Mr. Wells called for the previous question, which was then put in these words, "Shall the main question be now put ?"

And the ayes and noes being called for on said question, were as follows:

Ayes-Messrs. Beardsley, Blackstone, Bracken, Childs, Hoyt, McGregor, Newman, Shackelford, Shew, Sholes, Stevens, Sutherland and Wells-13.

Noes-Messrs. Baldwin, Billings, Brunson, Conroe, Craig, Cruson, Dewey, Jenkins, Longstreet, Ray, Story, Street and Whi. ton, speaker-13.

So the main question was not ordered.

The question then recurred on agreeing to the amendment of Mr. Street, when

Mr. Sutherland moved to amend the amendment offered by Mr. Street, by inserting the words, "W. W. Wyman, editor of the Madison Express."

The amendment to the amendment was not adopted.

The question then recurred on the amendment offered by Mr. Street, and the question being divided, the ayes and noes were called on striking out, and were as follows:

Ayes-Messrs. Baldwin, Billings, Brunson, Conroc, Craig, Cru son, Dewey, Jenkins, Longstreet, Ray, Street and Whiton, speaker-12.

Noes--Messrs. Beardsley, Blackstone, Bracken, Childs, Hoyt, McGregor, Newman, Shackelford, Shew, Sholes, Stevens, Story, Sutherland and Wells-14.

So the House refused to strike out for the purpose of inserting Josiah A. Noonon, editor of the Madison Enquirer.

Mr. McGregor called for the previous question.

Mr. Street moved to adjourn, and the ayes and noes being call ed on said motion, were as follows:

So the motion was disagreed to.

The main question was then ordered, and was put in these words, viz: "Shall the resolution be engrossed and read the third time?"

And was decided in the affirmative.

Mr. Bracken, from the committee appointed for the purpose, made the following report:

The committee on claims, to whom were referred the report of Col. William B. Slaughter, late fiscal agent of this Territory, beg leave to report:

That Col. Slaughter received of the Bank of Missouri, on the faith of the Territory, $20,000, less the interest for four months, at 7 per cent. per annum, making the sum actually received by

Of Moses M. Strong, fiscal agent, under a resolution

of the Legislature, the sum of

The committee have compared the vouchers of Col. Slaughter, with the appropriation act, approved the 3d of March, 1839, and find that, except $15 to John Wentworth, that the said appropriations, amounting to the sum of $3,511 61, have been paid.

The committee have also compared the vouchers of Col. Slaughter with the appropriations made under the act, approved the 11th of March, 1839, and find the same to have been all paid, except $10 to Edward McSherry, $5 to Gordon & McCall, $437 63.100 to J. C. Dinnis & Co., $12 to William Bidwell, and $830 50.100 to Moses M. Strong, Esq., late fiscal agent, for which sum Mr. Strong claims a credit in his account with the Territory. The sums paid under that appropriation amount to $20,822 96-100.

The committee further report, that in addition to the foregoing sums, Col. Slaughter paid the mileage and per diem allowance of the members for the last session of the Legislative Assembly,

amounting to the sum of $5,850 00. It will therefore appear, that Col. Slaughter has paid $7,555 77 more than he was responsible for as fiscal agent of the Territory.

Mr. Childs, from the committee on engrossed bills, reported the following to be correctly engrossed, viz:

No. 6, "Memorial to Congress to extend the jurisdiction of justices of the peace."

No. 39, "A bill to amend an act entitled, An act in addition to An act to establish the seat of government of the Territory of Wisconsin, and to provide for the erection of public buildings, approved December 3d, 1836, and for other purposes,' approved March 8th, 1839."

Mr. Story, from the committee on expenses, reported bill No. 51, entitled,

"A bill to provide for the compensation of the officers of the Legislative Assembly, and for other purposes."

Which was read the first and second time.

Mr. Beardsley presented the account of Edward Elderkin, for services as serjeant-at-arms pro tem.

Mr. Wells presented the account of Simeon Mills, for carrying the mail once each week extra, during the present session, between Madison and Milwaukee.

Mr. Ray presented the account of Peter W. Matts.

Ordered, That the said accounts be referred to the committee on claims.

Mr. Ray, from the committee on claims, reported that the com. mittee had allowed the account of James Morrison, and moved that the same be referred to the committee on expenses.

So referred.

And then the House adjourned.

On motion of Mr. Childs,

FRIDAY, January 10, 1840.

Ordered, That the reading of the Journal of yesterday be dis pensed with for the present.

Mr. Bracken presented the account of J. A. Noonan for printing.

Mr. Ray presented the account of J. A. Noonan, for papers furnished the members of the Legislative Assembly.

Referred to the committee on printing.

Mr. Ray, from the committee on claims, reported several accounts as allowed by the committee, which were referred to the committec on expenses.

Mr. Jenkins, from the committee on the militia, reported, No. 16, "Resolution relative to the expenses of the Adjutant-General's office."

Which was read the first and second time.

Mr. Bracken, from the committee to which the subject was referred, made the following report:

The committee on claims, to which was referred the account of A. A. Bird, report that they have adjudicated his account, and find that he has a claim as commissioner of public buildings for $2,225, allowing him five dollars per day for his services, in pursuance of a resolution passed at the last session of the Legisla

ture.

The committee know of no fund other than that donated by Congress, out of which Mr. Bird could be paid. They would, therefore, offer the following resolution, viz:

No. 17, "Resolution concerning the settlement of the accounts of the late acting commissioner."

The report of the committee was accepted, and the resolution was read the first and second time.

Mr. Sholes, from the committee on printing, reported that the committee had examined and allowed the account of Welsh & Plowman.

Which was then referred to the committee on expenses.

The Speaker laid before the House the report of the Territorial Librarian.

Which was read and referred to the committee on expenses. Mr. Longstreet introduced the following resolution, which was read the first and second time, viz :

No. 18, "Resolution relating to the election of canal commis. sioners."

On motion of Mr. Bracken,

The report of the committee on claims relating to the account of William B. Slaughter, inade to this House yesterday, was referred back to the said committee.

Mr. Dewey, from the committee on engrossed bills, reported the following to be correctly engrossed, viz:

No. 3, Memorial to Congress concerning pre-emption rights. to miners."

No. 14, "Joint resolution relating to the printing of the laws. passed at the present session of the Legislative Assembly."

No. 46, "A bill to change the time of holding courts in the second judicial district."

Mr. Shackelford, from the committee on enrolment, reported the following to be correctly enrolled, which were signed by the Speaker, viz:

"An act to establish the county of Sauk."

"An act to provide for taking the census or enumeration of the inhabitants of this Territory, and to fix the time of holding an extra session of the Legislative Assembly."

The House then proceeded to the orders of the day.

The undermentioned bills, resolutions and memorials, of this House, were severally read the third time, passed, and titles thereof agreed to, viz:
