On motion of Mr. Wand, Senate Bill No. 446 was taken from the file and referred to the San Francisco delegation.

On motion of Mr. Orr, substitute for Senate Bill No. 328 was ordered printed.

Mr. Saunders had leave to make the following report:

Mr. PRESIDENT: Your Committee on Corporations, to whom was referred Senate Bill No. 256, would respectfully report the same back with the following amendment, and recommend its passage: Amend by striking out section three and insert the following:

Section 3. The San José and Santa Clara Railroad Company are hereby authorized to run their cars over their roadway, from the intersection of Franklin and Grant streets, in the Town of Santa Clara, along the line of the Alameda road, to the city limits of the City of San José, to be propelled by horses, mules or what are known as steam dummy engines, for the term of one year from the time that they may put such engine or engines in operation. At the end of the above named period of one year, the Board of Supervisors of Santa Clara County may, at their discretion, require the said company to desist from the use of said engines, if in their opinion it is detrimental to the public interests.

Mr. Maclay had leave to introduce the following bill-An Act to amend an Act to provide for a system of common schools.

Read first and second times and placed on file, and ordered printed. Assembly Bill No. 245-An Act to regulate fees and salaries of office and salaries of certain officers, and to repeal certain other Acts in relation thereto.

The hour of two o'clock P. M. having arrived, the time for the consid eration of special order-Governor's message vetoing Senate Bill No 185 -An Act authorizing Morris Wolff and others to lay down iron water pipes in any of the public streets of the Town of San Bernardino.

On motion of Mr. Mandeville, the special order was discharged and made the special order for to-morrow at twelve o'clock M.

Assembly Bill No. 245 was considered in Committee of the Whole and amended.

Mr. Lawrence had leave to introduce the following resolution:

Resolved, That when the Senate adjourns, it adjourns to meet this evening, at half-past seven o'clock, for the special consideration of the fee and salary bill, now under discussion.

Adopted.

Mr. Morrill verbally reported Assembly Bill No. 479, with amendments, and recommended the passage of the bill as amended.

Amendments of delegation adopted, bill read a third time and passed. At four o'clock and thirty-five minutes P. M., on motion of Mr. Lewis, the Senate took a recess until this evening at half-past seven o'clock.

Consideration of substitute for Assembly Bill No. 245 was resumed in Committee of the Whole, and amended.

Mr. Roberts moved to amend section four, in lines thirty-three, thirtysix, forty-one, fifty-four, sixty-four, seventy-two, seventy-nine, eightytwo, ninety-nine and one hundred and one, of printed bill, by striking out the word "five" wherever the same occurs in each of said lines.

Upon the adoption of the amendment, the ayes and noes were demanded by Messrs. Roberts, Fowler and Mandeville, and the Senate refused, by the following vote:

AYES-Messrs. Banvard, Beach, Conly, Conn, Fowler, Green, Irwin, Murch, O'Connor, Orr, Pacheco, Perkins, Roberts, Tompkins, Turner, Tweed, Wilson and Wing-18.

NOES-Messrs. Betge, Burnett, Chappell, Comte. Curtis, Farley, Gwin, Hunter, Hutchings, Kincaid, Larkin, Lawrence, Lewis, Maclay, Mandeville, McDougall, Minis, Morrill, Pendegast, Saunders and Wand-21.

Mr. Chappell moved to amend by striking out all after the first word "county," in line eight, section fifty-five, and add the following: "Provided, that if such fees do not, in the aggregate, amount to three thousand dollars, then the deficiency shall be paid out of the General Fund of Shasta County."

Upon the adoption of the amendment, the ayes and noes were demanded by Messrs. Betge, Hunter and Maclay, and the Senate so ordered, by the following vote:

AYES-Messrs. Banvard, Beach, Burnett, Chappell, Conly, Curtis, Farley, Green, Gwin, Mandeville, McDougall, Morrill, O'Connor, Orr, Pacheco, Pendegast, Perkins, Roberts, Saunders, Tompkins, Tweed and Wing-22

NOES-Messrs. Betge, Comte, Conn, Fowler, Hunter, Hutchings, Irwin, Kincaid, Larkin, Lawrence, Lewis, Maclay, Minis, Murch and Wand-15.

Mr. Murch moved to amend section fifty-eight, by inserting, as follows:

"Section 58. This Act shall take effect and be in force from and after the first Monday in March, eighteen hundred and seventy-two."

Upon the adoption of the amendment, the ayes and noes were demanded by Messrs. Roberts, Murch and Chappell, and the Senate refused, by the following vote:

AYES-Messrs. Banvard, Conly, Green, Murch, Perkins, Roberts and Tompkins-7.

NOES-Messrs. Beach, Betge, Burnett, Comte, Curtis, Farley, Fowler, Hunter, Hutchings, Irwin, Kincaid, Larkin, Lawrence, Lewis, Maclay, Mandeville, McDougall, Minis, Morrill, O'Connor, Orr, Pendegast, Saunders, Turner, Tweed, Wand, Wilson and Wing-28.

Mr. Pendegast moved to reconsider the vote by which the amendment proposed by Mr. Chappell, relative to the office of Sheriff, was adopted. Upon which the ayes and noes were demanded by Messrs. Chappell, Green and Betge, and the Senate so ordered, by the following vote:

AYES-Messrs. Banvard, Burnett, Comte, Curtis, Farley, Fowler, Hunter, Hutchings, Irwin, Kincaid, Larkin, Lawrence, Lewis, Maclay, Minis, O'Connor, Pendegast, Saunders, Wand and Wilson-20.

NOES-Messrs. Betge, Chappell, Conly, Green, Mandeville, McDougall, Morrill, Orr, Roberts, Tompkins, Tweed and Wing-12.

Upon a reconsideration of the vote, the amendment was lost.

Mr. Kincaid moved to make the bill the special order for Saturday next. at twelve o'clock M.

Mr. Mandeville moved the previous question, which was sustained. The motion to make the bill the special order was lost.

Upon the passage of the bill, the ayes and noes were demanded by Messrs. Green, Betge and Minis, and the bill was passed, by the follow ing vote :

Resolved, That Senators Curtis, Murch and Roberts be added to the select committee to which was referred the petition relating to woman's suffrage.
