Mr. PRESIDENT: I am directed to inform your honorable body that the Assembly on yesterday passed Assembly Concurrent Resolution No 23-Relative to printing Central Pacific Railroad reports.

CONSIDERATION OF ASSEMBLY MESSAGE.

Assembly Concurrent Resolution No 23, above reported, read first and second times and concurred in by the Senate.

INTRODUCTION OF BILLS.

By Mr. Lewis-An Act to authorize K. Powell, H. Kraft and their associates, to construct and maintain a wagon road from the Bell mills to a point near the Antelope mills, and to collect toll for travel thereon

Read first and second times and referred to the Judiciary Committee. By Mr. Mandeville-An Act authorizing John C. Murphy and his assigns to construct and maintain a toll road in Mono County.

Read first and second times and referred to the Judiciary Committee. By Mr. Hager-An Act to provide for the improvement of public parks in the City of San Francisco.

Read first and second times and referred to the Judiciary Committee, and ordered printed.

By Mr. Saunders-An Act to ratify and confirm certain orders, ordinances and resolutions of the Board of Supervisors of the City and County of San Francisco.

Read first and second times and referred to the San Francisco delegation.

By Mr. Minis-An Act to authorize Robert J. White, and his associates, successors and assigns, to build and maintain a wharf at the City of Vallejo, in the County of Solano.

MOTIONS, RESOLUTIONS AND NOTICES.

Mr. Farley gave notice that he would, at an early day, introduce a bill to authorize the Board of Supervisors of the County of Amador to levy an additional tax for county expenditures in said county. By Mr. Pendegast:

WHEREAS, Cheap, free and reliable telegraphic communication is one of the greatest needs of the people of the United States, and especially of the people of the Pacific coast, separated as they are from the rest of the country by so great a distance; and whereas, the oppressions and extortions of private companies have demonstrated the necessity of making the telegraph a part of the postal system; therefore, be it

Resolved by the Senate of the State of California, the Assembly concurring, That our Senators in Congress are hereby instructed, and our Representatives requested, to use all efforts for the adoption of such measures as will enable the Post-office Department of the United States to receive and send telegraphic messages in like manner and at as low rates proportionally as letters are now received and sent.

Referred to the Committee on Federal Relations.

By Mr. McDougall :

Resolved, That the Senators composing the Committee on State Hospitals have indefinite leave of absence for the purpose of visiting the State Lunatic Asylum and other institutions.

Adopted.

By Mr. Burnett:

Resolved, That the assistant or assistants appointed by the Enrolling Clerk shall receive the same per diem as the Enrolling Clerk, payable out of the Contingent Fund of the Senate.

Referred to the Committee on Contingent Expenses.

By Mr. Tompkins :

Resolved, That when the Senate adjourns, it adjourns to Monday next, at two o'clock and thirty minutes P. M.

By Mr. Pendegast:

Resolved, That Senators Lewis and Conly be added to the special committee on the location of the State Normal School.

On the motion to lay the resolution on the table, the ayes and noes were demanded by Messrs Fowler, Wilson and Mandeville, and the Senate refused, by the following vote:

AYES-Messrs. Banvard, Beach, Chappell, Conn, Curtis, Fowler, Irwin, Kincaid, Lawrence, Mandeville, McDougall, Murch, Wilson and Wing-14.

NOES-Messrs. Betge, Burnett, Farley, Gwin, Hager, Hunter, Hutchings, Larkin, Minis, Morrill, O'Connor, Orr, Pendegast, Perkins, Roberts, Saunders, Tompkins, Turner, Tweed and Wand-20.

Mr. Pendegast offered the following as a substitute for the resolution :

Resolved, That the President of the Senate be authorized to appoint two additional members of the special committee on the location of the State Normal School.

By Mr. Farley:

Resolved by the Senate, the Assembly concurring, That the two Houses meet in joint convention in the Assembly Chamber, at twelve o'clock M.

on Tuesday, January twenty-fifth, for the purpose of electing four Trustees of the State Library, to fill the vacancies which will occur by the expiration of the terms of Joseph W. Winans, H. W. Harkness, C. G. W. French and W. C. Belcher.

Adopted, and rules suspended and resolution ordered to be transmitted immediately to the Assembly.

On motion of Mr. Orr, the rules were suspended, and the Senate took up Senate Bill No. 123, heretofore reported by the Committee on Corporations.

Amendment of committee adopted.

Rules suspended, bill considered engrossed, read a third time and passed.

The rules were further suspended, and bill ordered transmitted immediately to the Assembly.

By Mr. Lawrence:

Resolved, That S. J. Lynn be and is hereby appointed Assistant Copying Clerk, to act as such during the indisposition of George M. Norton, at the same per diem as allowed Copying Clerk, payable out of the Contingent Fund of the Senate.

Upon the suspension of the rules for the consideration of the resolution, the ayes and noes were demanded by Messrs. Hager, Betge and Hunter, and the Senate refused, by the following vote:

AYES-Messrs. Banvard, Beach, Betge, Chappell, Conn, Gwin, Kincaid, Lawrence, Lewis, Mandeville, McDougall, Minis, O'Connor, Tompkins, Tweed, Wand and Wing-17.

NOES-Messrs. Burnett, Curtis. Fowler, Hager, Hunter, Irwin, Larkin, Murch, Pendegast, Turner and Wilson-11.

By Mr. O'Connor:

Resolved, That William Smith be and he is hereby appointed to copy the Appendices of the Senate for the eighteenth session of the Legislature, at ten cents per folio of one hundred words; and before he shall receive any pay therefor, that the same be submitted to a proper committee, whose duty it shall be to examine the same as to number of folios written by him, and the correctness of the same.

PETITION.

Mr. Minis presented a petition from citizens of the City of Vallejo, requesting the passage of a bill relative to granting Thomas Davidson the right to maintain a steam ferry from South Vallejo to Mare Island.

Referred to the Committee on Commerce and Navigation.

Senate Bill No. 44-An Act relating to certificates of incorporation. Amendments of committee adopted and bill ordered engrossed.

Senate Bill No. 227, reported by the Judiciary Committee, and substituted for Assembly Bill No. 2 and Senate Bill No. 95-An Act amendatory of and supplementary to an Act entitled an Act to organize and regulate the Justices' Court in the City and County of San Francisco, approved March twenty-sixth, eighteen hundred and sixty-six.

Read first and second times.

Mr. Roberts offered the following amendment:

Amend by adding a new section, as follows: Section Sections eight, nine, ten and twelve of this Act shall not take effect until after the expiration of the term of office of the Constables now holding such offices in said City and County of San Francisco.

Upon the adoption of the amendment, the ayes and noes were demanded by Messrs. Murch, Beach and Roberts, and the Senate refused, by the following vote:

AYES-Messrs. Banvard, Beach, Chappell, Murch, Perkins, Roberts, Tweed and Wing-8.

NOES-Messrs. Betge, Burnett, Conn, Curtis, Farley, Fowler, Hager, Hunter, Hutchings, Irwin, Kincaid, Larkin, Lawrence, Lewis, Mandeville, O'Connor, Pendegast, Saunders, Wand and Wilson-20.

Mr. Hager presented a protest from citizens of the City of San Francisco, against the passage of a bill now before the Legislature, relative to donating to the Society of California Pioneers the use of a certain piece of land in said city.

REPORTS.

Mr. O'Connor, from the Committee on Engrossment, made the following report:

Mr. PRESIDENT: The Committee on Engrossment have examined and find correctly engrossed Senate Bill No. 44-An Act relating to certificates of incorporation.

Mr. Morrill, from the Committee on Enrolment, made the following report:

Mr. PRESIDENT: Your Committee on Enrolment respectfully report that they have examined and find correctly enrolled Senate Bill No. 122-An Act to raise a fund for the improvement of Napa City, and this day, at twelve o'clock M., presented the same to the Governor for his approval.

Mr. PRESIDENT: Your Committee on Enrolment respectfully report that they have examined and find correctly enrolled Senate Bill No. 208 -An Act to empower the Trustees of Sonoma School District, in Sonoma County, to borrow money and provide for its payment.

And on the twenty-second day of January, eighteen hundred and seventy, at twelve o'clock м, presented the same to the Governor for his approval.

Mr. Banvard, from the Committee on Finance, made the following report:

Mr. PRESIDENT: Your Committee on Finance, to whom was referred Senate Bill No. 48-An Act for the relief and support of the California Labor and Employment Exchange-would respectfully report that they have had the same under consideration, and the majority of said committee recommend that said Act do not pass.

Mr. Perkins, from the same committee, presented the following minority report:

Mr. PRESIDENT: The undersigned, a minority of the Finance Committee, to whom was referred Senate Bill No. 48-An Act for the relief and support of the California Labor and Employment Exchange-beg leave to submit the following minority report. Although agreeing with the majority of the committee that the sum asked, one thousand dollars per month, should not be appropriated, would respectfully make the following report: That in view of the fact that the memorial to the Legislature for aid was indorsed by the leading taxpayers of San Francisco, and believing from the evidence before your committee that the Labor Exchange of San Francisco is not only of incalculable benefit to that city, but the State at large, inasmuch as it is the medium to assist in furnishing employment to those who may desire, from any part of the State, free of charge-would respectfully report that, in his opinion, the
