said company will surrender to the Territory the privileges conferred upon them by the act of their incorporation.

The resolution was adopted.

On motion of Mr. Wells,

The House adjourned.

FRIDAY, December 27, 1839.

Mr. Sholos presented a communication from the Secretary of the Territory, with accompanying documents.

On motion of Mr. Sholes,

Ordered, That so much of the communication and documents as relates to the publication of the Revised Statutes, be referred to the joint committee appointed to settle the accounts of the agent to procure and superintend the publication of the said Statutes, and the remaining part of the communication to the committee on claims.

Mr. Beardsley presented the petition of inhabitants of the town. of Troy, in Walworth county, praying for a change in county government.

Referred to the following select committee, viz:

Messrs. Beardsley, Wells and Childs.

Mr. Childs presented a remonstrance of citizens of Brown county against the removal of the seat of justice of said county. Referred to the committee to which a petition on the same subject was referred.

Mr. Bracken presented the accounts of James L. Thayer and L. H. Cotton, for services and expenses incurred as commission. ers of public buildings.

Referred to the committee on claims.

Mr. Childs, from the committee on engrossed bills, reported the following to be correctly engrossed, viz:

No. 10, "Resolution relating to the appointment of Samuel B. Knapp, fiscal agent."

No. 17, "A bill to authorize William H. Bruce, and others, to build and maintain a dam on the Manitouwoc river."

No. 19, "A bill to prevent trespass and other injuries being done to the possessions of settlers on public lands, and to define the right of possession on said lands."

The House then proceeded to the orders of the day, being bills and resolutions on their passage.

On motion of Mr. Sholes,

Bill No. 2, entitled, "A bill to organize the counties of Calumet and Winnebago," was amended by unanimous consent, and was then read the third time, passed, and the title amended to read "A bill to organize the county of Calumet."

The undermentioned bills and resolution were then severally read the third time, passed and titles agreed to, viz :

No. 12, (Council file,) "A bill to provide for the construction. of a bridge across the Milwaukee river."

No. 16, (Council file,) "A bill to prevent the sale of intoxicating liquors to Indians."

No. 17, (H. R. file,) "A bill to authorize William H. Bruce, and others, to build and maintain a dam on the ManitouwoC river."

No. 19, (H. R. file,) "A bill to prevent trespass and other injuries being done to the possessions of settlers on public lands, and to define the right of possession on said lands."

Ordered, That the Council be requested to concur in said bills, and the amendments to bills Nos. 2 and 16, Council file.

Message from the Council by their Secretary:

"Mr. Speaker-The Council have passed bills and resolutions. as follows, in which they request the concurrence of the House of Representatives, viz :

"No. 11, A bill to incorporate the Michigan and Rock river rail-road company."

"No. 19, A bill to amend an act entitled, "An act relating to the militia."

"No. 20, A bill to exonerate the several counties in the Territory from the payment of certain taxes."

"No. 22, A bill to amend an act concerning the lien of me. chanics, and others, for repairs and improvements on real es tate.'

"No. 3, Resolution relative to adjournment of the Legisla ture; and,

"No. 4, Resolution to locate the university lands." "

And then he withdrew.

On motion of Mr. Wells,

Bill No. 3 was committed to the committee of the whole.

On motion of Mr. Wells,

The House then resolved itself into the committee of the whole, Mr. Shackelford in the chair, having under consideration the fol. lowing bills and resolution, viz:

No. 3, "Substitute for a bill relating to the duties of registers of deeds."

No. 20, "A bill to provide for the location and sale of the university lands."

No. 24, "A bill to provide for the support of common schools, and for other purposes;" and,

No. 9, "A resolution relating to the fiscal agency of Moses M. Strong."

After some time the committee rose and reported the said seve ral bills and resolution with amendments.

The amendments made to bill No. 3 were agreed to, and the said bill ordered to be engrossed for a third reading.

On motion of Mr. Sholes,

The House adjourned until 3 o'clock P. M.

AFTERNOON SESSION.

Three o'clock.

The House resumed the consideration of resolution No. 9, and bills Nos. 20 and 24, when

Mr. Bracken moved a call of the House, which was ordered.

A call of the House was then made, and the serjeant-at-arms sent after absent members.

Mr. Shackelford, from the committee on enrolment, reported the following to be correctly enrolled, which was signed by the Speaker, viz:

"A memorial to Congress relative to confirming the titles to lots one, two and three, of section thirty-two, town seven, range twenty-two east."

The serjeant-at-arms having reported the absent members in attendance, bill No. 20 was taken up, and the report of the committee agreed to.

Mr. Conroe moved that the said bill be laid on the table, and the ayes and noes being called, it was decided in the affirmative; ayes 14, noes 11.

Those who voted in the affirmative were, Messrs. Baldwin, Beardsley, Billings, Brunson, Conroe, Cruson, Dewey, McGregor, Shackelford, Shew, Sholes, Street, Sutherland and Whiton, speaker.

Those who voted in the negative were, Messrs. Blackstone, Bracken, Childs, Craig, Hoyt, Jenkins, Longstreet, Newman, Stevens, Story and Wells.

The House agreed to the amendments of the committee to resolution No. 9, and the said resolution was ordered to be engross. ed and read a third time.

The amendments to bill No. 24 were agreed to.

Mr. Bracken moved to amend the bill by inserting after the word "taxes," in the 7th line of the 4th section, the words ". vided the taxes so levied shall not exceed five per cent." The ayes and noes being called on the question to agree to the amendment, there were ayes 13, noes 12.

Those voting in the affirmative were, Messrs. Baldwin, Billings, Blackstone, Bracken, Craig, Cruson, Dewey, McGregor, Shackelford, Shew, Story, Sutherland and Wells.

Those voting in the negative were, Messrs. Beardsley, Brunson, Childs, Conroe, Hoyt, Jenkins, Longstreet, Newman, Sholes, Stevens, Street and Whiton, speaker.

So the amendment was agreed to.

Ordered, That the said bill be engrossed and read a third

time.

Mr. Childs gave notice that on some future day, he should ask leave to introduce a bill to authorize Hamilton Stevens to build and maintain a dam across the outlet of Fox Lake, in Dodge county; and, also, a bill to lay out and establish a Territorial road from Fort Howard, on the west side of Fox river, to Knaggs' fer. ry, at Butte des Mort, in Brown county.

Mr. Baldwin gave notice that on to-morrow, or some future day, he would ask leave to introduce a bill to incorporate the stockholders of the Bank of Sinipee.

The House then took up the special order of the day, being bill No. 4, (Council file,) entitled "A bill to change the time of hold. ing the district court in and for the county of Racine, and for other purposes."

Mr. Billings moved that the bill be committed to the committee of the whole House now.

And pending the question thereon,

On motion of Mr. Dewey,

The House adjourned.

SATURDAY, December 28, 1839.

Mr. Longstreet, from the joint committee on enrolment, reported that the said committee did on the 27th inst., submit to the Governor for his approval, "A memorial of the Legislative Assembly, in behalf of the settlers on the even numbered sections reserved to the United States by the law granting a quantity of lands to aid in the construction of the Milwaukee and Rock river canal."

Mr. Shew, from the select committee to which the subject was referred, made the following report:
