Mr. Speaker thereupon declared that said bill, having failed to receive the affirmative votes of a majority of all members elected to the House, had failed to pass the House.

H. B. No. 40, by Mr. Fourt: "A Bill for an Act providing for official bonds of certain public treasurers, and public officials, and providing that such bonds may be furnished by a surety or guaranty company, and that the premium on same shall be paid out of the public funds, and providing that such officials shall be absolutely responsible for the safe-keeping of public funds, and prescribing a form of bond."

Moved by Mr. Baird, that the word "absolutely" be stricken out, where it occurs in the title of said bill. The motion prevailed, and the Chief Clerk was instructed to make the correction accordingly.

Thereupon proceedings on said bill were suspended, pending the message from the Senate.

COMMUNICATION FROM THE SENATE.

Whereupon the following communication was received from the Honorable Senate, and read:

House Bill No. 157, by Ways and Means Committee: "A bill for an Act making appropriations to pay the salaries and contingent expense of State officers and their deputies and Boards; for contingent expenses of the Superintendents of Fish Hatchery Districts Nos. 1 and 2; for contingent and other necessary expenses of duly organized military organizations; for expense of suits brought by or against the State; for support and maintenance of State charitable and penal institutions; for paying Land Office fees incident to

the selection of State lands; for expense of advertising, platting, appraising and selling State lands; for printing the journals of the Fifth State Legislature; for printing biennial reports of Auditor and Treasurer; for measuring State printing; for insurance premiums on State Libraries; for relief of the Receiver of the Union Pacific, Denver & Gulf Railway Company; for the relief of Robert Foote, Jr.; for the relief of Thomas G. Smith; for the relief of Company C, First Regiment Wyoming National Guard; for the relief of Park Holland; for the relief of the members of the National Guard who volunteered under the call for troops by the Governor and were afterwards rejected; for the expense in the Iredale-Reavill contest case; for the relief of Chaplin, Spafford & Mathison; for the relief of the S. A. Bristol Company; for the relief of E. A. Slack; for contingent expense of the State Examiner, Judge of Third Judicial District and Judge of Fourth Judicial District; to reimburse the Markel Hotel Company; to reimburse H. G. Balch; to reimburse Virgil R. Rice; to pay expense of water litigation between the States of Colorado and Wyoming."

Thereupon Mr. Atherly rose to a question of personal privilege, and complimented the House upon the unprecedented promptness of the Fifth Legislature in passing the appropriation bill.

The final vote upon the passage of H. B. No. 40 was then called for, and on motion of Mr. Baird the reading of the bill in full was dispensed with. The vote thereon re sulted as follows:

S. F. No. 31, by Mr. Iredale: "A Bill for an Act to repeal Section 6 of Chapter 27 of the Session Laws of 1897, entitled ‘An Act to define the Judicial Districts of the State, and prescribing the time for holding the terms of the District Court in the several counties of each judicial district, and to repeal Chapter 64 of the Session Laws of the State of Wyoming, enacted by the Third State Legislature."

By unanimous consent, Mr. Fourt thereupon offered the following amendment: In line 6 of Section 1 of said bill, strike out the word "is" and insert in lieu thereof the word "are."

On motion of Mr. Fourt the said amendment was adopted, and the Chief Clerk instructed to correct the bill accordingly.

The bill being then placed upon its final passage as amended, the ayes and noes vote thereon resulted as follows:
