Mr. Bracken moved the following amendment to the bill:
Add to section 2 the words, "at Mineral Point."

Pending the question thereon, Mr. Sholes called for the previ ous question, and the ayes and noes were taken and were as fol. lows:

Ayes-Messrs. Baldwin, Beardsley, Dewey, Hoyt, Longstreet, Newman, Ray, Shackelford, Shew, Sholes, Sutherland, Wells and Whiton, speaker-13.

Noes--Messrs. Billings, Blackstone, Bracken, Brunson, Childs, Conroe, Craig, Cruson, Jenkins, McGregor, Stevens, Story and Street-13.

So the main question was not ordered.

Mr. Sholes then moved that the bill be laid on the table, and the ayes and noes were taken and were as follows:

Ayes--Messrs. Beardsley, Conroe, Dewey, Hoyt, Longstreet, Ray and Sholes--7.

Noes--Messrs. Baldwin, Billings, Blackstone, Bracken, Brun. son, Childs, Craig, Cruson, Jenkins, McGregor, Newman, Shackel. ford, Shew, Stevens, Story, Street, Sutherland, Wells and Whiton, speaker-19.

So the House refused to lay the bill on the table.

Mr. Sutherland then moved the House adjourn until 7 o'clock P. M.

And the ayes and noes were taken and were as follows: Ayes--Messrs. Childs, Dewey, Story, Sutherland and Whiton, speaker--5.

Noes--Messrs. Baldwin, Beardsley, Billings, Blackstone, Bracken, Brunson, Conroe, Craig, Cruson, Hoyt, Jenkins, Longstreet, McGregor, Newman, Ray, Shackelford, Shew, Sholes, Stevens, Street and Wells-21.

So the House refused to adjourn to 7 o'clock P. M.

Mr. Childs then moved that the House do now adjourn.
The motion was disagreed to.

Mr. Bracken moved to add to the second section of said bill, the words "Borough of Mineral Point."

The ayes and noes were called on said question, and were as follows:

Ayes--Messrs. Baldwin, Billings, Blackstone, Bracken, Brunson, Craig, Cruson, Hoyt, Jenkins, McGregor, Story and Street

--12.

Noes-Messrs. Beardsley, Childs, Conroe, Dewey, Longstreet, Newman, Ray, Shackelford, Shew, Sholes, Stevens, Sutherland, Wells and Whiton, speaker-14.

So the motion was lost.

Mr. Sholes moved to add to the second section the words 66 at Depere;" when

The previous question being called for, was then put, viz: "Shall the main question be now put?"

And the ayes and nocs being called for, there were ayes 15,

nocs 11.

Those voting in the affirmative were, Messrs. Baldwin, Beards. ley, Blackstone, Conroe, Dewey, Hoyt, Longstreet, Newman, Ray, Shackelford, Shew, Stevens, Sutherland, Wells and Whiton, speaker.

Those voting in the negative were, Messrs. Billings, Bracken, Brunson, Childs, Craig, Cruson, Jenkins, McGregor, Sholes, Story and Street.

So the main question was ordered to be put, and pending the

same,

The House adjourned.

TUESDAY, January 7, 1840.

Mr. Jenkins presented the account of Edward Campbell, for sundry articles furnished the Legislative Assembly.

Ordered, That the same be referred to the committee on claims.

Mr. Bracken, from the select committee to which the subject was referred, reported a memorial, which was read the first and second time, entitled as follows:

No. 5, "Memorial to Congress relative to duties on imported lead."

On motion of Mr. Cruson,

Ordered, That 500 copies of said memorial be printed for the use of this House.

(The above memorial is contained in the Appendix.)

Mr. Childs, from the committee on engrossed bills, reported the following to be correctly engrossed, viz:

No. 28, "A bill to amend an act of the Revised Statutes of the Territory of Wisconsin, entitled, An act concerning judgments and executions.'

No. 34, "A bill relating to strays.”

The Speaker laid before the House a communication from Moses M. Strong, Esq., in answer to a resolution of yesterday, call. ing on him to state on what appropriations he had disbursed the money received by him as fiscal agent.

Read and laid on the table.

The Speaker, also, laid before the House a statement from A. A. Bird, relating to the report of the joint committee on public buildings, which was read.

(See Appendix, document N.)

Mr. Wells moved that 250 copies of the same be printed for the use of this House.

The ayes and noes being called on said motion, there were ayes 13, noes 12.

Those who voted in the affirmative were, Messrs. Bracken, Brunson, Childs, McGregor, Newman, Ray, Shackelford, Shew, Sholes, Stevens, Story, Sutherland and Wells.

Those who voted in the negative were, Messrs. Baldwin, Beardsley, Billings, Blackstone, Conroe, Craig, Cruson, Dewey, Hoyt, Jenkins, Street and Whiton, speaker.

So the motion was agreed to.

. Mr. Wells offered the following resolution, which was adopt ed:

Resolved, That A. A. Bird, or either of the persons named in

the contracts, the copies of which are given in the statement of said Bird, made to this House this day, be permitted to attach their certificates, under oath, as to the truth of said statement, which shall be printed with said statement; that the original contracts be furnished this Ilouse, and that the statement, together with said contracts, be referred to a select committee, who are hereby instructed to report to this House to-morrow, as to the genuine. ness of the contracts, and to the allegations set forth in the state. ment; the said contracts to be returned to said Bird, after they shall have been reported upon.

Mr. Sholes asked to be excused from serving on said commit. tee, and moved that Mr. Wells be substitued.

The House refused to excuse Mr. Sholes.

Mr. Dewey moved that the whole committee be excused.
The motion was disagreed to.

Mr. Shackelford moved that the mover of the resolution (Mr. Wells) be added to the committee as chairman.

The motion was agreed to.

Mr. Conroe was added to said committee.

On motion of Mr. Wells,

Mr. Blackstone was added to said committee.

Mr. Strect moved that Mr. Billings be added to said commit.

The motion was disagreed to.

On motion of Mr. Dewey,

Mr. Shackelford was added to said committee.

Mr. Wells asked to be excused from serving on said commit.

The House refused to excuse him.

Mr. Story, from the select committee to which the subject was referred, made the following report:

The committee to whom was referred the account of H. N. Wells, the Attorney-General of the Territory, for professional ser

vices and expenses incurred in prosecuting suits of the Territory

vs. the Bank of Wisconsin, have examined said account and deem

it

proper that it should be allowed.

The said report was then referred to the eommittee on ex

penses.

The following message was received from the Council by their secretary:

"Mr. Speaker--The Council have concurred in bill No. 5, of this House, entitled, Bill to organize the county of St. Croix,' with amendments, in which the concurrence of this House is re. quested.

Have insisted on their amendment to bill No. 4, of this House, entitled, A bill to establish certain ferries therein named,' and have negatived, by striking out the enacting clause, bill No. 31, of this House, entitled, A bill to incorporate the rector, wardens and vestrymen of Trinity Church, at Mineral Point.""

And then he withdrew.

The House then proceeded to the orders of the day.
