bill No. 291, entitled · An act to amend chapter 249 of the Laws of 1864, entitled 'An act to amend an act, entitled An act to provide for the incorporation of villages, passed December 7th, 1847, and the several acts amendatory thereof so far as the same relate to the village of New Rochelle in the county of Westchester'" (Int. No. 287), for the purpose of amendment.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Ordered, That the Clerk deliver said resolution to the Assembly, and request their concurrence therein.

The Assembly returned the above resolution, with a message that they have concurred in the passage of the same.

Ordered, That the Clerk deliver said resolution to the Governor. Mr. Ford gave notice that at some future day he would move to suspend Senate rules Nos. 1, 4, 9, 12, 15, 19, 31 and 45, for the purpose of reading, passing and transmitting to the Assembly out of its order Senate bill No. 1102, entitled "An act to amend the Tax Law, relating to the taxation of public franchises as real property." (Int. No. 205.)

Mr. Foley moved that the Senate do now adjourn.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative. Whereupon the Senate adjourned.

The journal of yesterday was read and approved.

Mr. Ellsworth introduced a bill entitled "An act to repeal chapter 68 of the Laws of 1896, entitled 'An act to authorize the supervisors of Niagara county to appoint sidepath commissioners to tax cycles and to expend the moneys raised thereby in construction of sidepaths for cycles, and also chapter 607 of the Laws of 1897 amendatory thereof'" (Int. No. 988), which was

read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Ellsworth, and by unanimous consent, the rules were suspended and said bill ordered to a third reading. Mr. Donnelly introduced a bill entitled "An act to amend section 894 of chapter 378 of the Laws of 1897 commonly known as the Greater New York Charter, relative to taxation on personal property” (Int. No. 989), which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Donnelly, and by unanimous consent, the rules were suspended, and said bill ordered to a third reading and printed and referred to the committee on affairs of cities, retaining its place on the order of third reading.

Mr. Stranahan introduced a bill entitled "An act to amend chapter 394 of the Laws of 1895, entitled 'An act to revise the charter of the city of Oswego as amended by chapter 263 of the Laws of 1897 '” (Int. No. 990), which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Stranahan, and by unanimous consent, the rules were suspended, and said bill ordered to a third reading and printed and referred to the committee on affairs of cities, retaining its place on the order of third reading.

A communication from the Governor, was received and read, in the words following:

(Int. No. 700.)

Mr. Thornton moved that said bill be recommitted to the committee on taxation and retrenchment, with instructions to said committee to report the same forthwith amended as follows:

Page 3, lines 19 and 20, after the word "court" strike out the words "together with interest thereon from the date of the payment."

Page 4, lines 9 and 10, after the word "court" strike out the words "together with interest thereon from the date of the payment."

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Krum, from the committee on taxation and retrenchment, reported said bill amended as directed, and the same was ordered reprinted and placed on the order of third reading.

"An act to provide for the construction of a bridge over Black river, at Pratts landing, between the towns of Greig and Turin, in the county of Lewis, and making an appropriation therefor " (No. 580, Rec. No. 549), which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on finance.

"An act to authorize the town board of the town of Galen, Wayne county, to execute and negotiate notes for the purpose of raising money to pay certain indebtedness of said town, pursuant to a vote and resolution of the town meeting held March 7, 1899" (No. 2103, Rec. No. 550), which was read the first time, and by unanimous consent was also read the second time.
