Mr. Dewey moved a reconsideration of the vote taken on yes. terday by which the minority report, relating to the contracts and statement of A. A. Bird, was ordered to be printed; and,

The ayes and noes being called for, were as follows:

Ayes-Messrs. Beardsley, Billings, Blackstone, Bracken, Brunson, Childs, Craig, Cruson, Dewey, Hoyt, Jenkins, Longstreet, McGregor, Newman, Ray, Shackelford, Shew, Stevens, Story, Street, Sutherland and Whiton, speaker-22.

Noes-Messrs. Baldwin, Sholes and Wells--3.

On motion of Mr. Childs,

Ordered, That the minority of the said committee have leave to withdraw its report and that the committee be discharged.

The House then took up and considered the message from the Council returning bill No. 25 with an amendment, entitled, "A bill to amend an act to provide for aiding in the construction of the Milwaukee and Rock river canal," and refused to concur in the said amendment.

Ordered, That the Council be acquainted therewith.

On motion of Mr. Sutherland,

The House adjourned until 2 o'clock P. M.

AFTERNOON SESSION.

Two o'clock.

On motion of Mr. Dewey,

The undermentioned bills and resolutions from the Council were read the first and second time, viz:

No. 23, "A bill to organize the towns of Wau-wau-to-sa and Aztalan."

No. 28, "A bill to quiet the title to lands sold for taxes." No. 35, "A bill to amend an act entitled, An act to amend an act to incorporate the Portage canal company.""

No. 42, "A bill to provide for laying out and establishing Territorial roads therein named."

No. 7, "Resolutions relative to the southern boundary, and the admission of Wisconsion into the Union as a State."

On motion of Mr. Dewey,

Bills from the Council of the following titles, to wit:

No. 38, "A bill in relation to hawkers and pedlers ;"

No. 41, "A bill to provide for laying out and opening Territo rial roads, and for other purposes;"

No. 42, "A bill to provide for laying out and establishing Ter ritorial roads therein named ;"

And bills of this House as follows:

No. 43, "A bill to provide for laying out and establishing certain Territorial roads therein named;"

No. 44, "A bill to provide for establishing the seat of justice of Racine county;"

No. 47, "A bill to amend an act entitled, 'An act to provide for assessing and collecting county revenue;'

Were committed to the committee of the whole.

The House then resolved itself into the committee of the whole, on said bills, Mr. Dewey in the chair.

After some time the committee rose, and reported bills Nos. 38, 42 and 47 with amendments, and Nos. 41, 43 and 44 without amendment.

On motion of Mr. Dewey,

Bill No. 43 was indefinitely postponed.

On motion of Mr. Stevens,

Bill No. 44 was ordered to lie on the table until the first Mon. day of August next.

On motion of Mr. Sutherland,

The report of the committee on bill No. 42 was amended by striking out, in section 27, all after the word "to," in the sixth

line, to the close of the section, and insert "Janesville, in Rock county."

The report of the committee was then agreed to, and the said bill, and bill No. 41, were severally ordered to a third reading. On motion of Mr. Shew,

Bill No. 38 was indefinitely postponed.

The report of the committee was agreed to on bill No. 47, and the bill ordered to be engrossed for a third reading.

Mr. Street, from the committee to which a petition of the inhabitants of the town of Mentor was referred, by leave, reported bill No. 50, entitled,

"A bill to change the name of the town of Mentor, in the coun ty of Milwaukee.”

Which was read the first and second time.

Mr. Shackelford, from the committee on Territorial affairs, to whom was referred a resolution of this House on the subject of the United States road frome Racine to Sinipee, by leave, report. ed resolution No. 15, entitled,

"Joint resolution relating to United States road leading from Racine to Sinipee."

Which was read the first and second time.

On motion of Mr. Sholes,

The House resolved itself into committee of the whole, Mr. Show in the chair, having under consideration the following bills and resolution, viz:

No. 14, (H. R. file,) "Joint resolution relating to the printing of the laws passed at the present session of the Legislative As. sembly."

No. 38, (H. R. file,) "A bill in relation to mills and mill dams."

No. 46, (H. R. file,) "A bill to change the time of holding courts in the second judicial district."

No. 39, (Council file,) "A bill to provide for holding the dis. trict court within the county of Brown, and for other purposes.'

After some time the committee rose and, by their chairman,

reported the said resolution and bills Nos. 38 and 39 to the House with, and bill No. 46 without, amendments.

The House concurred in the amendments of the committee to bill No. 38.

Mr. Wells moved to amend said bill by adding two new sections, as follows:

SEC. 41. This act shall not in any way or manner affect any suit or suits now pending either in law or chancery, nor shall it affect any causes of action, rights or remedies, which may have accrued before the passage of this act.

SEC. 42. This act shall take effect from and after the first day of May, A. D. 1840.

The amendment was adopted.

On motion of Mr. Sholes,

The rule was suspended which requires bills to be engrossed before their third reading, and the same bill was ordered to be read a third time by its title now.

The said bill was then read a third time, and on the question, "Shall this bill pass ?" the ayes and noes were called, and were as follows:

Ayes-Messrs. Beardsley, Blackstone, Bracken, Brunson, Childs, Craig, Cruson, Hoyt, Jenkins, Longstreet, Ray, Show, Sholes, Stevens, Story, Wells and Whiton, speaker-17.

Noes-Messrs. Conroe, Dewey, McGregor, Newman, Shack. ford and Street-6.

So the said bill was passed and the title was then agreed to. Ordered, That the concurrence of the Council be requested in said bill.

Bill No. 46 was then ordered to be engrossed and read a third time.

Mr. Childs offered the following amendment to bill No. 30, which was adopted:

Strike out the amendment of the committee of the whole, and insert,

"Provided, That the board of the county commissioners shall not allow to be paid out of the county treasury an amount

to exceed the sum of fifteen dollars in any one year, to defray the additional expense of holding the said district court at the town of Green Bay."

The report of the committee was then agreed to, and said bill was ordered to its third reading.

On motion of Mr. Jenkins,

The question was taken separately on agreeing to the amend ments of the committee to resolution No. 14, and the question being on agreeing to the first amendinent, the ayes and noes were taken, and were as follows :

Ayes--Messrs. Baldwin, Beardsley, Blackstone, Bracken, Brunson, Childs, Conroe, Craig, Cruson, Dewey, Hoyt, Longstreet, McGregor, Newman, Ray, Shew, Sholes, Stevens, Story, Street, Sutherland and Whiton, speaker--22.

Noes--Messrs. Billings, Jenkins, Shackelford and Wells--4. So the first amendment was agreed to.

The second amendment was then agreed to.

Mr. Billings moved to amend the said bill as follows:

Strike out the words "Harrison Reed, editor of the Milwaukee Sentinel," and insert in lieu thereof, "H. B. Welsh & H. Plowman, editors of the Miners' Free Press."

A division of the question being called for, the question was taken on striking out, and the ayes and noes being called, were as follows:

Ayes--Messrs. Baldwin, Billings, Conroe, Cruson, Dewey, Jenkins, Longstreet, Ray, Street and Whiton, speaker--10.

Noes--Messrs. Beardsley, Blackstone, Bracken, Brunson, Childs, Craig, Hoyt, McGregor, Newman, Shackelford, Shew, Sholes, Stevens, Story, Sutherland and Wells--16.

So the House refused to strike out for the purpose of inserting H. B. Welsh & H. Plowman, editors of the Miners' Free Press. Mr. Street offered the following amendment:

Strike out the words "Harrison Reed, editor of the Milwaukee Sentinel," and insert in lieu thereof the words, "Josiah A. Noonan, editor of the Madison Enquirer."
