Mr. PRESIDENT: The Committee on Engrossment have examined and find correctly engrossed Senate Bill No. 550-An Act to provide for the submission to the people of the proposed amendment to the Constitution of the State, as proposed by the Legislature at its sixteenth session and adopted by the Legislature at its seventeenth session, to the votes of the qualified electors at the next general election.

Also, Senate Bill No. 397-An Act to protect fishing in the Sacramento River.

Also, Senate Bill No. 428-An Act to authorize the construction of a railroad in the Town of Santa Clara, and confirming an order of the Board of Trustees of said town in relation thereto.

Also, substitute for Senate Bills Nos. 143 and 107-An Act to provide for the restoration and preservation of fish in the waters of this State. Also, Senate Concurrent Resolution No. 32-Relative to the construction of a ship canal across the Isthmus of Darien or Panama.

therefor.

Also, Senate Concurrent Resolution No. 37-Relative to declaring Vallejo a port of entry.

Also, Senate Bill No. 6-An Act concerning foreign corporations. Also, substitute for Senate Bill No. 293-An Act authorizing the parties therein named, their associates and assigns, to construct and maintain a ship canal from the City of Stockton to deep water on the San Joaquin River.

Also, Senate Bill No. 275-An Act supplementary to an Act entitled an Act to authorize David N. Darlington and Isaiah Hanscom, and others, to build a wharf in Solano County, approved February twentyfirst, eighteen hundred and fifty-five.

Mr. Burnett presented a petition from citizens of San Francisco, for the passage of an Act relating to actions of partition. Read and referred to the Judiciary Committee.

Mr. Kincaid verbally reported Senate Bill No. 228, and recommended the concurrence in amendments made by the Assembly to said bill. Mr. McDougall, for the Monterey and Santa Cruz delegation, made the following report:

Mr. PRESIDENT: The delegation of Monterey and Santa Cruz beg leave to report back Senate Bill No. 228-An Act to authorize and

require the County of Santa Cruz to pay over certain school moneys to certain school districts in San Mateo County-and recommend that said bill be indefinitely postponed.

It appears from the evidence produced that during the school year commencing June first, eighteen hundred and sixty-seven, there was apportioned, by Santa Cruz County, to Pescadero School District, four hundred and seventy-four dollars and twenty-four cents, and that of that amount, one hundred and fifty dollars has been paid, as per annexed receipt, leaving a balance of three hundred and twenty-four dollars and twenty-four cents due on the sixteenth of March, eighteen hundred and sixty-eight.

By an Act of the Legislature, March sixteenth, eighteen hundred and sixty-eight, the larger portion of Pescadero School District was transferred from Santa Cruz County to San Mateo County.

After the date of such transfer, the Trustees of Pescadero School District made a demand for the money claimed by them to be due this district, but payment was refused. The question whether this money is due to Pescadero School District from the County of Santa Cruz has been judicially investigated and decided in favor of Santa Cruz County, as appears from accompanying documents.

It is also claimed that there is due to San Gregorio School District the sum of one hundred and fifty-seven dollars and fifty-eight cents, but there is no proof to sustain it; on the contrary, the accompanying certificate of the Superintendent of Common Schools tends to show that there has not been kept open in said district a free school for three months during the school year for which said amount is claimed to be due.

The delegation respectfully suggest that questions like these should be settled by the Courts and not by the Legislature.
