On motion of Mr. Carpenter of Albany, the report of the Committee on Credentials was adopted, and the Committee discharged.

On motion of Mr. Davis of Weston, a committee of three was appointed to wait on the Honorable Chief Justice of Wyoming, Mr. Potter, and request him to be present in the House and administer the oath of office to the several members; the said committee, consisting of Messrs. Baird of Laramie, Carpenter of Albany and Halbert of Sheridan, thereupon went to the office of the Honorable Chief Justice and soon returned with the Honorable Chief Justice, who thereupon administered the oath of office prescribed by the Constitution to be administered to members-elect of the House of Representatives of the State of Wyoming, and thereupon the following members subscribed their names to said oath:

Messrs. Atherly, Baird, Butler, Carpenter, Christian, Conaway, Condit, Cooper, Davidson, T. H. Davis, Eychaner, Fourt, Gardner, George, Halbert, Hawk, Hilands, Hollingworth, Jones, Juel, Lewis, McAllister, McAnally, McDermott, McDonald, Nagle, Nowlin, Ogden, Reader, Reid, Roberts, Snow, Stough, Sullivan, Swanson, Thom, Woods, and Mr. Speaker.

Whereupon the Chief Justice declared that the representatives-elect had duly qualified as members of the House of Representatives of the Fifth Legislature of the State of Wyoming.

On motion of Mr. Atherly of Albany County, the House then proceeded with the selection of seats for the members, and the chair appointed Messrs. Nagle and Hawk as tellers to prepare ballots. After the selection of seats was concluded, on motion the House adjourned until two o'clock p. m. tomorrow, the 11th inst.

The House met at 2 o'clock p. m., pursuant to adjournment.

Temporary Speaker B. B. Davidson in the chair.

The journal of the previous day's session was read, and after one correction, on motion of Mr. Atherly of Albany County the same was approved.

Roll call:

H., Eychaner, Fourt, Gardner, George, Halbert, Hawk, Hilands, Hollingworth, Jones, Juel, Lewis, McAllister, McAnally, McDermott, McDonald, Nagle, Nowlin, Ogden, Reader, Reid, Roberts, Snow, Stough, Sullivan, Thom, Woods, and Mr. Speaker.

Absent-Mr. Swanson.

ELECTION OF OFFICERS.

On motion of Mr. Carpenter of Albany, the House then proceeded to the election of permanent officers.

Nominations for Speaker being declared in order, the name of the Hon. Levi R. Davis of Weston, was presented by Mr. Atherly of Albany for said office, and seconded by Mr. Baird of Laramie. On motion of Mr. Atherly, the election of Mr. Davis of Weston was made unanimous by acclamation.

The Temporary Speaker thereupon declared Hon. L. R. Davis of Weston County unanimously elected Speaker of the House of Representatives of the Fifth Legislature of the State of Wyoming, and appointed Messrs. Cooper of Converse, Sullivan of Natrona, and Nagle of Laramie, a committee to escort the Speaker to the chair, which duty was by them duly performed.

Thereupon the Speaker-elect addressed the House.

On motion of Mr. Carpenter of Albany, the Speaker appointed Messrs. Baird, Condit and Cooper, a committee to wait upon the Honorable Chief Justice or other competent Judge, and request his presence in the House for the purpose of administering the oath of office to the Speaker-elect. The committee retired, and soon returned accompanied by the Honorable C. N. Potter, Chief Justice of Wyoming, who thereupon administered the oath of office to the Speakerelect as prescribed by the Constitution. Whereupon the Speaker-elect subscribed the oath, and the Honorable Chief Justice declared the Hon. Levi R. Davis of Weston County

the duly qualified Speaker of the House of Representatives of the Fifth Legislature of Wyoming.

Nominations for Speaker pro tempore being declared in order, Mr. Davidson of Laramie presented the name of Jerome S. Atherly of Albany for that position, which said nomination was, on second and motion of Mr. Fourt, made election unanimous by acclamation.

Nominations for Chief Clerk being declared in order, Mr. Fourt of Fremont presented the name of L. R. Gillette for said position, whose election was, on motion of Mr. Fourt, made unanimous by acclamation.

Nominations for Assistant Chief Clerk having been declared in order, Mr. Conaway presented the name of W. L. Evans for said position; and on second of Mr. Carpenter of Albany and motion of Mr. Davidson the election of Mr. Evans was made unanimous by acclamation.

Nominations for Enrolling and Engrossing Clerk being called for, Mr. McDermott of Laramie presented the name of Gertrude W. Dobbins for said position. On second and motion of Mr. Fourt, Miss Dobbins' election was declared unanimous by acclamation.

Nominations for Assistant Enrolling and Engrossing Clerk being then in order, J. W. Hawk of Sweetwater presented the name of Robert A. Smith, Jr., for said position. On motion of Mr. Hollingworth, the election of Mr. Smith was made unanimous by acclamation.

Nominations for Sergeant-at-Arms being then declared in order, Mr. Sullivan of Natrona presented the name of R. W. Wanlace for said position. On second by Mr. Lewis and motion of Mr. Davidson, the election of Mr. Wanlace was made unanimous by acclamation.

Nominations for Chaplain being then by the Speaker declared in order, Mr. Jones of Laramie County presented the name of Rev. W. N. Dunham, who was, on motion of Mr. Davidson, declared unanimously elected by acclamation.

Nominations for Messenger of the House being then declared in order, Mr. Cooper presented the name of Earl Adams, whose election was, on motion of Mr. Cooper, made unanimous by acclamation.

Nominations for the position of Watchman of the House being then in order, Mr. Fourt of Fremont presented the name of Robert McAuley, whose election was, on motion of Mr. Fourt, made unanimous by acclamation.

Nominations for Door-keeper of the House being then in order, Mr. Woods of Laramie presented the name of Benjamin F. Smalley for said position. On second and motion of Mr. Davidson, the election of Mr. Smalley was made unanimous by acclamation.

Nominations then being in order for Janitor of the House, Mr. Carpenter placed before the House the name of

Lewis Zolman, whose election was, on motion of Mr. Carpenter, made unanimous by acclamation.

Nominations for Page of the House being then declared in order, Mr. McDermott presented the name of Gus Buechner for said position. On motion of Mr. Davidson the election of Mr. Buechner was made unanimous by acclamation.

On motion of Mr. Atherly a committee of three was appointed to wait upon the Honorable Chief Justice or other qualified officer and invite him to be present in the House for the purpose of administering the oath of office to all duly elected employes of the House. The committee appointed by the Speaker, Messrs. Thom, Lewis and Stough, having retired to the office of the Honorable Chief Justice, soon returned in company with his honor, who thereupon administered the oath as prescribed by the Constitution to the following officers, each of whom immediately thereafter subscribed the oath:

Moved by Mr. Atherly that the House rules of the House of Representatives of the Fourth Legislature of Wyoming, be adopted by this House for the government and control thereof until rules be formulated anew; motion seconded by Mr. Conaway. Carried.

Moved by Mr. Baird that a special committee of five be appointed by the Speaker, to prepare rules for the government of this House, and that in conjunction with a like committee of the Honorable Senate, they prepare joint rules. which shall obtain during this session of the Fifth Legislature of Wyoming. Seconded by Mr. Jones. Carried. Mr. Speaker thereupon appointed as such committee, Messrs. Hollingworth, Lewis, Hawk, Carpenter, and Fourt.

On motion of Mr. Hollingworth, the Clerk was instructed to notify the Honorable Senate that the House was now fully organized and ready for the transaction of business, which was accordingly done.

On request of Mr. Hawk of Sweetwater, there being no objection to the same, Mr. Swanson was excused from attendance for the day, on account of sickness.

On request of Mr. Carpenter of Albany, and support of Mr. Fourt of Fremont, Mr. Baird of Laramie County was excused from attendance for tomorrow, Thursday the 12th instant, on account of urgent business in Denver.

Mr. Baird moved that a committee of three be appointed by the speaker to confer with a like committee from the Senate, and wait upon His Excellency the Governor and determine when he will be in readiness to deliver his annual message to the Fifth Legislature of Wyoming in joint session. The speaker appointed on said committee, Messrs. Butler, Gardner, and Jones.
