AN ACT to amend an act entitled "an act to incorporate the village of Fairplay," approved Feb ruary 24, 1845.

BE IT ENACTED by the Council and House of Representatives of the Territory of Wisconsin:

SECTION 1. That all of section number twenty-five, in town. ship No, one, of range No, two west of the fourth principal meridian, in the county of Grant, shall hereafter be known as the village of Fairplay; and the inhabitants residing, or who may hereafter reside on the said section, are hereby constituted a body corporate by the name of "the trustees of the village of Fairplay;" and by that name they and their successors forever hereaf ter shall and may have perpetual succession, and be capable in law of suing and being sued, pleading and being impleaded, an swering and being answered unto, defending and being defended in all courts and places and in all suits whatsoever.

SEC. 2. Section one, of an act entitled "an act to incorporate the village of Fairplay," approved February 24, 1845, is hereby repealed; and the preceding section is enacted in the place of the said repealed section.

AN ACT to vacate a part of Second street, in the town of Potosi, in the county of Grant, and for other purposes.

BE IT ENACTED by the Council and House of Representatives of the Territory of Wisconsin:

SECTION 1. That all that part of Second street, in the town of Potosi, in the county of Grant, which is embraced in the

width and space of fifteen feet on the south side of said street, and running of that width from Main street the whole length of lot number twenty-four in the said town, be and the same is hereby vacated as a street or public highway, and all the ground embraced in the said limits is hereby attached to and made a part of the said lot number twenty-four in the said town: Provided, that the owners of lots number twenty-two and twenty-four shall pay to the receiver of the money arising from the sale of lots in the said town of Potosi, under the provisions of an act entitled "an act to provide for carrying into effect an act of Congress entitled an act granting a section of land for the improvement of Grant river, at the town of Potosi, in Wisconsin Territory.'" approved June 15, 1844, approved February 18th, 1845, the proportionate value of the ground hereby attached to the said lot number twenty-four, according to the valuation that has been made of the said lot number twenty-four, under the provisions of the above recited act, and upon making payment of such propor tionate value the said receiver shall execute receipts for the same in the manner provided in the case of the sale and entry of lots in said town, and such receipt shall entitle the purchasers to a patent for the land herein vacated and attached to the said lot number twenty-four, in the same manner as other lots entered and sold in said town.

AN ACT to authorize Abraham Brawley to build a dam and boom across the Wisconsin River." EE IT ENACTED by the Council and House of Representatives of the Territory of Wisconsin:

SECTION 1. That Abraham Brawley, his associates, successors or assigns, is hereby authorized and empowered to build and maintain a dam and boom on the Wisconsin river between sec

tions thirty-one and thirty-two, in town twenty-four north, in range eight, east of the fourth principal meridian, in Portage county, Wisconsin Territory, and to make use of the water for mills, machinery and other hydraulic power, they may think proper.

SEC. 2. Said dam shall not exceed six feet in height above low water, and in some suitable place in said dam there shall be a good and sufficient slide not less than twenty-four feet wide, and not less than six feet long for every one foot said dam is high, to admit of the safe passage of all rafts, boats and other wa ter crafts descending said liver.

SEC. 3. In said boom there shall be a space of at least forty feet to open to admit all rafts and boats to pass and shall be open at all times when there is rafts or boats to pass, free of any expense.

SEC. 4. This act shall be subject to all the provisions of the act approved January 13th, 1840, concerning mills and mill dams.

SEC. 5. That all dams now erected, or hereafter to be erect ed across the Wisconsin river, shall be subject to the provisions of the second section of this act.

SEC. 6. This act may be altered, amended or repealed by any future legislature of this Territory or of the State of Wisconsin; APPROVED February 3rd, 1846.

AN ACT to incorporate Carroll College.

BE IT ENACTED by the Council and House of Representatives of the Territory of Wisconsin:.

SECTION 1. That the name of Prairieville Academy is hereby changed, and shall hereafter be known by the name of Carroll College.

SEC. 2. That the trustees of said college and their succes Bors shall forever hereafter have power and authority to direct and

prescrible [prescribe] the course of study and the discipline in Power of trussaid college; also to select and appoint by ballot or otherwise, a President and such Professors and Tutors to assist the President in the government and education of the students belonging to such college, and such other officers as the said Trustees shall deem proper, all of whom shall hold their offices during the pleasure of the Trustees.

SEC. 3. That the said Trustees and their successors shall, have power and authority to grant such literary honors and degrees as are usually granted by universities, colleges or seminaries of learning in the United States, and in testimony of such grants to give suitable diplomas under their seal, which diplomas shall entitle the possessors respectively to the immunities and privileges, which by usage or statute are allowed to the possessors of similar diplomas, granted by universities, colleges and seminaries of learning.

SEC. 4. That the trustees and their successors shall have pow Ib. er and authority to make such rules and by-laws which may be deemed necessary for carrying into effect the designs of said college: Provided such rules and by-laws are not inconsistent with the laws of the United States or of this Territory.

SEC. 5. That said corporation may at any time hold real estate not exceeding in value fifty thousand dollars.

SEC. 6. That the stockholders of said incorporation shall have power to elect any number of trustees not less than three nor more than nine.

SEC. 7. That all gifts and grants to said trustees shall be held by them for the exclusive benefit of said college, and for no othwhatever.

SEC. 8. This act may at any time be altered or amended by the Legislature.

AN ACT to amend an act entitled "an act to au thorize the construction of certain dams across the Rock River," approved April 1st, 1843.

BE IT ENACTED by the Council and House of Representatives of the Territory of Wisconsin:

SECTION 1. That section two, of an act entitled" an act to an thorize the construction of certain dams across the Rock River," be and the same is hereby repealed; and that the second section of this act be and the same hereby is substituted in the place and stead thereof.

SEC. 2. Such dam shall be raised to such a height as will give a fall of not more than four feet at an ordinary stage of said Rock River; and the proprietors of said dam shall construct a conve nient lock in their canal, not less than one hundred and twenty feet long between the gates, and not less than twenty-four feet wide in the clear of the chambers, for the passage of boats, barges and other water craft. Said lock to be in readiness for the pas sage of boats, barges and water craft, at the time, or as soon as said Rock River shall be improved and rendered navigable from the southerly line of this Territory to the village of Janesville. and the proprietors of said dam shall maintain said lock and shall attend to the passage of all such boats, barges and water craft through said lock, free of all charges to the owner thereof.

SEC 3. That the proviso contained in section five, of the afore said act, be and the same is hereby repealed. Tho legislature may at any time alter, amend or repeal this act.
