SEC. 25. Whereas, an emergency exists, therefore this act shall take effect and be in force from and after its passage.

CHAPTER 14.

AN ACT to authorize the Board of Public Lands and Buildings to extend the contract for the building of the west wing of the capitol building.

Be it enacted by the Legislature of the State of

SEC. 1. That the board of public lands and Contract to be building is hereby authorized and directed to extend the time of completion of the contract, heretofore entered into by and on behalf of the State of Nebraska with W. H. B.

Stout for the building of the west wing of the new capitol building, to a time not longer than the 1st day of September A. D. 1881, and that hereafter the board of public lands and buildings shall have full control and authority over the said building and all contracts and extensions entered into on behalf of the state in reference thereto

Provided, That before any extension of time shall be granted or deemed allowed that the sureties on the original bond given, that they shall be required each and severally to file their written consent with the board of public lands and buildings consenting to the extension of the time aforesaid mentioned, and when such consent aforesaid is given the board of public lands and buildings shall then be authorized to extend the time aforesaid.

Provided further, no claim for damages for the non-completion of said west wing according to contract or for any other branch of said contract shall be released by such extension.

SEC. 2. The unexpended balance of the amount due on the contract with said W. H. B. Stout, mentioned in section one of this act is hereby appropriated out of the general fund not otherwise appropriated for the completion of said building.

SEC. 3. WHEREAS, An emergency exists therefor, this act shall take effect and be in force from and after its passage and approval.

CHAPTER 15.

AN ACT to provide for the erection and completion of the east wing of the Capitol building of the state of Nebraska. WHEREAS, under the law passed by the Leg- Preamble. islature and approved February 25th, 1879, providing for the securing and adopting plans for a capitol building for the State of Nebraska and the construction of one wing of said building, and whereas said plans were so secured and adopted, and whereas the contract was entered into by and between the State of Nebraska and W. H. B. Stout for the erection of the west wing of said building which is now well nigh completed; And

WHEREAS, The necessities of the State demand the completion of that portion of the building not under contract to W. H. B. Stout, as rapidly as the interest of the taxpayer and the resources of the state will permit.

Therefore be it enacted by the Legislature of the State of Nebraska:

SECTION 1. That it shall be the duty of the Advertisement Board of Public Lands and buildings, within ten days of the taking effect of this act to advertise in three newspapers in the State of Nebraska, one in Chicago, Illinois, and one in St. Joseph, Missouri, for thirty days, for plans and specifications for the east wing of the Capitol building of the State of Nebraska. The exterior of said east wing to conform in every respect to the exterior of the west wing now under contract of construction by W. H. B. Stout, and the interior to contain proper offices and committee rooms on the first floor,

and on the second floor a hall of an area of not less than four thousand square feet together with appropriate galleries; the said building shall contain all the necessary stairways, gaspipes, plumbing, drain pipes, ventilating shafts, or ducts and flues necessary for heating by steam and properly ventilating the same.

Provided, That if William H. Wilcox, architect of the plans heretofore adopted, will furnish the same with all the details, specifications, and working detailed drawings necessary under the contract for the construction of said building as rapidly as the work may progress, for a sum not to exceed one and one-half per cent of the contract price to be paid as hereinafter specified, that it shall be the duty of the Board of Public Lands and Buildings to adopt such plans within ten days after the taking effect of this act, and no advertising as heretofore specified shall be necessary.

SEC. 2. Should the board be compelled to advertise for plans and specifications as provided for in the first part of section one of this act, then within ten days after the day named in the advertisement it shall be the duty of the said Board in conjunction with a competent builder, who shall not be interested in the contract of the letting thereof―said builder to be appointed by the Governor-to adopt that one of the plans so submitted which shall in their judgement best meet the wants and requirements of the State, and they shall have the right to reject any and all plans submitted.

SEC. 3. The Board shall allow as compensation for said plans and specifications and full working details a sum not to exceed one and

one-half per cent. of the contract price of said building to be constructed, and upon the adopting of said plans and the letting of the contract for the construction of said east wing, the Board shall certify the contract price, together with the amount allowed the architect, to the Auditor of Public Accounts, who shall then draw his warrant on the General Fund for three-fourths of one per cent. on the contract price of said building, and the balance due upon the contract made by said Board with the said architect for said plans and detail drawings shall be certified to by the Board in installments as the work progressess withholding sufficient amount until the completion of all of said detailed working plans to insure the completion of the same. When they are completed, that fact shall be certified to the Auditor and he shall then draw his warrant on the General Fund for the balance due said architect. SEC. 4. The plans and specifications shall be kept on Custody of file in the office of the Commissioner of Public Lands and Buildings, and he is hereby made custodian, and it shall be his duty to see that they are carefully preserved, and they shall remain the property of the State.

SEC. 5. The contract shall provide for the completion of the east wing of said building by the first day of December, 1882.
