Mr. Hutchings presented the following report:

Mr. PRESIDENT: The select committee, consisting of the Senators from Colusa, Sutter, Yuba and Nevada Counties, to whom was referred Senate Bill No. 345-An Act to empower the City of Marysville and the Counties of Colusa, Sutter, Yuba and Nevada to aid in the construction of the Colusa, Marysville and Nevada Railroad-would report the same back with amendments, and recommend its passage as amended.

HUTCHINGS, for Select Committee.

Mr. Hutchings, from the Committee on Roads and Highways, made the following report:

Mr. PRESIDENT: Your committee, to whom was referred Assembly Bill No. 252-An Act concerning roads and highways in San Bernardino County; also, Senate Bill No. 422-An Act concerning roads and highways in the County of Butte-report favorably and recommend their passage.

Mr. Curtis, from the Sacramento delegation, made the following report:

Mr. PRESIDENT: The Sacramento delegation, to whom was referred Assembly Bill No. 204-An Act to amend an Act, approved March twelfth, eighteen hundred and sixty-eight, entitled an Act to provide for the drainage of the City of Sacramento, and of the lands of Swamp Land District Number Two-have had the same under consideration, and report back and recommend its passage.

Mr. Saunders, from the San Francisco delegation, made the following report:

Mr. PRESIDENT: The San Francisco delegation, to whom was referred Assembly Bill No. 109-An Act to confer additional powers on the Board of Supervisors of the City and County of San Francisco; and also, substitute for Assembly Bill No. 81-An Act to confirm a certain order passed by the Board of Supervisors of the City and County of San Francisco, and to authorize said Board to appropriate money for certain purposes have had same under consideration, and herewith report them back with the recommendation that they pass.

SAUNDERS, for Delegation.

Mr. Wilson verbally reported substitute for Assembly Bill No. 91 without recommendation, and the bill was referred to the Monterey and Santa Cruz delegation.

MOTIONS, RESOLUTIONS AND NOTICES.

Resolved, That the Committee on Corporations be requested to report to this body, without unnecessary delay, Senate Bill No. 62-An Act to amend an Act entitled an Act for the incorporation of railroad companies and the management of the affairs thereof, and other matters relating thereto, approved May twentieth, eighteen hundred and sixtyone-with their action thereon.

Resolved, That when the Senate adjourn, it adjourn to meet on Thursday, the twenty-fourth instant, at two and a half o'clock P. M.

Upon the adoption of the resolution. the ayes and noes were demanded by Messrs Green, Fowler and Wilson, and the Senate so ordered, by the following vote:

Resolved, That the Secretary of the Senate is hereby directed and required to prepare, under the direction of the Committee on Rules, a copy of the standing rules of the Senate and the joint rules of the Senate and Assembly, as amended, and the usual number of the Senate and joint rules, together with the names of the officers and the standing and joint committees of the Senate and Assembly, shall be printed for the use of the Senate.

Mr Farley moved to reconsider the vote by which Senate refused to adopt the resolution allowing P. W. Murphy his seat as Senator from the Third Senatorial District.

Mr. Roberts raised the point of order that Mr. Farley's notice was out of order, as he had voted in the minority.

The Chair decided the point of order to be well taken.

Mr. Irwin moved to reconsider the vote by which the Senate refused to adopt said resolution.

Mr. Farley moved to make the motion to reconsider the special order for Friday next, at ten o'clock P. M.

Upon which motion, the ayes and noes were demanded by Messrs. Green, Murch and Roberts, and the Senate refused, by the following

vote:

AYES-Messrs. Burnett, Comte, Farley, Fowler, Hunter, Hutchings, Irwin, Mandeville, McDougall, Minis, O'Connor and Wand-12.

NOES-Messrs. Banvard, Beach, Chappell, Conly, Curtis, Green, Murch, Perkins, Roberts, Saunders, Turner, Tweed, Wilson and Wing-14.

Mr. Farley moved to make the motion the special order for Saturday next, at one o'clock P. M.

Upon which the ayes and noes were demanded by Messrs. Farley, Fowler and Mandeville.

The roll was called, with the following result:

AYES-Messrs. Burnett, Comte, Farley, Fowler, Hunter, Irwin, Mandeville, McDougall, Minis, O'Connor, Saunders and Wand-12.

There being a tie vote, the President, in the exercise of his constitutional privilege, voted aye, and the motion to reconsider was made the special order for Saturday next, at one o'clock P. M.

Mr. Conn had leave to have his name recorded as voting against the resolution reported by the Committee on Elections in the contested election case of P. W. Murphy vs R Pacheco.

Mr. Saunders had leave to introduce the following bill-An Act to make, open and establish a public street in the City and County of San Francisco, to be called Montgomery avenue, and to take private landtherefor.

Mr. Mandeville had leave to introduce the following bill-An Act t authorize the Treasurer of Tuolumne County to apportion certain mone to the Current Expense Fund of said county, and to pay certain wa

By Mr. O'Connor-From citizens of Nevada County, against the passage of any law which shall require or may permit said county to issue bonds, or guarantee the interest upon bonds, for railroad purposes. Read and referred to the Committee on Corporations.

By Mr. Kincaid-From citizens of the County of Santa Clara, against the passage of so much of a bill, recently introduced in the Senate for the reincorporation of the Town of Santa Clara, as relates to the extension or change of the limits thereof.

Mr. Banvard, from the Committee on Finance, made the following report:

Mr. PRESIDENT: Your Committee on Finance have had under consideration Assembly Bill No. 391-An Act to provide a Contingent Fund for the use of the Legislature-and recommend its passage.

Also, Senate Bill No. 400-An Act to amend an Act entitled an Act granting bounties to the volunteers of this State, enlisted in the service of the United States, for issuing bonds to provide funds for the payment of the same, and to levy a tax to pay such bonds, approved April fourth, eighteen hundred and sixty-four-and recommend its passage.

Also, Senate Bill No. 399-An Act to amend an Act to provide for paying certain equitable claims against the State of California, and to construct a funded debt for that purpose, approved April twenty-eighth, eighteen hundred and fifty-seven-and recommend its passage.
