Mr Farley moved to suspend the rules for the purpose of transmitting the bill immediately to the Assembly.

Mr. Orr raised the point of order that the rules could not be suspended for that purpose.

The Chair decided the point of order to be not well taken, from which Mr. Orr appealed.

On motion of Mr. Ilager, the rules were suspended for the consideration of Senate Bill No. 555—An Act for the endowment of the University of California-heretofore reported from the Assembly, with amend

ments.

On motion of Mr. Hager, the amendments made by the Assembly were concurred in by the Senate.

Pursuant to notice, Mr. Roberts introduced the following resolutions as amendments to the rules of the Senate:

Resolved, That in the consideration of the general and special files, the bills shall be taken up in the order in which they are arranged on the file, and as each bill is called, if there be an objection made to its consideration, such bill shall be temporarily passed until the file shall be called

through, after which the consideration of the file in its order shall be resumed.

Also, the following resolution:

Resolved, That no Senator shall be allowed to speak more than five minutes on any bill, resolution or motion, without the consent of twothirds of the Senators voting

Resolved, That any rule or order may be suspended or repealed by a two-thirds vote; and any Senator may appeal from any decision of the Chair at any time except during roll call, but all questions of order and appeal shall be decided without debate.

On motion of Mr. Pacheco, the rules were further suspended for the consideration of Assembly Bill No. 627, heretofore reported from the Assembly.

The rules were further suspended, bill read a third time and passed. Mr. Orr had leave to introduce the following concurrent resolution :

Resolved by the Senate, the Assembly concurring, That the Enrolling Committee of the Senate be and they are hereby empowered to strike out the following clause in section twenty of Senate Bill No. 568-An Act to reincorporate the City of Stockton: "To grant to any company now incorporated, or hereafter to be incorporated, the exclusive right to lay down and maintain water pipes in and through the streets of the City of Stockton, and through said pipes to supply water for the use of said city and the inhabitants thereof for the term of fifty years, subject to such restrictions and regulations as they may impose upon said company concerning the laying, repairing and using of said pipes; provided, that the Common Council shall have full power at all times to fix and regulate the charges of said company for supplying water to the inhabitants;" and that his Excellency the Governor be requested to deliver said bill to the Enrolling Committee for the purpose above mentioned.

And also refused to concur in Senate amendments to Assembly Bill No. 680-An Act making appropriations for the support of the several charitable institutions therein specified during the twenty-second and twenty-third fiscal years.
