Nejdl, Chambers, Batt.

MESSAGE FROM THE HOUSE.

MR. PRESIDENT:

We offer the following message from the House of Representatives: We desire to announce to the Senate that the House of Representatives is organized and ready to receive any communications from the Senate, and that the following officers have been elected by the House: Speaker-Raymond C. Morgan.

Chief Clerk-Frank E. Wright.
Assistant Clerk-Nina Schmidt.

Chief Doorkeeper-Everett J. Newlin.

SENATE MOTION.

Senator Van Orman presented the following motion:

MR. PRESIDENT:

I move that the Rules of Procedure of the Senate of the Seventysecond Session General Assembly be the Rules of Procedure of this session until such time as changes be made therein.
