Which was read and adopted, and the following committee appointed on the part of the House, viz: Messrs. Forman, Taylor of Mosquito, Betton, Patterson, and Turner.

A bill to be entitled "An act to admit George W. Call, Junior, to practice law in the several Courts of this Territory," was read a third time, and passed. Ordered that the title be as stated. The House adjourned until to-morrow.

THURSDAY, February 23, 1843. The House met pursuant to adjournment, and there being a quorum present, the Journal of yesterday's proceedings was read.

Mr. Dummett moved that, in consequence of his absence from the House on yesterday when the vote was taken on the resolution to divide the Territory of Florida, the rule be waived and that he be allowed to record his vote among the yeas. Which motion was lost.

Mr. Tabor moved that the rule be waived and he be allowed to record his vote on the resolution to divide the Territory of Florida among the Nays. Which motion was lost.

Mr. Floyd moved that the rule be waived and he be allowed to record his vote upon the passage of a bill entitled "An act concerning Executions," in the negative, inasmuch as the said act was passed during his temporary absence.

The Speaker decided the motion out of order.

Mr. Floyd appealed from the decision of the Chair.
The House unanimously sustained the decision.

Mr. Irwin moved that the communication from the Surveyor General be taken from the table and referred to a select committee of three members from the West. Which motion prevailed and Messrs. Irwin, Turner and Amos were appointed that committee.

A bill to be entitled "An act to alter and change the name of Amanda S. Mandal was, according to previous notice, introduced by Mr. Bush. Which was read the first time, the rule waived, read a second and third time by the title, and passed. Ordered that the title be as stated.

Mr. McRaeny, according to previous notice, obtained leave to introduce a bill to be entitled "An act for the relief of Overseers." Which was read the first time and referred to the Judiciary Committee.

Mr. Floyd moved that a bill entitled "An act to prevent masters of ships and vessels and other persons from throwing ballast in the Bay of Apalachicola," be taken from the table and placed among the orders of the day. Which motion prevailed.

Mr. Betton moved that a bill entitled "An act to amend the charter of the city of Port Leon" be taken from the table and placed among the orders of the day. Which was granted.

Mr. McRaeny moved that a petition of sundry citizens of St. Marks be taken from the table and placed among the orders of the day.

Mr. Child, from a select committee, made the following

REPORT:

The select committee, to whom was referred the petition of John G. Swann and others praying the establishment of a ferry across the Withlacoochee river, at Fort Izard, beg leave to report the accompanying bill. J. CHILD, Chairman.

A bill entitled "An act to authorize John G. Swann to establish a Ferry across the Withlacoochee river, at Fort Izard," was read the first time, the rule waived, read the second and third time by the title, and passed. Ordered that the title be as stated.

Mr. De la Rua, from a select committee, made the following

REPORT:

The select committee, to whom was referred the petition of sundry citizens of Escambia County, praying that a charter be granted to Dr. George Terrill, authorizing him to construct a canal or railroad from the Grand Lagoon to one of the arms of the Perdido Bay, beg leave to report—

That in the discharge of that duty, with careful, attentive, and full deliberation, they have arrived at the opinion that the view embraced in the petition, if carried into effect, will be highly advantageous to the people of Escambia, and the inhabitants of Perdido Bay; and deeming, therefore, that the prayer of the petitioners is reasonable and just, they ask to submit a bill in conformity therewith, and beg to be discharged from its further consideration.

Which report was concurred in, and the bill reported, entitled "An act to authorize the construction of a Canal or Railroad from the Grand Lagoon in Escambia County to Perdido Bay," was read the first time, and ordered for to-morrow.

ORDERS OF THE DAY.

A chapter entitled "Poor Persons," was taken up, and laid on the table.

Mr. Smith moved that the rule be waived, and a reconsideration had on the concurrence of the House in the amendments of the Senate to a resolution of the House requiring the Secretary of the Territory to have one hundred copies of the laws of Congress relative to Florida, printed.

Which motion prevailed, and the amendment of the Senate was concurred in, and amended by striking out one hundred, and inserting "five hundred," which was ordered to be certified to the Senate.

A bill to be entitled "An act in relation to Judgments and Executions, and the valuation of property subject to the same," was read a second time.

Mr. Floyd moved the indefinite postponement of the bill, and the yeas and nays being called on said motion, were as follows:

Yeas-Messrs. Arnou, Child, De la Rua, Dummett, Floyd, Haddock, Patterson, Smith, Stewart, Summerlin, Taylor of Jefferson-11.

Nays-Mr. Speaker, Messrs. Betton, Bush, Cromartie, Forman, Irwin, Knowles, M'Raeny, Pent, Selph, Tabor, Taylor of Mosquito, Turner, and Zeigler-14.

On the question of engrossing said bill for a third reading to-morrow, the yeas and nays were called by Messrs. Smith and Knowles,' and were as follows:

His Excellency the Governor transmitted to the House the following communication:

Gentlemen of the Senate, and House of Representatives :

I have approved the following acts, chapters and resolutions, passed by the Legislative Council during the present session :

A resolution requesting our Delegate in Congress to endeavor to obtain a re-appropriation of the sum of ten thousand dollars, (heretofore appropriated and not expended,) to improve the navigation of the Ocklawaha river.

An act to authorize James Bryan to establish a Ferry across the Suwannee river, at a place known as the Indian Ford.

An act to amend an act entitled "An act to authorize Bryan Sheffield to establish a Ferry across the Suwannee river, at the upper Mineral Springs, known as the White Sulpher Springs." Approved 4th March, 1842.

A preamble and resolutions respecting the connection of the waters of the Gulf of Mexico and the Atlantic, by a rail-road or canal.

An act more particularly to define the eastern boundary of Jefferson county.

A chapter entitled "Schools."

A preamble and resolutions requesting our Delegate in Congress to endeavor to have a Post-Office established at Enterprize, the county-site of Mosquito county."

A preamble and resolutions requesting the Delegate in Congress to endeavor to procure a re-appropriation of fifteen thousand dollars, (heretofore appropriated and not expended,) to remove obstacles in the navigation of the Suwannee river.

An act to authorize William Rawlinson to establish a Ferry across the North prong of the St. Mary's river. A chapter entitled" County Clerk."

Which was read.

A bill entitled "An act to amend an act entitled an act to incorporate the town of Quincy," was read the third time, and passed. Ordered that the title be as stated.

A chapter entitled "Banking," was read a third time.

Mr. Floyd moved that the bill be indefinitely postponed; and the yeas and nays being called on said motion, were as follows:

FRIDAY, February 24, 1843.

The House met pursuant to adjournment, and there being a quorum present, the Journal of yesterday's proceedings was read. Mr. Taylor asked to have spread on the Journals that his colleague, Mr. Scott, was absent from the House on account of indisposition. Which was granted.

Mr. Bush gave notice that he would, on some future day, ask leave to introduce a bill to be entitled "An act in relation to Judgments."

Mr. Floyd gave notice that he would, on some future day, ask leave to introduce a bill to be entitled "An act to appoint Trustees to wind up the affairs of the Union Bank of Florida, and to secure the people from losses."

Mr. Betton, pursuant to previous notice, obtained leave to introduce a bill to be entitled "An act to establish the Exchange Bank of Tallahassee."

Which was read the first time.

Mr. Arnou moved the indefinite postponement of said bill; and the yeas and nays being called on said motion, were as follows: Yeas-Messrs. Arnou, De la Rua, Dummett, Haddock, Smith, Summerlin, Taylor of Jefferson-7.

Nays-Mr. Speaker, Messrs. Amos, Betton, Bush, Child, Cromartie, Floyd, Forman, Irwin, Knowles, M'Raeny, Patterson, Pent, Selph, Stewart, Tabor, Taylor of Mosquito, Turner, and Zeigler-19.

So the House refused to postpone said bill indefinitely, and the bill was referred to the Committee on Corporations.

Mr. Irwin moves that the names of the mulattoes which appear on the petition from Jackson county, praying the division of said county, be expunged from said petition.

Mr. Bush moved an amendment to the original motion, by insert

ing the following: "And that the member making the motion be requested to strike said names from said petition."

Which was concurred in.

On the question of placing Mr. Bush on the committee to act with Mr. Irwin, the yeas and nays were called by Messrs. Irwin and Smith, and were as follows:

Yeas-Messrs. Dummett, Haddock, Irwin, M'Raeny, Selph, Smith, Taylor of Jefferson-7.

Nays Mr. Speaker, Messrs. Amos, Arnou, Betton, Bush, Child, Cromartie, De la Rua, Floyd, Forman, Knowles, Patterson, Pent, Stewart, Summerlin, Tabor, Taylor of Mosquito, Turner, and Zeigler-19.

So the House refused the amendment.

Which was read. The nominations of the Governor for Hamilton and Franklin counties were advised and consented to. The nominations for Jackson county were ordered to be returned to his Excellency, in consequence of there being a mistake in the name of the county.
