Mr. PRESIDENT: The Committee on Engrossment have examined and find correctly engrossed Senate Bill No. 647-An Act granting certain property to the County of Sacramento.

Also, Senate Bill No 639-An Act to create the County of Oristimbo and define its boundaries.

Also, Senate Bill No. 648-An Act to amend an Act entitled an Act to amend an Act entitled an Act to provide for the liquidation and payment of the indebtedness of the City of Marysville, in Yuba County, and for other purposes, approved February fifth, eighteen hundred and sixtyeight, approved March tenth, eighteen hundred and sixty-eight.

Also, Senate Bill No. 555-An Act to authorize the Boards of Supervisors of the Counties of San Mateo and Santa Clara to donate certain railroad stocks to the Southern Pacific Railroad Company, to aid in the construction of the road of said company.

Mr. PRESIDENT: Your Committee on Enrolment respectfully report that they have examined and find correctly enrolled substitute for Senate Bill No. 447-An Act to make, open and establish a public street in the City and County of San Francisco, to be called Montgomery avenue, and to take private lands therefor.

And on the twenty-sixth day of March, eighteen hundred and seventy, at two o'clock and fifteen minutes P. M., presented the same to the Governor for his approval.

Lewis, his heirs or assigns, to institute proceedings to recover certain real estate of James M. Lewis, deceased, escheated to the State of California -and recommend its passage.

Also, Senate Bill No. 424-An Act to prevent litigation between counties and recommend its passage.

Also, Senate Bill No. 479-An Act relating to actions of partitionand recommend its passage.

Also, Senate Bill No. 518-An Act to amend an Act entitled an Act to regulate proceedings in criminal cases, passed May first, eighteen hundred and fifty-one-and recommend its passage.

Also, Assembly Bill No. 257-An Act to amend an Act entitled an Act concerning crimes and punishments, approved April sixteenth, eighteen hundred and fifty-and recommend its passage.

Also, Senate Bill No. 585-An Act to provide for the official valuation of life insurance policies-and recommend the passage of the same without amendments

Also, report back Senate Bill No. 573-An Act to authorize Robert McHenry, administrator of the estate of Henry Langworthy, deceased, to sell the real estate of said estate-with amendments, and recommend its passage.

Also, Senate Bill No. 463-An Act to regulate appeals from Justices' Courts to the County Court of the City and County of San Franciscowith amendments, and recommend its passage.

Also, Senate Bill No. 481-Proposed amendment to the Constitution of the State of California-with amendments, and recommend its passage.

Also, Assembly Bill No. 286-An Act to amend an Act entitled an Act concerning attorneys and counsellors at law, approved February nineteenth, eighteen hundred and fifty-one-with amendments, and recommend its passage.

Also. Assembly Bill No. 311-An Act to amend an Act concerning Courts of justice of this State and judicial officers, approved April twentieth, eighteen hundred and sixty-three-with amendments, and recommend its passage.

Also, Assembly Bill No. 452-An Act to amend an Act entitled an Act to regulate proceedings in civil cases in the Courts of justice of this State, passed April twenty-ninth, eighteen hundred and fifty-one-with amendments, and recommend its passage.

Also, Assembly Bill No. 398-An Act to amend section five hundred and thirty-eight of an Act entitled an Act to regulate proceedings in civil cases in the Courts of justice in this State, approved April twentyninth, eighteen hundred and fifty-one-with amendments, and recommend its passage.

Also, Senate Bill No. 599-An Act to amend an Act to regulate proceedings in criminal cases, passed May first, eighteen hundred and fiftyone-with amendments, and recommend the adoption of the amendments and the passage of the bill as amended.

Also, report back Assembly substitute for Assembly Bill No. 303-An Act to amend an Act entitled an Act to regulate proceedings in civil cases in Courts of justice in this State, passed April twenty-ninth, eighteen hundred and fifty-one, and Acts amendatory thereof and recommend that it do not pass, as the subject matter has already been provided for by Senate Bill No. 93, which has passed the Senate.

Also, Assembly Bill No. 234-An Act to provide for the settlement of statements on appeal and on motion to set aside reports of Commissioners in certain cases-and recommend that it do not pass, as the same matter is already contained in Senate Bill No. 229, which has passed the Senate.

Also, Assembly Bill No. 335--An Act to provide for the appointment of two additional Notaries Public in the County of Solano-and recommend that it do not pass, as the object desired in said bill has already been accomplished by amendment to another bill passed the Senate.

Also, Senate Bill No. 439-An Act to provide for the submission of the proposed amendment to the Constitution of the State, as proposed by the Legislature at its sixteenth session and adopted by the Legislature at its seventeenth session, to the qualified electors of the State-and recommend that it do not pass, as the subject matter has already been provided for by a bill passed the Senate.

Also, Senate Bill No. 529-An Act to amend the Act entitled an Act to regulate proceedings in civil cases in the Courts of justice of this State, approved April twenty-ninth, eighteen hundred and fifty-oneand recommend that it do not pass, as the same matter is contained in Assembly Bill No. 452, passed the Assembly and now before the Senate

for action.

Also, Assembly substitute for Senate Bill No. 5-An Act to amend an Act entitled an Act to provide revenue for the support of the Government of this State, passed May sixteenth, eighteen hundred and sixtyone and recommend that the Senate refuse to concur in the amendment called a substitute for Senate Bill No. 5.

Also, Senate Bill No. 472-An Act supplemental to the Act of February twenty-first, eighteen hundred and sixty-eight, entitled an Act to limit the hours of labor-the committee were unable to agree upon said bill and therefore report the same back for the consideration of the Senate.

Also, report back Assembly Bill No. 160-An Act to protect the people of the State of California from the evils of Asiatic emigration— for consideration of the Senate.

On motion of Mr. Lawrence, the rules were suspended for the consideration of Senate Bill No. 489, above reported.

The rules were further suspended, bill considered engrossed, read a third time and passed.

On motion of Mr. Hager, the rules were suspended for the consideration of Senate Bill No. 583, above reported.

On motion of Mr. Farley, the rules were suspended for the consideration of Senate Bill No. 578-An Act to authorize the Boards of Supervisors of the several counties of this State to grant franchises, in their respective counties, for cleaning out streams and for using the waters of the same for rafting, floating and booming purposes.

The rules were further suspended, bill considered engrossed, read a third time and passed.

On motion of Mr. Roberts, the rules were suspended for the consid eration of Senate Bill No. 505-An Act to regulate the rights of owners of mines.

The bill was considered in Committee of the Whole and amended.
