And then he withdrew.

The amendments to the said resolutions and bill were then taken up and considered, when the amendments to resolutions Nos. 18 and 19, were severally concurred in; and the amend ments to resolution No. 17, and bill No. 45, were non-concurred in.

On the question of agreeing to the amendment to resolution No. 17, the aycs and noes were called, and were as follows:

Ayes-Messrs. Billings, Brunson, Jenkins, McGregor, Street and Whiton, speaker--6.

Noes--Messrs. Baldwin, Beardsley, Blackstone, Bracken, Childs, Conroe, Craig, Cruson, Dewey, Hoyt, Longstreet, Newman, Ray, Shackelford, Shew, Sholes, Stevens, Story, Sutherland and Wells-20.

Mr. Longstreet, from the joint committee on enrolment, reported that the committee did on this day submit to the Governor, for his examination and approval, the following, viz:

"An act relating to strays."

"An act to provide for laying out a Territorial road from Fort Howard to Knaggs' ferry, in Brown county."

"An act to provide for the support of common schools, and for other purposes."

"An act to establish the towns of Pewaukee and Granville, in the county of Milwaukee."

"An act relating to the duties of the register of deeds of the county of Rock."

"Resolution relating to county seals."

Mr. Shackelford, from the committee on enrolment, reported to be correctly enrolled, "Resolution relating to the clection of canal commissioners," which was signed by the Speaker.

On motion of Mr. Sholes,

Resolved, That the chief clerk of this House be directed to inform the Council that seats have been prepared for the members thereof, and to request their attendance in the Hall of Represen tatives', for the purpose of electing by joint ballot three canal com. missioners, and supplying the vacancies in the board of visitors of

the Wisconsin University, the time for said election, as provided by joint resolution, having arrived.

Resolved, further, That a teller be appointed, on the part of this House, who shall, in conjunction with the teller appointed by the Council, receive and canvass the votes given for said offi

cers.

The Speaker appointed Mr. Shew.

Mr. Shackelford, from the committee on enrolled bills, reported the following to be correctly enrolled, which were signed by the Speaker, viz:

"Joint resolution relating to the United States road leading from Racine to Sinipce."

"An act relative to the county officers of Sheboyagan county."

CONVENTION OF THE TWO HOUSES.

The President and members of the Council having convened in the Representatives' Halls, the President stated the object of the Convention to be to elect three canal commissioners, and to fill such vacancies as have occurred in the board of visitors of the University of Wisconsin.

On motion of Mr. Prentiss,

Ordered, That the Convention proceed to elect three canal. commissioners, all to be voted for on one ticket, and to be desig, nated on the ticket for what office the person is voted for, whether for receiver, register or acting commissioner.

The following nominations were then made.

Mr. Street nominated George H. Walker, for acting commis. sioner.

Mr. Bracken nominated John Hustes, for register. Mr. Wells nominated Thomas J. Noyes, for register. Mr. Longstreet nominated John H. Tweedy, for receiver. The votes having been taken and counted, Messrs. Bullen and Shew, appointed tellers for that purpose, reported that George H. Walker had received thirty-three votes, for acting commissioner

L. W. Weeks received for the same office, two votes; James L.
Thayer received for the same office, one vote.

John H. Tweedy received for the office of receiver, thirty. two votes; and Rufus Parks received for the same office, four

votes.

John Hustes received for the office of register, seventeen votes; Thomas J. Noyes received for the same office, thirteen votes; and Haus Crocker received for the same office, seven votes.

George H. Walker having received a majority of all the votes given for the office of acting commissioner, the President declared him to be duly elected acting commissioner of the Milwaukee and Rock river canal.

John H. Tweedy having received a majority of all the votes given for receiver, the President declared him to be duly clected receiver of the Milwaukee and Rock river canal.

No person having received a majority of the votes given for register, the President declared that no clection had taken place for that office; whereupon,

On motion of Mr. Sholes,

The Convention proceeded to a second ballot for register.

The votes having been taken and counted, the tellers reported that John Hustes had received twenty votes, and that Thomas J. Noyes had received seventeen votes for said office.

John Hustes having received a majority of all the votes given, the President declared him to be duly elected register of the Milwaukee and Rock river canal.

On motion of Mr. Wells,

The Convention then proceeded to elect three visitors of the University of Wisconsin.

Mr. Arndt presented the following communication:

MADISON, January 11, 1840. To the Honorable the Legislative Assembly of Wisconsin Terri tory:

GENTLEMEN-Three vacancies in the board of visitors of the University of Wisconsin have occurred, which vacancies by the law creating said university, devolves on you to fill.

The vacancies are--one occasioned by the death of William N. Gardner, Esq.. late of Milwaukee; and two occasioned by removal from the Territory, viz: of John F. Schermerhorn and William W. Coriell.

The votes having been taken and counted, the tellers reported that Benjamin Eaton had received twenty-five votes; Thomas W. Sutherland twenty-three votes; L. B. Hull twenty-two votes ; Alfred Brunson cleven votes; Jared F. Ostrander seven votes; Washington Philo four votes; Hon. M. L. Martin four votes; Dr. Armstrong two votes; and blank one vote.

Benjamin Eaton, Thomas W. Sutherland and L. B. Hull hav. ing cach received a majority of all the votes given, the President declared them to be duly elected visitors of the University of Wisconsin.

The business before the Convention having now been completed,

On motion of Mr. Prentiss,

The Convention was declared to be dissolved.

The House then resumed its session, when

Mr. Shew, the teller on the part of the House, reported that the

two Houses having met in Convention agreeably to the provisions of the several laws for that purpose, had duly elected George H. Walker, acting commissioner, John II. Tweedy,receiver, and John Hustes, register, of the Milwaukee and Rock river canal, for the ensuing year; and that they had, also, elected Benjamin Eaton, Thomas W. Sutherland and L. B. Hull, to fill the vacancies in the board of visitors of the University of Wisconsin.

Mr. Bracken, from the committee on claims, reported back to the House the report of William B. Slaughter, Secretary of the Territory, corrected.

On motion of Mr. Baldwin,

The House went again into committec of the whole, on bills Nos. 42, 49, 50 and 51, of this House, and on bill No. 48, of the Council, Mr. Sholes in the chair.

After some time the committee rose and, by their chairman, reported to the House the said bills Nos. 42, 48, 49 and 51 with, and No. 50 without, amendment.

Bill No. 50 was ordered to be engrossed and the third time. Message from the Council by their secretary:

"Mr. Speaker-The Council have insisted on their amendment to No. 41, (H. R. file,) A bill to organize the county of Dodge.""

And then he withdrew.

Mr. Shew moved to amend bill No. 51, by striking out the word "three," in the paragraph relating to the pay of John Sheely, for cutting wood, and inserting in lieu thereof the word "four," and, also, by striking out the words "twenty-nine," and inserting "seventy-two."

The and ayes noes were called on said question, and were as follows:

Ayes-Messrs. Brunson, Craig, Cruson, Dewey, McGregor, Shackelford, Shew and Street-8.

Nocs-Messrs. Baldwin, Beardsley, Billings, Blackstone, Brack en, Childs, Hoyt, Jenkins, Longstreet, Newman, Ray, Sholes, Stevens, Story, Sutherland, Wells and Whiton, speaker—17. So the amendment was not agreed to.
