GENTLEMEN: This refers to your application for exemption from Federal income tax as an organization described in section 501(c)(3) of the Internal Revenue Code. Before a determination can be made of its qualification for exemption from Federal income tax, it will be necessary to furnish additional information relative to the proposed activities and operations of the organization.

A determination letter may be issued in advance of actual operations if an organization can furnish information in sufficient detail to permit a conclusion that its proposed operations will clearly meet the requirements of the section of law under which exemption is claimed. Since you have not actually operated for a period of time and to an extent sufficient to clearly disclose your method of operation, you should submit a statement describing your proposed activities and operations in detail, and how your purposes are to be carried out.

For your information and guidance we are enclosing a copy of Publication 557, and refer you to page 5, which has been marked for your ready reference. A description of the activities in which the organization expects to engage, its expected sources of funds, and the nature of its principal contemplated expenditures, fully expanded, as set out in the procedures, should be furnished. Please also furnish copies of any printed material available. This should include brochures, programs, newspaper articles, and any other. Upon receipt of this information, further consideration will be given to your status for Federal income tax purposes.

If this information is not furnished, a record of actual operations is required before a determination letter may be issued. In this event, a determination will not be made at this time. However, if you will submit your application in duplicate after you have actively operated over a period of 12 months in carrying out the purposes for which you were formed, further consideration will be given to your request for exemption from Federal income tax at that time.

Until such time as you have been held to be entitled to an exempt status, you are not relieved of the necessity for filing Federal income tax returns.

A copy of this letter is enclosed and should be attached to the statement requested above, or to your new application after you have actively operated for least 12 months.

Sincerely yours,

J. E. WALL, District Director.
