other appointees, and such clerks, and assistants to committees. Where the pay of officers, clerks, assistants, or other employes is now fixed by law, they shall be paid accordingly.
Where their pay is not fixed by law, but limited by law, their pay shall not be in excess of such limit. In all other cases their pay shall be fixed by either or both Houses of the General Assembly.
SEC. 4. No appropriation, having been made for the purpose herein set forth; it is hereby declared that an emergency exists for the immediate taking effect of this act, therefore the saine shall be in full force from and after its passage.·

SECTION 1. Be it enacted by the General Assembly of the State of Indiana, That section one of an act entitled "An act concerning the death penalty, prescribing the time, place and manner of inflicting the same, defining who shall be the executioner, and the duties of various officers in connection therewith, and declaring an emergency," approved March 6, 1889, be amended so as to read as follows: Section 1. That the punishment of death prescribed by law shall be inflicted by hanging by the neck until the death penalty. person is dead, which hanging shall take place before the hour of sunrise upon such day, not less than one hundred (100) days after conviction, as the court may adjudge. town of Gentryville is hereby declared to be legally in-

said town, and all the official acts, orders, ordinances, reso-
lutions, by-laws, minutes, and proceedings of the Board of
Trustees of said town of Gentryville are hereby legalized and declared valid: Provided, That this act shall not ap- ply to, or affect pending litigation if any.

of Commissioners in any and all counties in the State of Indi-
ana which have proceeded and constructed free gravel, stone
or other macadamized roads under and by virtue of an act
entitled "An act concerning the construction of free gravel,
stone or other macadamized roads, providing for the location,
the manner of their construction, and providing for the pay-
ment of the same, and their maintenance, and declaring an
emergency, approved March 3, 1893, as amended by 'An act
to amend sections 1, 2, 5, 6, 7, 8 and 10 of said act and ap-
proved March 7, 1895,' as amended by 'An act to amend Sec-
tion 1 of said act, approved February 24, 1899,' and 'An act
to amend sections 1, 2, 3, 4, 5, 6 and 7 of an act approved
March 7, 1895, to amend sections 1, 2, 5, 6, 7, 8 and 10 of an
act approved March 3, 1893,' adding supplemental sections
thereto and declaring an emergency, approved February 28,
1899," and to legalize any and all bonds issued thereunder
and by virtue thereof, whether sold or unsold, and declaring
an emergency.

the manner of their construction, and providing for the
payment of the same, and their maintenance, and declar-

1899," and "An act to amend sections 1, 2, 3, 4, 5, 6 and 7
of an act approved March 7, 1895, to amend sections 1, 2,
5, 6, 7, 8 and 10 of an act approved March 3, 1893, adding
supplemental sections thereto and declaring an emer-
gency, approved February 28, 1899," and has issued and
sold bonds under said acts or has issued bonds under said
acts that remain unsold, under said acts to pay for the cost
of the construction of said road or roads, including the con-
tract price together with compensation allowed the view-
ers and engineer, expenses of election, of posting notices,
of publication and all other expenses, or otherwise, all the
acts and orders of any and all of said boards of commis-
sioners, and any and all bonds issued by them thereunder
and by virtue thereof, whether sold or unsold, be and the
same are hereby in all respects legalized and made valid:
Provided, That nothing in this act shall in any way affect
any suit now pending in any of the courts of Indiana, but
the same shall be heard and determined the same as if this
act had not been passed.
SEC. 2. It is hereby declared that an emergency exists
for the immediate taking effect of this act, therefore the
same shall be in force from and after its passage.
