Mr. PRESIDENT: The Judiciary Committee report back Assembly amendments to the State Constitution No. 3, with amendments thereto, for the consideration of the Senate.

Mr. PRESIDENT: The Committee on Judiciary have had under consideration the following bills: Senate Bills Nos. 39, 138, 70, 88, 177, 72, 156, 210, 222, 226, 232, 286, 363, 364, 367, 368, 370, 369, 389, 74, 220, 429, 435, 445, 475, 638, 574, 322, 326, 359, 379, 378, 565, 277, 36, 64, 108, 129, 161, 608, 40, 29, 337, 480 and 575; also, Assembly Bills Nos. 235, 164, 217, 461, 18, 10 and 12; Assembly substitutes for Assembly Bills Nos. 84, 216, 168, 316, 331, and No. 2 proposed amendment to Constitution of this State, and report the same back and recommend that each bill be indefinitely postponed.

On motion of Mr. Tompkins, the rules were suspended and Assembly Concurrent Resolution No. 64, this day reported from the Assembly, relative to lowering the flag on the dome of the Capitol to half-mast, was taken up and adopted.

Senate Bill No. 654-An Act to relieve the owners of encumbered real estate from double taxation.

Mr. Irwin moved to amend section two by adding the following: "Provided, that nothing in this section contained shall be construed to require the refunding of any moneys which, under existing laws, are required to be paid into the State treasury."

Upon the adoption of which, the ayes and noes were demanded by Messrs. Irwin, Tweed and Green, and the Senate refused, by the following vote:

AYES-Messrs. Beach, Chappell, Comte, Gwin, Hunter, Hutchings, Irwin, Larkin, Murch, O'Connor, Orr, Perkins, Roberts and Tweed-14. NOES-Messrs. Mr. Green moved to amend section two, by striking out, in line three, the word "four," and insert "six."

Mr. Mandeville moved the previous question, which was seconded. Upon the question, "Shall the main question be now put?" the ayes and noes were demanded by Messrs. Comte, Hunter and Green, and the Senate so ordered, by the following vote:

Mr. Farley moved to amend section three, after the word "deposits," in line twelve of printed bill, add "and from all liability to pay the taxes, for the payment of which said deposits were reserved, and all such taxes are hereby remitted."

Adopted.

Mr. Kincaid offered the following amendment: Amend section three by inserting after the word "State," in line ten, printed bill, as follows: "to be by said Treasurer and Controller apportioned between the State and the City and County of San Francisco, in the proportions that each is entitled to by law."

Upon the adoption of which, the ayes and noes were demanded by Messrs Kincaid, Comte and Betge, and the Senate refused, by the fol lowing vote:

Governor's message, returning without his approval Senate Bill No. 243-An Act to empower the Counties of Stanislaus, Merced, Fresno, Tulare and Kern to aid in the construction of a railroad in said counties. Mr. Murch moved to lay the whole subject matter on the table.

Upon the question, "Shall Senate Bill No. 243 become a law, notwithstanding the objection of the Governor?" the roll was called, and the Senate refused, by the following vote:

Mr. Green had the unanimous consent of the Senate to withdraw a notice given by him on yesterday, of a motion to reconsider the vote by which the Senate refused to pass Senate Bill No. 244 over the veto of the Governor.

On motion of Mr. Perkins, Senate Bill No. 43-Proposed amendments to the Constitution of the State of California-was taken up out of unfinished business.

Mr. PRESIDENT: The Committee on Engrossment have examined and find correctly engrossed Senate Bill No. 665-An Act supplementary to an Act entitled an Act to provide for compensating parties whose property may be destroyed in consequence of mobs or riots, approved March twenty-seventh, eighteen hundred and sixty-eight.

Also, Senate Bill No. 661-An Act granting leave of absence to Antonio F. Coronel, Treasurer of the State of California.

Also, Senate Concurrent Resolution No. 33-Relative to a weekly mail from Cottage Grove to Orleans, in Klamath County.

Also, Senate Bill No. 663-An Act to fix the terms of the District Court in the Second Judicial District.

Also, Senate Bill No. 641-An Act concerning the office of Clerk of the Board of Supervisors and Equalization in the County of Placer. Also, Senate Bill No. 451-An Act authorizing the Controller of State to employ an additional clerk.

Also, Senate Bill No. 654-An Act to relieve owners of encumbered real estate from double taxation.

Also, Senate Bill No. 147-An Act for the relief of John Kneland. Also, Senate Bill No. 658-An Act to appropriate money for contingent expenses of the Legislature.

Also, Senate Bill No. 329-An Act to authorize the construction of a railroad from the Town of Santa Clara to the City of San José, in the County of Santa Clara.

amendment.

Also, report back Assembly Bill No. 529-An Act to exempt aged and infirm persons from their liabilities for road poll tax-with amendments; also, Assembly Bill No. 626-An Act concerning the county records of the County of Santa Clara-with amendments, and recommend the adoption of the amendments and the passage of the several bills as amended.
