Mr. PRESIDENT: The Committee on Elections, to whom was referred the subject matter of the contested election case, wherein P. W. Murphy is contestant and R. Pacheco is respondent, have had the same under consideration, and report it back to the Senate and recommend the adoption of the following resolution:

Resolved, That P. W. Murphy be and he is hereby declared entitled to his seat as the Senator from the Third Senatorial District, composed of the Counties of Santa Barbara and San Luis Obispo.

Mr. PRESIDENT: The Committee on Judiciary, having had under con sideration Senate Bill No. 187-An Act for the relief of Caleb Dorsey, District Attorney of Tuolumne County; also, Senate Bill No. 216-An Act to repeal an Act entitled an Act supplementary to the Act entitled an Act concerning crimes and punishments, approved April first, eighteen hundred and sixty-four-report the same back and recommend their passage.

Also, Senate Bill No. 173—An Act amendatory of an Act concerning conveyances, passed April sixteenth, eighteen hundred and fifty; and Senate Bill No. 158-An Act to fix the rate of interest on indebtedness due from one county to another, arising from the division of countiesreport the same back and recommend their indefinite postponement.

Also, Senate Bill No. 235-An Act to amend an Act, approved March twenty-fourth, eighteen hundred and sixty-four, entitled an Act to amend an Act entitled an Act concerning the Courts of justice of this State and judicial officers, approved April twentieth, eighteen hundred and sixty-three-report the same back, and recommend that the petition appended to the bill be stricken out, and that the bill pass.

Also, Senate Bill No. 223-An Act to provide for the improvement of public parks in the City of San Francisco-report the same back and recommend that it be amended by striking out the whole of section one,

numbering the following sections thus: Section two as section one, section three as section two, section four as section three, section five as section four, and so on; and that the bill be referred to the San Francisco delegation for their action, it being entirely local in all its parts except in section one.

Also, Assembly Bill No. 61-An Act to amend an Act concerning crimes and punishments, passed April sixteenth, eighteen hundred and fifty; Senate Bill No. 172-An Act to amend an Act providing for the time of holding the several Courts of record in this State, approved April twenty-seventh, eighteen hundred and sixty-three; Senate Bill No. 186-An Act to extend an Act entitled an Act concerning District Court reporters, approved March thirteenth, eighteen hundred and sixty-six, to the Seventeenth Judicial District of the State of California; Senate Bill No. 198-An Act supplemental to an Act concerning crimes and punishments, passed April sixteenth, eighteen hundred and fifty; Senate Bill No. 231-An Act to amend an Act entitled an Act to create the Seventeenth Judicial District, approved March nineteenth, eighteen hundred and sixty-eight; and Senate Bill No. 56-An Act to authorize Harriet Wilkins, administratrix of the estate of Henry Wilkins, deceased, to sell the real and personal estate of said deceased-and report the same back with amendments, and recommend the adoption of the amendments and the passage of the several bills as amended.

Mr. Fowler, from the Committee on Agriculture, made the following report:

Mr. PRESIDENT: The Committee on Agriculture, to whom was referred Senate Bill No. 143-An Act to provide for the restoration of fish in the waters of this State-respectfully report the same back with the following amendment. Strike out section three of the bill and insert the following:

Section 3 It shall be the duty of the Commissioners authorized to be appointed by this Act to require, as far as practicable, all persons, firms and corporations, who have erected mill-dams, water weirs or other obstructions on rivers or streams within the waters of this State, within six months after the passage of this Act to construct and keep in repair fish ways or fish ladders at such mill-dams, water weirs or obstructions, so that, at all seasons of the year, fish may ascend above such dam, weir or obstruction to deposit their spawn. Any person, firm or corporation owning such mill-dam or obstruction, who shall fail or refuse to construct and keep in repair such fish way or fish ladder after having been notified and required by the Commissioners to do so, shall be deemed guilty of misdemeanor, and upon conviction thereof shall be punished by a fine not to exceed one hundred dollars for every such neglect or refusal. The fines and penalties that may be received for convictions under this section shall be paid one-half to the District Judge who shall prosecute the suit, and one-half to the Common School Fund of the county.

Mr. PRESIDENT: Your Committee on Enrolment respectfully report that they have examined and find correctly enrolled Senate Bill No. 2An Act to repeal an Act entitled an Act to prohibit the carrying of concealed weapons, approved April twenty-seventh, eighteen hundred and sixty-three.

Also, Senate Bill No. 42-An Act to appropriate money to pay for services rendered the State by Dr. C. T. Overton.

Also, Senate Bill No. 227 (substitute for Assembly Bill No. 2 and Senate Bill No. 95)-An Act amendatory of and supplementary to an Act to organize and regulate the Justices' Court in the City and County of San Francisco, approved March twenty-sixth, eighteen hundred and sixty-six.

Also, an Act to authorize the Board of Supervisors of the County of Siskiyou to transfer moneys from a certain fund to certain other funds. And on the third day of February, eighteen hundred and seventy, at one o'clock and ten minutes P. M., presented the same to the Governor for his approval.

Mr. PRESIDENT: Your Committee on Finance respectfully report that they have had under consideration Senate Bill No. 67-An Act to amend an Act entitled an Act to authorize the Board of Supervisors of the County of San Joaquin to issue certain bonds and to provide for the payment of the principal and the interest thereon, approved April eighth, eighteen hundred and sixty-two-and recommend its passage. Mr. Saunders, from the San Francisco delegation, made the following report:

Mr. PRESIDENT: Your committee, composed of the Senators representing the City and County of San Francisco, to whom was referred Senate Bill No. 126-An Act to ratify and confirm a certain conveyance made by the Board of Education of the City and County of San Francisco-having had the same under discussion, respectfully report the same back to the Senate and recommend its passage.

Also, Senate Bill No. 104-An Act to amend an Act entitled an Act to amend an Act supplementary to an Act entitled an Act to provide for a street railroad within the City and County of San Francisco, and other matters relating thereto, approved April twenty-first, eighteen hundred and sixty-three, the Act hereby amended having been approved March thirtieth, eighteen hundred and sixty-eight-having duly con sidered the same, report the same back to the Senate and recommend its passage.

Also, Senate Bill No. 192-An Act granting certain privileges to the Central Railroad Company of San Francisco-having duly considered the same, report the same back to the Senate with the following amendment, to wit: Strike out the word "one" at the end of line twelve of section one, and, as amended, recommend its passage.

Also, Senate Bill No. 117-An Act to confer additional powers upon the Board of Supervisors of the City and County of San Francisco, and upon the Auditor and Treasurer thereof, and to authorize certain appropriations of money by said Board-having had the same under consideration, report the same back to the Senate with the following amend ments, to wit: 1st. At the end of subdivision second of section one, after the word "month," insert the word "each." 2d. Strike out the whole of subdivision fifth of section one, commencing at the word “fifth” on line one, page two, down to and including the word "dollars" on line three, same page. 3d. After the word " dollars" in line five of subdivision eighth of section one, on page two, insert: " Ninth-To pay out of the General Fund, for inclosing and improving the city cemetery and paying keeper thereof, the sum of six thousand five hundred ($6,500) dollars." 4th. After the word "valuation" in line eight of section seven, page four, insert "in lieu of all other taxes for school purposes now allowed by law;" and as amended, recommend its passage.

Also, Senate Bill No. 236-An Act to provide funds for the School Department of the City and County of San Francisco-having duly considered the same, report the same back to the Senate with the following amendments, to wit: 1st. Strike out the word "two" between words "for" and "weeks" in line six of section three, page two, and insert in lieu thereof the word "four." 2d. After the word "county" in line seven of section three, page two, insert, "and two weeks in two daily newspapers of general circulation in the City of New York." 3d. After the word "year" in line eleven of section three, page two, insert "as provided in section six." 4th. After the word "Francisco" in line sixteen of section three, page two, insert "by and with the approval and consent of the Mayor of the City of San Francisco, whose consent shall also be necessary to the adoption of all plans and contracts for the purchase of school lots and building of school houses, as aforesaid." 5th. After the word "year" in line six of section six, page four, add "not exceeding the sum of ($50,000) fifty thousand dollars;" and recommend its passage, as amended.

Also, Senate Bill No. 279-An Act to confer additional powers upon the Board of Supervisors of the City and County of San Francisco, and upon the Auditor and Treasurer thereof-having had the same under
