up, post up notices in three of the most public places in his town. ship, and offer for sale to the highest bidder such stray; and if such stray shall sell for a price above the cost and charges, the overplus shall be paid into the county treasury, subject to be drawn therefrom by any person proving satisfactorily to the coun ty treasurer that the stray so sold was his property but if such overplus shall not be so drawn, it shall be appropriated to the use of common schools."

The amendment was disagreed to.

Mr. Story then moved to lay the bill on the table, which was also disagreed to.

The report of the committee was then agreed to, and the said bill was ordered to be engrossed for the third reading.

The report of the committee on bill No. 28 was agreed to, and the bill ordered to be engrossed for the third reading.

On motion of Mr. Sholes,

Resolved, That after Tuesday next no new business shall be received to be acted upon by this House, except accounts, reports of committees upon subjects which may previously to that time, be referred to them, and the appropriation bill.

On motion of Mr. Sutherland,

The House adjourned until 2 o'clock P. M.

AFTERNOON SESSION.

Two o'clock.

Mr. Beardsley, agreeably to previous notice for leave, introduced a bill, No. 48, entitled,

"A bill relating to the duties of register of deeds of the county of Rock."

Which was read the first and second time.

On motion of Mr. Sholes,

The House resolved itself into the committee of the whole, Mr. Blackstone in the chair, having under consideration the following, viz:

No. 30, (Council file,) "A bill to provide for taking the census or enumeration of inhabitants of this Territory, and to fix the time of holding an extra session of the Legislative Assembly."

No. 34, (Council file,) "A bill for the relief of the county off. cers of Crawford county."

No. 48, (II. R. file,) "A bill relating to the duties of the register of deeds of the county of Rock;" and,

No. 11, (II. R. file,) "Joint resolution calling upon the Sc cretary of the Territory for certain information."

After some time the committee rose and, by their chairman, reported to the House the said resolution No. 11, and bill No. 43 without, and bills Nos. 30 and 31 with amendments.

The question was taken on ordering resolution No. 11 to be en. grossed and read a third time; and the ayes and noes being call ed, were as follows:

Ayes--Messrs. Beardsley, Blackstone, Billings, Bracken, Brunson, Childs, Conroe, Craig, Cruson, Dewey, Hoyt, Longstreet, McGregor, Newman, Ray, Shew, Sholes, Stevens, Story, Street, Sutherland, Wells and Whiton, speaker--23.

Noes--Messrs. Baldwin, Jenkins and Shackelford--3.

So the said resolution was ordered to be engrossed and read a third time.

The House concurred in the amendments of the committee to bill No. 34.

Mr. McGregor moved to strike out the first and second sections of said bill, and the ayes and nays being called, on said motion, were as follows:

Ayes--Messrs. McGregor, Newman and Shackelford--3.

Noes-Messrs. Baldwin, Beardsley, Billings, Blackstone, Bracken, Brunson, Childs, Conroe, Craig, Cruson, Dewey, Hoyt, Jenkins, Longstreet, Ray, Shew, Sholes, Story, Street, Suther. land, Wells and Whiton, speaker--22.

So the motion was lost.

The said bill was then ordered to the third reading.

Mr. Shew moved to amend the amendment made by the com. mittee of the whole to bill No. 30, by striking out the words

"Mineral Point," and inserting in lieu thereof the words "Mil. waukee," which amendment provided for holding a special ses sion of the Legislature at Mineral Point.

On motion of Mr. McGregor,

The question was divided, and the ayes and noes being called on the question to strike out Mineral Point, there were ayes 12, nocs 14.

Those voting in the affirmative were, Messrs. Beardsley, Childs, Conroe, Dewey, Ray, Shackelford, Shew, Sholes, Story, Suther land, Wells and Whiton, speaker.

Those voting in the negative were, Messrs. Baldwin, Billings, Blackstone, Bracken, Brunson, Craig, Ciuson, Hoyt, Jenkins, Longstreet, McGregor, Newman, Stevens and Street.

So the House refused to strike out, for the purpose of inserting Milwaukee.

Mr. Sholes moved to strike out "Mineral Point," and insert "Green Bay," in lieu thereof.

A division of the question being called for, the question was taken on striking out, and the ayes and nocs being called, there were ayes 13, noes 13.

Those voting in the affirmative were, Messrs. Beardsley, Brunson, Childs, Conroe, Dewey, Longstreet, McGregor, Shackelford, Sholes, Story, Sutherland, Wells and Whiton, speaker.

Those voting in the negative were, Messrs. Baldwin, Billings, Blackstone, Bracken, Craig, Cruson, Hoyt, Jenkins, Newman, Ray, Shew, Stevens and Street.

So the House refused to strike out for the purpose of inserting Green Bay.

Mr. Shew moved to strike out the words "Mineral Point," and insert in lieu thereof, the word "Madison."

A division of the question being called for, the question was taken on striking out, and the ayes and noes being called, were as follows:

Ayes--Messrs. Beardsley, Brunson, Childs, Conroe, Dewey, Longstreet, McGregor, Ray, Shackelford, Shew, Sholes, Stevens, Sutherland, Wells and Whiten, speaker-15.

Noes--Messrs. Baldwin, Billings, Blackstone, Bracken, Craig, Cruson, Hoyt, Jenkins, Newman, Story, and Street--11.

So the House amended the amendment made by the committee of the whole, by striking out" Mineral Point."

The question then recurred on inserting "Madison," and the ayes and nocs being called, on the said question, were as follows:

So the House refused to insert Madison.

A motion was then made by Mr. Wells to insert "Milwaukee," and the ayes and noes being called, were as follows:

Ayes-Messrs. Beardsley, Conroe, Hoyt, Longstreet, Newman, Ray, Shackelford, Shew, Stevens, Story, Street and Wells

So the House refused to insert Milwaukee.

Mr. Dewey then called for the previous question, which was put in these words, "Shall the main question be now put?"

And the ayes and noes being called, were as follows:

Ayes-Messrs. Baldwin, Beardsley, Dewey, Ray, Shackelford, Shew, Sutherland, Wells and Whiton, speaker-9.

Nocs-Messrs. Billings, Blackstone, Bracken, Childs, Conroe, Craig, Cruson, Hoyt, Jenkins, Longstreet, McGregor, Newman, Sholes, Stevens, Story and Street--17.

So the main question was not ordered.

Mr. Childs moved to insert "Green Bay."

Pending the question thereon, a motion was made by Mr. Billings, that the bill do now lie on the table, and the ayes and noes were called and were as follows:

Ayes-Messrs. Billings, Blackstone and McGregor-3.

Noes-Messrs. Baldwin, Beardsley, Bracken, Brunson, Childs, Conroe, Craig, Cruson, Dewey, Hoyt, Jenkins, Longstreet, Newman, Ray, Shackelford, Shew, Sholes, Stevens, Story, Street, Sutherland, Wells and Whiton, speaker--23.

The question then recurred on inserting "Green Bay," and the ayes and noes were as follows:

Ayes--Messrs. Beardsley, Brunson, Childs, Conroe, McGregor, Shackelford, Sholes, Story and Street--9.

So the House refused to insert Green Bay.

Message from the Council by their secretary:

"Mr. Speaker-The Council have passed No. 40, A bill for the relief of Joseph R. Brown,' in which I am requested to ask the concurrence of this House.

"They have also concurred in No. 15, (of the House,) ‹ A bill to amend an act of the Revised Statutes of 1839, entitled, An act concerning the supreme and district courts,' with amendments, in which amendments the concurrence of this House is also requested. And have adopted the report of the committee of conference on the disagreeing vote of both Houses, on bill No. 16, A bill to prevent the sale of intoxicating liquors to Indians." "

And then he withdrew.

Mr. Sutherland called for the previous question, which was or dered.

The main question was then put in these words, "Will the House agree to the report of the committee as amended?"

And the ayes and noes being called, were as follows: Ayes-Messrs. Baldwin, Beardsley, Blackstone, Brunson, Hoyt, Longstreet, Newman, Ray, Shackelford, Shew, Sholes, Stevens, Street, Sutherland, Wells and Whiton, speaker-16.

So the House agreed to the report of the committee.
