On motion of Mr. Sholes,

MONDAY, January 13th, 1840.

A call of the House was made, and the serjeant-at-arms sent after absent members.

The serjeant-at-arms returned after a short time and reported that Messrs. Hoyt, Newman, Shew, Stevens and Sutherland could not be found at their lodgings, and that it was reported that they had left town.

The Speaker laid before the House a list of the acts, memorials and resolutions originating in the House of Representatives, and which have been approved by the Governor, prepared by the clerk in obedience to the order of the House, which are as follows:

"An act to establish a Territorial road from Madison to Frankfort in Dodge county."

Approved December 21, 1839.

"An act to repeal an act entitled, 'An act to change the corporate limits and powers of the town of Green Bay.""

"An act to provide for recording contracts relating to lands, and for other purposes."

"An act to authorize William H. Bruce, and others, to build and maintain a dam on the Manitouwoc river."

"An act to prevent trespass and other injuries being done to the possessions of settlers on public lands, and to define the right of possession on said lands."

"An act relating to the fiscal agency of Moses M. Strong." Approved January 4, 1840.

"An act to organize the county of St. Croix."

Mr. Shackelford, from the joint committee on enrolment, reported the following bill to be correctly enrolled, which was signed by the Speaker, viz:

"An act to authorize the building a bridge across the Fox river, in the county of Brown."

On motion of Mr. Wells,

Ordered, That the clerk be instructed to enter upon the journal the names of the members absent without leave, as reported by the serjeant-at-arms.

Messrs. Hoyt, Newman, Shew, Stevens, and Sutherland, were reported to have left town and were not in their seats.

Mr. Street, from the select committee to whom the memorial of Messrs. Collier & Pettus of St. Louis, with the accompanying documents were referred, submitted a report which was read. (See Appendix, document P.)

On motion of Mr. Shackelford,

The memorial of Messrs. Collier & Pettus relating to the sub. ject embraced in the said report was read, together with other pa pers referred to the committee.

On motion of Mr. Shew,

The report was accepted and the committee discharged.

A motion was made by Mr. Shackelford that the said report be printed, and the ayes and noes were called for and were as fol lows:

Message from the Council by their secretary:

"Mr. Speaker-The Council have receded from their amend. ment to bill No. 35, of this House, entitled, A bill to amend an act of the Statutes of the Territory of Wisconsin, entitled, An act concerning costs and fees.'

"The Governor has informed the Council that he has, on this day, examined and approved the following:

"An act to organize the towns of Wau-wau-to-sa and Aztalan.'

"An act to provide for holding the district court within the county of Brown, and for other purposes.'

"An act to incorporate and regulate public libraries.' "An act limiting the term of office of all officers not now li mited by law.'

And then he withdrew.

The Speaker laid before the House a message from the Governor returning the following acts, &c. with his approval, viz: "An act in relation to mills and mill-dams."

"An act to provide for the appointment of agents to demand fugitives from justice, and for issuing search warrants."

"An act to change the time of holding courts in the second judicial district."

"An act in relation to collectors, assessors and supervisors of roads."

"An act relative to the expenses of the Adjutant-General's office."

"An act relating to the duties of the register of deeds of the county of Rock."

"An act to establish the towns of Pewaukee and Granville in the county of Milwaukee."

"An act to provide for the support of common schools, and for other purposes.'

Mr. Wells, from the judiciary committee, reported a bill which was read the first and second time, of the following title, to wit:

On motion of Mr. Sholes,

The said bill was considered as in committee of the whole, and was, by the special order of the House, read the third time, passed and the title amended to read, "A bill in relation to suits in the Territory;" the rules having been suspended for that pur pose.

Ordered, That the clerk request the Council to concur in the said bill.

Mr. Shackelford, from the joint committee on enrolment, re ported the undermentioned bills to be correctly enrolled, which were signed by the Speaker, viz:

On motion of Mr. Story,

Bill No. 51, "A bill to provide for the compensation of the offi. cers of the Legislative Assembly, and for other purposés," was taken up and considered as in committee of the whole, and the 11th amendment, being an addition to the bill, was concurred in, with amendments.

Resolution No. 17, entitled, "Resolution relative to the settle. ment of the accounts of the late acting commissioner,” was taken up and considered, and their non-concurrence in the amendments of the Council was receded from, and the amendments concurred in.
