The House then took up and considered bill No. 41, "A bill to organize the county of Dodge," in which the Council insisted on their amendment.

And the question being put, "Will the House recede from their non-concurrence in said amendment ?"

It was decided in the negative.

Mr. Sutherland moved that a committee of conference be ap pointed on the disagreeing vote of the two houses on said bill. The motion was agreed to.

The Speaker appointed Messrs. Sutherland and Childs, of said committee on the part of this House.

Ordered, That the clerk inform the Council thercof, and request a similar committee to be appointed on their part.

Mr. Childs, from the committee on engrossed bills, reported No. 20,"Resolution relative to the publication of the laws in the newspapers," to be correctly engrossed.

The said resolution, and resolution No. 12, (Council file,) enti. tled, "Resolution authorizing the clerk of the supreme court of this Territory to keep his office in the Capitol at Madison," were severally read a third time, passed, and the titles thereof agreed all rules prohibiting the same, being suspended for that pur.

Ordered, That the Council be informed thereof.

Mr. Shackelford moved a reconsideration of the vote taken on to-day, by which bill No. 48, (Council fiie,) entitled, "A bill to authorize the county of Iowa to collect taxes due from the county of Dane for the year 1838," was indefinitely postponed.

The ayes and noes being called for on said question, were ta ken and were as follows:

Ayes-Messrs. Baldwin, Billings, Blackstone, Bracken, Brun. son, Childs, Craig, Cruson, Hoyt, Jenkins, Longstreet, Newman, Shackelford, Shew, Sholes, Story and Street-17.

Noes-Messrs. Beardsley, Conroe, McGregor, Ray, Stevens, Sutherland, Wells and Whiton, speaker-8.

So the said vote was reconsidered.

The question then recurred on ordering said bill to its third reading, and the ayes and noes being called, were as follows:

Ayes-Messrs. Baldwin, Billings, Blackstone, Bracken, Brunson, Childs, Craig, Cruson, Dewey, Hoyt, Jenkins, Longstreet, Newman, Shackelford, Story and Street-16.

Noes-Messrs. Beardsley, Conroe, McGregor, Ray, Shew, Stevens, Sutherland, Wells and Whiton, speaker-9.

So the said bill was ordered to its third reading, and was then read the third time, and the question being put, "Shall this bill pass?"

It was decided in the affirmative, aycs 15, noes 9.

Those voting in the affirmative were, Messrs. Baldwin, Bil. lings, Blackstone, Bracken, Brunson, Childs, Conroe, Craig, Dewey, Hoyt, Jenkins, Longstreet, Shackelford, Story and Street-

Those voting in the negative were, Messrs. Beardsley, McGre. gor, Newman, Ray, Shew, Stevens, Sutherland, Wells and Whi ton, speaker-9.

No. 43, A, "A bill to incorporate the Blue Mounds mining, smelting and manufacturing company," was then taken up, and the question being on ordering the same to its third reading,

On motion of Mr. Dewey,

A call of the House was had, and the serjeant-at-arms was sent after absent members.

After a short time the serjeant-at-arms reported the absent members in attendance.

The question was then taken on ordering the said bill to its third reading, and was decided in the affirmative.

The said bill was then read a third time, and the question being

put, "Shall this bill pass?" the ayes and noes were called, and were as follows:

Ayes-Messrs. Baldwin, Beardsley, Blackstone, Bracken, Childs, Craig, Hoyt, Longstreet, Newman, Ray, Sutherland, Wells and Whiton, speaker--13.

Noes-Messrs. Billings, Brunson, Conroe, Cruson, Dewey. Jen. kins, McGregor, Shackelford, Shew. Sholes, Stevens, Story and Street--13.

So the House being equally divided the bill was lost.

Ordered, That the Council be informed thereof, and of the concurrence of this House in bill No. 48.

Mr. Billings moved that the House go into the committee of the whole on bill No. 43, (Council file,) entitled, "A bill supplemen. tary to an act for assessing and collecting county revenue."

Mr. Dewey moved that said bill be indefinitely postponed.
Which was decided in the affirmative.

Bill No. 27, (Council filc,) was then taken up and considered, entitled, "A bill limiting the term of office of all officers not now limited by law;" and the question being on its final passage was theu put,

And was decided in the affirmative.

Ordered, That the Council be informed thereof, and that bill No. 43 has been negatived by this House.

The House then took a recess of half an hour.

Half past nine o'clock.

The House resumed its session, when the following message was received from the Council:

"Mr. Speaker--The Council have passed the following: "No. 3, Memorial to Congress concerning pre-emption rights to miners.'

"No. 5, Memorial to Congress relative to duties on imported

lead.'

"No. 6, Memorial to Congress to extend the jurisdiction of justices of the peace.""

And then he withdrew.

On motion,

A call of the House was had, and the serjeant-at-arms sent af. ter absent members.

After a short time the serjeant-at-arms returned and reported. all in attendance, except Messrs. Beardsley and Longstreet.

Mr. Shackelford offered the following resolution, which was adopted:

Resolved, That the chief clerk of this House call upon the Council and request them to transmit to this House the memorial, and all communications of Messrs. Collier & Pettus, addressed to the Legislature upon the fiscal agency of Moses M. Strong.

On motion of Mr. Baldwin,

The House again took a recess of half an hour.

Half past ten o'clock.

The House resumed its session.

On motion of Mr. Sholes,

Bill No. 6, (Council file,) entitled, "A bill to authorize the building a bridge across the Fox river, in the county of Brown," was taken up, and ordered to be read the third time by its title

now.

The said bill was then read the third time, and on the question "Shall this bill pass ?" the ayes and noes were called, and were as follows:

Ayes-Messrs. Baldwin, Beardsley, Billings, Blackstone, Bracken, Brunson, Childs, Conroe, Craig, Cruson, Hoyt, Longstreet, Newman, Ray, Shew, Sholes, Stevens, Story, Sutherland and Whiton, speaker--20.

Noes-Messrs. Dewey, Jenkins, McGregor, Shackelford and Street-5.

So the said bill was passed, and the title thereof was then agreed

Ordered, That the Council be informed thereof.

Message from the Council by their secretary:

"Mr. Speaker-The Council have concurred in bills, and a resolution of this House, as follows, viz :

"No. 50, A bill to change the name of the town of Mentor, in the county of Milwaukee.'

"No. 51, A bill to provide for the compensation of the officers of the Legislative Assembly, and for other purposes;' and,

"No. 14, Joint resolution relating to the printing of the laws passed at the present session of the Legislative Assembly," with amendments to bills Nos. 47 and 51, in which amendments the concurrence of this House is requested.

"And have concurred in the amendment of this House to bill No. 41, entitled, 'A bill to provide for laying out and opening Territorial roads, and for other purposes.'

"Have negatived bills of the following titles, viz:

"No. 42, A bill in relation to United States roads in this Territory; and,

"No. 49, A bill to regulate the mode of petitioning the Legislative Assembly.'

"And have receded from their amendments to bill No. 41, 'A bill to organize the county of Dodge.""

And then he withdrew.

Mr. Sutherland, from the committee appointed for the purpose, made the following report:

The joint committee, appointed on the disagreeing vote of the two houses,in relation to bill No.41, entitled, "A bill to organize the county of Dodge," have had the subject referred to them under con sideration, and would respectfully report, that the committee on the part of the Council have agreed to recommend to that body to recede from their amendment, made to the bill in the Council.

The report of the committee was accepted, and the committee discharged.

Mr. Shackelford, from the committee on enrolment, reported the following to be correctly enrolled, which were signed by the Speaker, viz:

"An act limiting the term of office of all officers not now limit. ed by law.":
