Council with amendments, was considered and the amendments concurred in.

Ordered, That the Council be requested to concur in the amend ments to the amendments to bill No. 51, and be informed of the concurrence of the House in the amendments to bill No. 47, and resolution No. 17.

On motion of Mr. Billings,

The House took a recess until 11 o'clock A. M.

Eleven o'clock A. M.

Mr. Shackelford, from the joint committee on enrolment, re-. ported the following to be correctly enrolled, which were signed by the Speaker, viz:

"Resolution concerning the settlement of the accounts of the late acting commissioner."

"An act to amend an act, entitled, An act to provide for assessing and collecting county revenue." "

Mr. Shackelford, from the same committee, reported that he had submitted to-day to the Governor for his approval, the follow ing bills, viz:

"An act to authorize the building a bridge across the Fox river, in the county of Brown."

"An act to amend an act of the Statutes of Wisconsin, entitled, An act concerning costs and fees."

"An act concerning actions relating to real property."

"An act to authorize the county of Iowa to collect taxes due from the county of Dane for the year 1838."

"An act to change the name of the town of Mentor, in the county of Milwaukee."

"Memorial to Congress concerning pre-emption rights to miners.' "Memorial to Congress relative to duties on imported lead." "An act to organize the county of Dodge, and for other pur poses.'

"Joint resolution relative to the printing of the laws passed at the present session of the Legislative Assembly."

A message was received from the Governor, informing the

House that he had, on this day, approved of the following, viz:

"An act to organize the county of Dodge, and for other pur poses.'

"Memorial to Congress relative to duties on imported lead." "Memorial to Congress concerning pre-emption rights to mi

ners."

"An act to change the name of the town of Mentor, in the county of Milwaukee."

Message from the Council by their secretary:

"Mr. Speaker--The Council have passed bill No. 54, entitled, A bill requiring Samuel B. Knapp to pay certain moneys, and for other purposes,' in which I am directed to request the concur rence of this House."

And then he withdrew.

The said bill, No. 54, was read the first and second time, and considered in committee of the whole, Mr. Billings in the chair.

After some time the committee rose, and reported the same to the House without amendment.

On motion of Mr. Shackelford,

The said bill was laid on the table for the present.

Mr. Jenkins obtained leave to introduce the following joint re solution, viz:

No. 21, "Joint resolution tendering thanks to the Hon. E. V. Whiton."

The Speaker called Mr. Childs to the chair, when the said resolution, by the special order of the House, was read the first, se cond and third time, passed, and the title agreed to; all rules hav ing been suspended for that purpose.

Ordered, That the Council be requested to concur therein. The Speaker resumed the chair, when,

The House adjourned until 2 o'clock P. M.

AFTERNOON SESSION.

Two o'clock.

A quorum of the members not being present, a call of the House was made and the serjeant-at-arms ordered to procure the attendance of absent members.

The serjeant-at-arms having reported the attendance of all the members, except Messrs. Hoyt, Newman, Shew, Stevens and Sutherland who had left town, the House took up and considered bill No. 54, from the Council, entitled,

"A bill requiring Samuel B. Knapp to pay certain moneys, and for other purposes."

Mr. Sholes offered the following amendment, which was adopt. ed:

Add to the bill the following section,

"SEC. 2. That if Moses M. Strong, late fiscal agent, shall neg. lect or refuse to pay the Secretary of the Territory, the amount of money due from him to the Territory, for the space of two months, from and after the passage of this act, the said Secretary shall report the delinquency to the Attorney-General of Wisconconsin, who shall thereupon commence suit in the name of the Territory for the recovery of the sum due and unpaid."

On motion of Mr. Conroe,

Ordered, That the said bill be read the third time by its title

now.

The said bill was then read the third time, passed, and the title thereof agreed to.

Ordered, That the Council be requested to concur in the amend ment to said bill.

The following message was received from the Council by their secretary, viz:

"Mr. Speaker-The Council have concurred in the amendments of this House to the 11th amendment of the Council to bill No. 51, entitled, A bill to provide for the compensation of the officers of the Legislative Assembly,' except the following-to strike out

two,' in the compensation to Col. Slaughter for office rent, &c. and insert 'five,' to which the Council haved disagreed; have amended the 11th amendment of this House, in the 32d para graph; and have adhered to their 8th amendment."

And then he withdrew.

The House then took up and considered bill No. 51, contained in the foregoing message.

The House insisted on their disagreement in the 11th amend. ment to the paragraph which provides a compensation for office. rent, fuel, &c., to William B. Slaughter, and Messrs. Sholes and Childs were appointed a committee of conference thereon.

The amendment of the Council to the amendment of the House in the 32d paragraph of the 11th amendment was concurred in.

The House, also, insisted on their disagreement to the 8th. amendment of the Council to said bill.

Mr. Shackelford moved that a committee of conference be ap pointed on the disagreement of the two Houses to the 8th amend

ment.

The Speaker decided the motion not in order.

Mr. Shackelford appealed from the decision of the chair. The question was then stated to be, "Shall the decision of the chair stand as the judgment of this House?"

When Mr. Shackelford withdrew his appeal.

The House then, on motion of Mr. Dewey, reconsidered its vote insisting on their disagreement to the 8th amendment. Message from the Council by their secretary:

"Mr. Speaker-The Council have concurred in joint resolu tion No. 21, entitled, "Joint Resolution tendering thanks to the Hon. E. V. Whiton; and in the amendment of this House to bill No. 54, entitled, A bill requiring Samuel B. Knapp to pay certain moneys, and for other purposes;' and have indefinitely postponed No. 53, A bill in relation to suits in favor of the Ter ritory.""

And then he withdrew.

A motion was then made by Mr. Sholes that the House do re

cede from their non-concurrence in the 8th amendment of the Council, and the ayes and noes being called for, were as fol lows:

Ayes-Messrs. Blackstone, Bracken, Conroe, Craig, Cruson, Dewey, Longstreet, Ray, Sholes, Strect and Whiton, speaker

Noes--Messrs. Baldwin, Beardsley, Childs, Jenkins, McGre gor, Shackelford and Story-7.

So the House receded from their non.concurrence in the 8th amendment.

Ordered, That the clerk request a conference on the disagree. ment of the two Houses to the paragraph in the 11th amendment of said bill, which provides a compensation to William B. Slaughter, for office rent, &c., and inform the Council of the concurrence of the House in the 8th amendment, and in the 32d paragraph of the 11th amendment to said bill.

Mr. Story, from the committee en expenses, reported bill No. 54, entitled, "A bill for the relief William B. Slaughter.'

Which was read the first and second time.

The said bill was then, by the special order of the House, read the third time, passed, and the title thereof agreed to; the rules prohibiting it to be so read, having been suspended for that pur. pose.

Ordered, That the clerk request the Council to concur in said

bill.

Mr. Shackelford, from the joint committee on enrolment, re. ported the following to be correctly enrolled, which was signed by the Speaker, viz:

"An act requiring Samuel B. Knapp to pay certain moneys, and for other purposes."

On motion of Mr. Wells,

Ordered, That the clerk be directed to return the memorial of Messrs. Collier & Pettus, and the accompanying documents, to the Council.
