Mr. Wells moved to amend the preamble and resolution by striking out the words "United States Attorney for this Territory," in the first and second lines, and also, all after the word "Territory," in the twenty-first to the word "whether," in the twenty. fourth line.

A division of the question being called for by Mr. Childs, the question recurred on striking out the words "United States Attorney for this Territory," and the ayes and noes being called, were as follows:

Ayes-Messrs. Baldwin, Beardsley, Billings, Bracken, Childs, Conroe, Craig, Dewey, Hoyt, Jenkins, McGregor, Newman, Ray, Shew, Sholes, Stevens, Story, Street, Sutherland, Wells and Whiton, speaker-21.

Noes-Messrs. Cruson and Shackelford-2.

So the amendment was adopted.

On motion of Mr. Conroe,

A call of the House was ordered, and the serjeant-at-arms was sent after absent members.

On motion of Mr. Childs,

Mr. Longstreet was excused from attendance in the House, in in consequence of illness.

The serjeant-at-arms having reported that the absent member could not be found, the question on the second amendment was then taken.

Mr. Shackelford called for the ayes and noes on said amend. ment, which were as follows:

Ayes-Messrs. Billings, Conroe, Hoyt, Jenkins, Newman, Ray, Street, Wells and Whiton, speaker-9.

Noes-Messrs. Baldwin, Beardsley, Bracken, Childs, Craig, Cruson, Dewey, McGregor, Shackelford, Shew, Sholes, Stevens, Story and Sutherland-14.

So the amendment was not adopted.

The question then recurred on the passage of the resolution as amended; and the ayes and noes being called for, by Mr, Shackelford, were as follows:

Ayes Mesurs. Baldwin, Bez dsley, Billings, Bracken, Childs,

Craig, Cruson. Dewey, Jenkins, McGregor, Newman, Ray, Shackelford, Shew, Sholes, Stevens, Story, Street, Sutherland and Wells.

Noes-Messrs. Conroe, Hoyt and Whiton, speaker.

So the resolution was passed.

Mr. Sholes, by leave, introduced resolution No. 8, entitled "Resolution relative to the distribution of the local laws." Which was read a first and second time,

Message from the Council by their secretary:

"Mr. Speaker-The Council have passed the following, in which they ask the concurrence of this House, viz :

"Bill No. 1, A bill to legalize the proceedings of the county commissioners of Crawford county therein referred to.'

"Resolution No. 2, Resolution relating to public printing.' "And have concurred in resolutions of this House, as follows, viz :

"No. 3, Joint resolution relating to printing reports and other documents made in both Houses.'

No. 5, Resolution in relation to the half-breed lands on Lake Pepin.'

"No. 6, Resolution relative to the extension of the military reserve, at Fort Snelling, to the east side of the Mississippi river.'

And then he withdrew.

On motion of Mr. Story,

A bill and resolution from the Council were then taken up and read a first and second time, entitled as follows:

No. 1, "A bill to legalize the proceedings of the county officers of Crawford county therein referred to."

No. 2, "Resolutions relating to public printing."

Mr. Childs moved that the House do now adjourn until 3 o'clock P. M.

And the ayes and noes being called for, were as follows: Ayes-Messrs. Beardsley, Bracken, Cruson, Hoyt, McGregor, Shackelford, Stevens, Story, Sutherland and Wells-10.

Noes-Messrs. Baldwin, Billings, Childs, Conroe, Craig, Dewey,

Jenkins, Newman, Ray, Shew, Sholes, Street and Whiton, speaker-13.

So the motion was lost.

On motion of Mr. Childs,

The House adjourned.

FRIDAY, December 13, 1839.

Mr. Sholes presented the petition of citizens of Jefferson coun. ty, praying that James L. Thayer, and others, be authorized to construct a dam across the west branch of Rock river, in town seven north, range fourteen east, and moved that the same be read and referred to a select committee.

Which was agreed to.

Messrs. Sholes, Sutherland and Story, were appointed said committee.

Mr. Brunson offered the following resolution, which was adopt. ed:

Resolved, That the committee on internal improvement be instructed to report for the consideration of this House, a memorial to the Secretary of War, praying for the construction of a milita ry road leading from Green Bay to Fort Snelling.

Mr. Brunson, from the select committee, to which was referred the petition of Joseph R. Brown, and others, praying for certain ferry charters, reported bill No. 4, entitled

"A bill to establish certain ferry charters therein named."

Which was read a first and second time.

Mr. Shackelford, from joint committee on enrolled bills, reported resolutions, of this House, with the following titles to be correctly enrolled, viz;

No. 3, "Joint resolution relating to printing reports and other documents made to both Houses."

No. 5, "Resolution in relation to the half-breed lands on Lake Pepin."

No. 6, "Resolution relative to the extension of the military reserve, at Fort Snelling, to the east side of the Mississippi river.”

The said resolutions were then severally presented to, signed. by the Speaker, and ordered to be presented to the President of the Council for his signature.

Mr. Shackelford, from the committee on Territorial affairs, reported bill No. 5, entitled

"A bill to organize the county of St. Croix."

Mr. McGregor gave notice that he should, on some future day, ask leave to introduce a bill to amend an act, entitled

"An act for assessing and collecting county revenue."

Mr. Street moved to reconsider the vote taken yesterday on the passage of the resolution relating to the fiscal agency of Moses M. Strong, Esq.

And the ayes and noes being called for on the question to re consider, there were ayes 18, noes 7.

Those voting in the affirmative were, Messrs. Baldwin, Bil. lings, Brunson, Conroe, Craig, Cruson, Dewey, Hoyt, Jenkins, Longstreet, Newman, Ray, Shew, Story, Street, Sutherland, Wells and Whiton, speaker.

Those voting in the negative were, Messrs. Beardsley, Bracken, Childs, McGregor, Shackelford, Sholes and Stevens.

So the House reconsidered the vote adopting the said resolu tion.

Mr. Childs offered the following resolution, which was agreed

Resolved, That the Governor of this Territory be requested to report to this House any information in his possession relative to the fiscal agency of Moses M. Strong.

Mr. Jenkins moved to amend the resolution relating to the fiscal agency of Moses Mr. Strong, Esq., as follows:

Strike out all of the last resolution and insert the following: "And whereas the Hon. James D. Doty, our present delegate in Congress, was heretofore elected treasurer of the commission. ers on public buildings, and whereas the said Doty, as such treas urer, has received the sum of forty thousand dollars, the sum appropriated by Congress for the erection of public buildings in this Territory; and whereas divers rumors are in circulation as

to the manner in which said money has been expended, therefore,

"Resolved, That the said James D. Doty, be requested to report to this House, as soon as practicable, whether any portion of said appropriation, has been by him, or others to his knowledge, in.' vested in lead, bank stock or merchandize, or in the erection of dwelling-houses, stores, taverns, shops, offices or steam mills, at Madison, and if so, what amount has been appropriated to each of these objects, together with the result of such investments; and whether the old board of commissioners and James Morrison, contractor, arc in partnership in the erection of said public buildings, and other speculating operations.

"Resolved, That the chief clerk of this House be requested to transmit copies of these resolutions to the Hon. James D. Doty and Moses M. Strong, Esq."

Mr. Bracken moved to amend the amendment offered by Mr. Jenkins, by striking out the following words, "our present dele. gate in Congress."

Which was agreed to.

Mr. Billings moved that the resolution and the amendment be laid on the table, and be made the order of the day for Monday next, and the question being taken

It was decided in the affirmative. Ayes 12, noes 10.

So the resolutions were made the order of the day for Monday

next.

Mr. Ray gave notice, that on some future day he should ask leave to introduce a bill providing for laying out and establishing a certain Territorial road.

On motion of Mr. Billings,

The House adjourned until 3 o'clock P. M.
